amending Act No. 530 / 1990 Coll., on bonds, as amended, and Act No. 328 / 1991 Coll., on bankruptcy and settlement, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the bankruptcy and settlement law
In Act No. 328 / 1991 Coll., on bankruptcy and settlement, as amended by Act No. 122 / 1993 Coll., Act No. 42 / 1994 Coll., Act No. 74 / 1994 Coll., Act No. 117 / 1994 Coll., Act No. 156 / 1994 Coll., Act No. 224 / 1994 Coll., Act No. 84 / 1995 Coll., Act No. 94 / 1996 Coll., Act No. 151 / 1997 Coll., Act No. 12 / 1998 Coll., Act No. 27 / 2000 Coll., Act No. 30 / 2000 Coll., Act No. 105 / 2000 Coll., and Act No. 214 / 2000 Coll., in Section 32, paragraph 7, including footnote No. 4d., read:
"(7) If the insolvency of the issuer of subordinated bonds is subject to special legislation, (4d) it shall be satisfied in the schedule of claims of the holders of subordinated bonds on those bonds only after all other claims, except those which are subject to the same or similar condition of subordination. Subordinated bond claims and other claims which are subject to the same or similar condition of subordination shall be satisfied according to their order.
4d) § 21a of Act No. 530 / 1990 Coll., on Bonds, as amended. '
Efficacy
This Law shall take effect on 1 January 2001.
