DECLARATION
of 24 September 2008
amending Decree of the Ministry of Defence No. 268 / 1999 Coll., which, for the purposes of service formalities, determines who is considered to be an executive flyer and which service is a service of a special nature or a special degree of danger, and the procedure for the payment of service charges, as amended by Decree No. 458 / 2002 Coll.
According to § 133 (2) and § 143 (11) of Act No. 221 / 1999 Coll., on professional soldiers, the Ministry of Defence provides:
In Decree No 268 / 1999 Coll., which determines for the purposes of the service formalities who is considered to be an executive flyer and which service is a service of a specific nature or degree of danger and the procedure for the payment of the service charges, as amended by Decree No 458 / 2002 Coll., § 2, including the title and footnote 1 to 5, read:
Service of a specific nature or degree of hazard
(1) A service of a particular nature or degree of hazard is a service where a soldier has been assigned to a service
(a) air traffic controllers;
(b) the Executive Paratrooper;
(c) pyrotechnics;
(d) a firefighter who has done dangerous work;
(e) a diver who has performed special underwater work;
(f) firefighters,
(g) related to the performance of explosives;
(h) carrying out activities at a special place of work in the underground;
(i) established by the Defence Minister in Military Intelligence pursuant to a special rule of law (1);
(j) military police officers under special legislation2);
(k) carried out in an environment exposed to the effects of the aggravating effects referred to in § 10 (2) (b), (c), (d), (h) and (j) of Government Regulation No 565 / 2006 Coll., on the pay ratios of professional soldiers, if the activity persists in such an environment for as long as it has received a supplement for working in a difficult working environment (3).
(2) The professional classification referred to in paragraph 1 (a) to (j) is a service of a special nature or a special degree of danger, provided that the soldier received a special surcharge for this activity pursuant to Article 11 of Decree-Law No 565 / 2006 Coll. If the soldier has fulfilled the conditions for entitlement to the specific premium in question but has not received it in order to meet the entitlement to another more favourable supplement (4), the condition for receiving the special premium in question shall be deemed to have been fulfilled.
(3) For the purposes of assessing a service of a specific nature or a specific degree of hazard, the service referred to in points (b) to (h) of paragraph 1 shall mean a service the performance of which continues to predominate the activities of the first category of risks determined by the Minister of Defence under the special legislature5).
