amending Decree No. 104 / 1997 Coll., implementing the Road Act, as amended
The Ministry of Transport and Communications provides pursuant to § 9 (3) of Act No. 13 / 1997 Coll., on Road, as amended by Act No. 132 / 2000 Coll.:
Decree No. 104 / 1997 Coll., implementing the Road Law, as amended, is amended as follows:
1. In the authorisation provision, the words "Paragraph 9 (4) 'are replaced by the words" Paragraph 9 (3)'.
2. In the heading of Part Two, the text in brackets is replaced by the text "to Paragraph 9 (3) of the Act."
3. after Paragraph 10, the following Section 10a is inserted:
Terms of the contract for the management and maintenance of the first class motorway or road
(1) The following elements are always included in the contract:
(a) the names of the Contracting Parties, including the names and surnames of the persons authorised to act for them;
(b) the precise definition of the sections of the first class motorway or road covered by the contract by their station;
(c) the extent, manner and time limits for the removal of defaults in the winter and other periods;
(d) the fixing of the price for the administration and maintenance of the first-class motorway or road, including the method of reimbursement and the deadline for its payment;
(e) the effective date of the contract;
(f) the period for which the contract is concluded;
(g) penalties for non-compliance;
(h) the manner in which the contract is amended and terminated;
(i) other conditions, the content of which shall be determined by mutual agreement of both Parties;
(j) signatures of persons authorised to act on behalf of the Contracting Parties.
(2) In addition, the contract must contain specific arrangements to ensure the administration and maintenance of the first-class motorway or road in crisis situations. 3a)
(3) The contract and any amendments thereto must be concluded in writing.
3a) For example, Act No. 239 / 2000 Coll., on the Integrated Rescue System and on the amendment of certain laws, Act No. 240 / 2000 Coll., on Crisis Management and on the amendment of certain laws (Crisis Act), Act No. 241 / 2000 Coll., on economic measures for emergency situations and on the amendment of certain related laws. '
4. Annex 4 shall read as follows:
