DECLARATION
of 29 November 2024
amending Decree No. 489 / 2021 Coll., on procedures for registration of aid with a market operator and implementing certain other provisions of the Act on Supported Energy Sources (Registration Order)
According to Article 53 (2) (c) to (f) and (i) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Acts, as amended by Act No. 131 / 2015 Coll. and Act No. 382 / 2021 Coll.:
Decree No. 489 / 2021 Coll., on the procedures for registration of aid with a market operator and implementation of certain other provisions of the Act on Supported Energy Sources (Registration Order), is amended as follows:
1. In Article 8 (3), the words "or the amount of the auction bonus' are deleted.
2. In Article 11 (1), the second sentence is replaced by the following: "The transmission system operator, distribution system operator or other gas manufacturer shall inform the market operator and the biomethane manufacturer through the market operator system without undue delay, no later than 7 working days from the date of receipt of the information referred to in the first sentence, whether its data on the identification code of the transfer points, the type of measurement device installed at the transfer point and whether the biomethane production is connected to the transmission system, the distribution system or the device of another gas manufacturer are consistent with the data registered by the producer of the biomethane in the market operator system. '.
3. In Article 13 (2), the word "energy 'and the words" second sentence' are inserted after the word "producer '.
4. In Paragraph 13 (4), at the end of point (c), the words "the amendment made for the following calendar year cannot be re-amended in the market operator system 'shall be added.
5. In Annex 1, the following point 6 is inserted after point 5:
"6. Contact telephone number."
Points 6 to 9 shall be renumbered 7 to 10.
6. Point 7 of Annex 2 reads as follows:
'7. The date of the first parallel connection of the electricity source under the Decree governing the reporting of energy from supported sources. ';
7. In Annex 2, point 14 (f), the words "Annex 3 to Decree No. 141 / 2021 of the Ministry of Industry and Trade Coll., on the Energy Assessment and Data of the Energy Consumption Monitoring System 'are replaced by the words" Statements governing the adequacy of the operational support provided to energy sources'.
8. In Annex 3, point 4, the words "under Paragraph 24 (2) (b) of the Act 'are replaced by the words" heat using biogas, with the exception of landfill and sludge gas, with an installed electrical power up to 500 kW'.
9. In Annex 3 (8) (f) and Annex 4 (12) (f), the words "Annex 3 to Decree No 141 / 2021 Coll., on the Energy Assessment and on the data kept in the Energy Consumption Monitoring System 'are replaced by the words" Decisions governing the adequacy of the provided operational support for energy sources'.
10. In Annex 4, point 6:
'6. Biomethane production type:
a. Biomethane production, which includes biogas plants and biogas treatment, all of which are not more than 5 years old at the date of entry into service (new).
b. Biomethane production, which includes biogas plants and biogas treatment, which is produced by the modification of the electricity or heat plant, where there is no possibility of any other legal aid (conversion).
c. Biomethane production which includes only biogas treatment equipment for biomethane (cleaning). '
11. In Annex 4, point 8, the word "Term 'is replaced by" Date' and the words "under the connection contract 'are deleted.
12. In Annex 4, point 9 reads as follows:
'9. Date of installation and type of measuring device at the transfer point of the biomethane production plant connected to the transport or distribution system or to another gas production plant, or date of installation of the specified meter according to the Metrology Act at the transfer point of the biomethane production plant directly connected to the service station or dispenser. ';
13. Annex 5 (1) (c) reads as follows:
"c. Number of operating hours for high efficiency cogeneration:
i. 3000 hours.
ii. 4400 hours.
iii. 8400 hours.
iv. 6000 hours.
v. 3300 hours. ';
14. In Annex 5 (2) (c):
"c. The process of using biomass in the heat production plant:
i. Pure combustion.
ii. Co-incineration with a non-renewable source.
iii. Municipal waste. ';
Efficacy
This Decree shall take effect on 1 January 2025.
