DECLARATION
of 5 September 2005
concerning the requirements applicable to certain frozen foodstuffs
According to Article 18 (1) (a), (g), (h) and (m) of Act No. 110 / 1997 Coll., on Food and Tobacco Products, and amending and supplementing certain related laws, as amended by Act No. 316 / 2004 Coll., hereinafter referred to as "the Act":
Subject matter
This decree (1) implements the relevant European Union2 provisions and regulates the labelling, minimum technological requirements, storage and handling during marketing, transport and sampling requirements for certain frozen foodstuffs.
Definition of terms
(1) For the purposes of this decree:
(a) freezing - the preservation of foodstuffs by reducing the freezing temperature to a value at which physical, biochemical and microbiological processes in those foods are slowed or stopped;
(b) certain frozen foods - quick-frozen foods which have undergone a freezing process so that the maximum crystal formation zone is overcome as quickly as possible and the final temperature is reached after heat stabilization of -18 ° C or below in all parts of the product.
(2) Ice cream, frozen creams and frozen butter are not considered to be deep-frozen foods.
Labelling
(1) In addition to the information provided in the Regulation on the provision of food to consumers (m3), in the law and in the legislation governing certain labelling of foodstuffs (4), packaging shall be labelled:
(a) in words that the food has been deep-frozen;
(b) the date of minimum durability at or below -18 ° C;
(c) storage temperature,
(d) "Do not freeze again after defrosting."
(2) The consumer packaging shall include information on the duration of the food to be kept by the consumer and the storage temperature. The information shall be indicated by the words "Consumer storage."
Technological requirements
(1) As freezing media that come in direct contact with deep frozen food, only:
(a) air;
(b) carbon dioxide,
(c) liquid nitrogen.
(2) Raw materials used for the manufacture of quick-frozen foodstuffs must comply with the requirements laid down in other implementing regulations (9).
(3) The preparation and freezing of products must be carried out without delay using appropriate technical equipment so that chemical, biochemical and microbiological changes are limited to the minimum possible.
(4) Deep-frozen foodstuffs must be protected by appropriate packaging (5) from microbial or other external contamination and from drying.
(5) Freezer warehouses shall be operated in such a way that they are maintained, with minimum variations in air temperature and circulation, temperature in all parts of the product -18 ° C or lower. The expression of freezing temperatures is given in Annex 1.
(6) In freezer warehouses of less than 10 m3 intended to store stocks in retail stores, temperature measurements may be made with only one well-visible thermometer, which measures temperature at the hottest storage space (6).
(7) Sampling for the measurement of the temperature of quick-frozen food and the actual measurement of temperature is carried out in accordance with the relevant Czech technical standard (7).
(8) The permitted negative mass deviations of the packages of quick-frozen foodstuffs are given in Annex 2.
Marketing
(1) Deep-frozen foodstuffs are transported by means of means of transport which allow the temperature of quick-frozen foodstuffs to be maintained -18 ° C or below. During transport, the temperature of the product may be increased by a maximum of 3 ° C in the short term.
(2) Offers for the sale of quick-frozen foodstuffs in freezer boxes to consumers must be made under conditions such that the temperature of quick-frozen food does not increase by more than 3 ° C.
Transitional provision
Packaging produced before the entry into force of this Order may be used until 30 June 2007 at the latest.
Repeal
The following shall be deleted:
1. Decree of the Ministry of Agriculture No. 326 / 1997 Coll., implementing § 18 (a), (d), (j) and (k) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, for frozen foodstuffs.
2. Decree of the Ministry of Agriculture No. 44 / 2000 Coll., amending Decree of the Ministry of Agriculture No. 326 / 1997 Coll., implementing § 18 (a), (d), (j) and (k) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws for frozen foodstuffs.
3. Decree of the Ministry of Agriculture No. 160 / 2002 Coll., amending Decree of the Ministry of Agriculture No. 326 / 1997 Coll., implementing § 18 (a), (d), (j) and (k) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, for frozen foodstuffs, as amended by Decree No. 44 / 2000 Coll.
Efficacy
This Decree shall take effect on 1 January 2006.
