on measures in relation to the Federal Republic of Yugoslavia (Serbia and Montenegro) and the areas of the Republic of Bosnia and Herzegovina under the control of the forces of the Bosnian Serbs
The Bureau of the Federal Assembly of the Czech and Slovak Federal Republic, having regard to United Nations Security Council Resolution 757 (1992), has acted pursuant to Article 58 (3) of Constitutional Law No. 143 / 1968 Coll., on the Czechoslovak Federation, on the following legal measure:
(1) Imports of all goods and other products originating in the territory of the Republic of Bosnia and Herzegovina under the control of the forces of the Bosnian Serbs and then exported to the territory of the Czech and Slovak Federal Republic are hereby prohibited.
(2) The activity of natural persons residing in the Czech Republic and legal persons domiciled in the Czech Republic, as well as any activity of other persons in the territory of the Czech and Slovak Federal Republic, which would support or count on the promotion of the export or transit of all goods or products originating in the territory of the Republic of Bosnia and Herzegovina under the control of the forces of the Bosnian Serbs, is prohibited.
(3) Any disposal of all goods and goods originating in the territory of the Republic of Bosnia and Herzegovina under the control of the forces of Bosnian Serbs and subsequently exported by Czechoslovak natural and legal persons in the territory of the Czech and Slovak Federal Republic, as well as ships flying the Czechoslovak flag and aircraft imatricated in the Czech and Slovak Federal Republic or hired by Czechoslovak natural and legal persons, shall be prohibited.
(4) Any transfers of money within the territory of the Republic of Bosnia and Herzegovina which are under the control of the Bosnian Serb forces for the purpose of the activities referred to in paragraph 2 or the disposal referred to in paragraph 3 shall be prohibited.
(1) The sale or supply of any goods or products, whether or not originating in the territory of the Czech and Slovak Federal Republic, carried out by natural persons resident in the territory of the Czech Republic, or by legal persons domiciled in the territory of the Czech Republic, including the use of ships flying the flag of the Czech Republic and aircraft imatricated in the Czech Republic or hired by natural persons residing in the territory of the Czech Republic, or by legal persons established in the territory of the Czech Republic, by any person or institution in the territory of the Republic of Bosnia and Herzegovina, under the control of the forces of Bosnian Serb, as well as any person or institution for the purpose of any trade carried out or controlled by the territory of the Republic of Bosnia and Herzegovina, which are controlled by the forces of Bosnia and Herzegovina shall be prohibited.
(2) The prohibition referred to in paragraph 1 shall not apply to sales or supplies intended exclusively for medical purposes, foodstuffs and other necessary humanitarian needs, the export of which will be authorised under the provisions of § 7.
(3) Any activity of natural persons residing in the territory of the Czech Republic and of legal persons domiciled in the territory of the Czech Republic, as well as any activity of other persons in the territory of the Czech and Slovak Federal Republic, which supports or plans to support the activity referred to in paragraph 1, shall be prohibited.
(4) The prohibition set out in paragraphs 1 and 3 shall apply to all States in the territory of the former Socialist Federal Republic of Yugoslavia if it concerns the sale or supply of weapons and military equipment.
(1) Transfers of funds or any financial or economic resources to authorities within the territory of the Republic of Bosnia and Herzegovina under the control of the forces of Bosnian Serbs, or to any natural or legal person operating in the territory of the Republic of Bosnia and Herzegovina under the control of the forces of Bosnian Serbs, as well as to any natural or legal person managed or directly or indirectly controlled by such entities, irrespective of their registered office or residence, by natural or legal persons located in the territory of the Czech and Slovak Federal Republic shall be prohibited.
(2) This prohibition shall also apply to any other means of providing funds, financial or economic resources, including the return of funds to the persons and institutions referred to in paragraph 1.
(3) The prohibition set out in paragraphs 1 and 2 shall not apply to payments intended solely for medical or humanitarian purposes and payments for the supply of foodstuffs on the territory of the Republic of Bosnia and Herzegovina under the control of the forces of the Bosnian Serbs.
The provision of services, both financial and other domestic persons, to natural and legal persons for the purposes of any business in the Republic of Bosnia and Herzegovina under the control of the forces of the Bosnian Serbs shall be prohibited. This prohibition shall not apply to telecommunications, postal services and legal assistance, as well as services necessary for humanitarian or other exceptional purposes, provided that authorisation has been granted pursuant to Paragraph 7.
Natural persons residing in the territory of the Republic of Bosnia and Herzegovina under the control of the forces of Bosnian Serbs and legal persons domiciled in that territory, as well as legal persons owned or controlled directly or indirectly by such persons, may not engage in business, business or engage in business in the territory of the Czech Republic. This prohibition shall not apply to activities for which authorisation has been granted pursuant to Paragraph 7.
The entry into ports of river merchant ships flying the flag of the Czech Republic on the territory of the Republic of Bosnia and Herzegovina under the control of the Bosnian Serbs shall be prohibited except in cases of emergency or on the basis of an authorisation granted under Section 7.
(1) The activities referred to in § 2 (2), § 4a, 6a and 6b may only be carried out on the basis of an authorisation granted by the competent central administration on a case-by-case basis. When granting authorisation, this authority shall proceed with the obligations arising for the Czech Republic from membership of the United Nations.
(2) The general rules on administrative procedures shall not apply to the authorisation referred to in paragraph 1.
(3) The application for authorisation referred to in paragraph 1 shall be submitted to:
(a) the Ministry of Industry and Trade, if it is an export permit pursuant to § 2 (2) or to the activities referred to in § 6a;
(b) Ministry of Transport, if it is for authorisation to enter ports pursuant to § 6b,
(c) the Ministry of Foreign Affairs, if it is for authorisation to provide services under § 4a.
If the goods and products are exported from the Czech Republic, the border customs office shall withdraw the permit on exit.
This legal measure shall not apply to:
(a) diplomatic missions of the Czech Republic;
(b) activities related to the United Nations Security Forces (UNPROFOR), the Convention on Yugoslavia or the European Communities' Monitoring Mission.
This legal measure shall take effect on the date of its publication.
