of 17 August 2005
on the emission of pollutants in the exhaust gases of positive ignition engines of certain non-road mobile machinery
The Government mandates pursuant to § 22 to implement § 12 (1) (a) to (c) and § 13 (2) of Act No. 22 / 1997 Coll., on technical requirements for products and amending and supplementing certain laws, as amended, (hereinafter referred to as "the Act on Technical Requirements for Products') and to implement Act No. 56 / 2001 Coll., on the Conditions for the operation of vehicles on the road and amending Act No. 168 / 1999 Coll., on Insurance of Liability for Damage caused by the operation of a vehicle and on the amendment of certain related laws (Act on Vehicle Liability Insurance), as amended by Act No. 307 / 1999 Coll., (hereinafter referred to as" the Act on the Approval of Technical Competence of Vehicles'):
Subject matter
(1) This Regulation implements the relevant provisions of the European Community (1) and regulates the requirements for the permissible emission of pollutants in exhaust gases of positive-ignition engines of mobile machinery and equipment not intended for use on the road, and auxiliary engines fitted to equipment in a road vehicle, special vehicle, craft, motor vehicle or special-purpose vehicle ("railway vehicle") with a net power of 19 kW or less ("mobile machine").
(2) Mobile machines with positive-ignition engines are, for example:
(a) lawn mowers and horticultural equipment carriers, including motor soil milling machines;
(b) chainsaws,
(c) hand-held drill;
(d) portable machine saw and cutter for cutting hard materials such as stone, steel,
(e) a stationary power generator, or installed in a road vehicle, a special vehicle, a vessel or a groove vehicle;
(f) welding equipment,
(g) stationary refrigerated or air-conditioned equipment, or installed in a road vehicle, special vehicle, vessel or train vehicle;
(h) water pump and suction equipment;
(i) grass and shrub miners,
(j) garbage disposal;
(k) portable hedge shears;
(l) lawn sweeper, vacuum cleaner or leaf blowers,
(m) lawn aerator and cultivator,
(n) snow cleaning and snow milling equipment;
(o) golf cart,
(p) a blower and compressor; and
(q) equipment with auxiliary engine (for example, ventilation, hot air blowing).
(3) This Regulation shall not apply to positive-ignition engines intended for propulsion:
(a) recreational vehicles, such as motor sleigh, go-karts, off-road motorcycle and car; and
(b) mobile machinery intended for use by the armed forces.
(4) This Regulation is without prejudice to other technical requirements for mobile machinery laid down by specific legislation2).
Definition of terms
(1) This Regulation shall apply:
(a) a specified product, a positive-ignition engine as defined in Section 1;
(b) the approval authority of the Ministry of Transport,
(c) a technical service legal person authorised by the approval authority to carry out approval activities;
(d) an engine type of a mobile machine engine which does not differ in essential characteristics from engines of the same category and class of the same manufacturer; the model of the document showing the essential characteristics of the engine type is set out in Annex 4 to this Regulation,
(e) a family of engines specified by the manufacturer by the manufacturer of the engines produced, having its design given similar characteristics with regard to exhaust pollutant emissions and meeting the requirements of this Regulation;
(f) the parent engine of the engine selected from the engine family representing that engine family; an example of the procedure for selecting the characteristics of the parent engine is given in point 2 of Annex 3 to this Regulation,
(g) the net power of the engine, measured in kW, measured in accordance with the Regulation of the European Communities (3), at the end of the crankshaft or equivalent engine outlet, the measured power shall be increased by the power of the cooling fan when the cooling fan has been used in the measurement;
(h) the engine identification number of the engine which differs from the engines of the same manufacturer which are of the same type, category, class, power and degree of emission characteristics; the engine identification number may be the engine's production number or the engine's production number is part of the engine identification number; the engine identification number and other documentation of the manufacturer may be used to identify the engine production series or, where applicable, the date of manufacture of the engine,
(i) the information documents provided by the manufacturer with all test reports or other documents attached to the manufacturer's documentation by the technical service or approval authority during the performance of its functions;
(j) a list of the information package indicating the aggregate content of the information package with appropriate numbering or other marking enabling the unambiguous identification of all pages;
(k) a replacement engine newly produced engine which is made available on the market only for replacement of the original motor of the mobile machine;
(l) a handheld mobile machine, a mobile machine which, during the work to which it is intended, meets at least one of the following requirements:
1. is held or carried by an operator;
2. can work in different positions,
3. is guided by the operator or is a generator or pump and the mass of this mobile machine without fuel and lubricants is less than 20 kg;
(m) the degree of emission characteristics of the positive-ignition engine as determined by the level of emissions of pollutants in the exhaust gas for the class of positive-ignition motor of the mobile machine; the emission performance level shall be valid over a specified period of time and shall be identified by numbers, with lower emissions of pollutants in the exhaust gases being introduced by a higher emission level; the emission limit values for the positive-ignition engine of the mobile machinery of stage I and stage II are set out in Annex 2 to this Regulation,
(n) the service life of the emission characteristics, the number of hours specified in the requirements laid down for each category of positive-ignition engine of the mobile machine; an example of the emission durability range for each class of positive-ignition engines for stage II emission characteristics is given in point 4 of Annex 2 to this Regulation,
(o) gaseous pollutants in particular substances whose limit values are set in this Regulation and are carbon monoxide with the chemical brand CO, HC hydrocarbons (expressed in C1: CH1,85 equivalent) and NOx oxides (expressed in nitrogen dioxide equivalent with the chemical mark NO2), and
(p) a manufacturer of small series of positive-ignition engines of a manufacturer whose total annual production is less than 25 000 units or whose total annual production of the positive-ignition family is less than 5 000 units.
(2) For the purpose of determining the emissions of pollutants in exhaust gases, small positive ignition engines of mobile machinery are divided into two categories:
(a) in a handheld mobile machine marked "SH"; and
(b) in a mobile machine other than a handheld "SN."
(3) The categories of SH and SN mobile machinery are further divided into seven classes according to the lifting volume, class
(a) SH: 1, having a lifting capacity of less than 20 cm3,
(b) SH: 2, having a lifting capacity of 20 cm3 or less up to and including 50 cm3,
(c) SH: 3, having a lifting capacity of 50 cm3 or more,
(d) SN: 1, having a lifting capacity of less than 66 cm3,
(e) SN: 2, having a lifting capacity of 66 cm3 or more, up to and including 100 cm3,
(f) SN: 3, having a lifting capacity of 100 cm3 or more, up to and including 225 cm3 and
(g) SN: 4, having a lifting capacity of 225 cm3 or more.
The engine intended for the mobile machinery and its components which may affect the emissions of pollutants in the exhaust gases whose limits for the engine class and the relevant emission stage are set out in Annex 2 to this Regulation shall be so designed, constructed and assembled that the emissions of pollutants in the exhaust gases of such an engine when the mobile machine is put into service do not exceed the prescribed limits and, for the emission stage II engine, do not exceed the limits for the period specified in point 4 of Annex 4 to this Regulation.
Details of type-approval
(1) A separate application shall be submitted for each engine type or family to be approved.
(2) The approval documents shall contain the documents referred to in the information document, the model of which is set out in Annex 4 to this Regulation.
The approval authority shall assign an approval number in accordance with Annex 6 to this Regulation to an approved engine type or engine family and shall indicate it in the EC type-approval certificate, a model of which appears in Annex 5 to this Regulation.
When amending the decision on the approval of a type of engine or engine family, the approval authority shall adapt the approval documentation together with its list and indicate the changes thereto. The approval authority shall indicate in the information package the date on which the decision to amend the approval takes effect.
Test procedures for positive-ignition engines
The emission of pollutants in the exhaust gases of positive ignition engines of mobile machinery shall be determined by the technical service. When testing the positive-ignition engine, technical service
(a) uses a reference fuel with a defined composition as specified in Annex 9 to this Regulation for engine propulsion;
(b) comply with the determined measurement procedure and test cycles as set out in Annex 8 to this Regulation;
(c) when measuring emissions of pollutants of an engine type or parent engine, use analytical and sampling systems, as specified in Annex 10 to this Regulation; and
(d) the test result is processed in a specified manner and recorded in the test report; the mandatory information in the test report on pollutants of the positive-ignition engine of a mobile machine is set out in Annex 7 to this Regulation.
Specified identification of mobile machinery engines
(1) The manufacturer shall place the basic marking set out in Annex 1 to this Regulation on each positive-ignition engine of a mobile machine manufactured in conformity with the approved type.
(2) The replacement positive-ignition engine of the mobile machine shall be marked with at least a degree of emission performance that has been fulfilled by the original engine, the replacement engine of which is to be used. A label containing the text "Replacement engine 'shall be affixed to the engine or shall be provided in the user manual to the replacement engine.
Transitional provisions
(1) From the date of entry into force of this Regulation, the Approval Authority shall decide on the type-approval or extension of the type-approval for a positive-ignition engine of class SN: 3, SN: 4, SH: 1, SH: 2 and SH: 3 mobile machinery, provided that this engine complies with the requirements of this Regulation and the emissions of pollutants in the exhaust gases comply with the engine emission characteristics set out in point 2 of Annex 2 to this Regulation.
(2) The approval authority shall decide, as from the date of entry into force of this Regulation, on the type-approval or extension of the type-approval for a positive-ignition engine of Class SN: 1 and SN: 2 mobile machinery, provided that this engine complies with the requirements of this Regulation and the emissions of pollutants in exhaust gases comply with the engine emission characteristics set out in point 3 of Annex 2 to this Regulation.
(3) A positive-ignition motor of an SN and SH-class mobile machine may not be placed on the market after six months from the date of entry into force of this Regulation unless it complies with the requirements laid down in paragraphs 1 and 2, not for a mobile machine or a positive-ignition motor of a mobile machine intended for export to a State which is not a Member State of the European Union.
(4) The approval authority shall decide on the type-approval or extension of the type-approval for a positive-ignition engine of a Class Mobile Machine
(a) SN: 4 after 1 August 2006,
(b) SH: 1, SH: 2 and SN: 3 after 1 August 2007, and
(c) SH: 3 after 1 August 2008,
if the engine complies with the requirements of this Regulation and the emissions of pollutants in the exhaust gases comply with the engine emission characteristics set out in point 3 of Annex 2 to this Regulation.
(5) Mobile class positive-ignition engine
(a) SN: 4 after 1 February 2007,
(b) SH: 1, SH: 2 and SN: 3 after 1 February 2008, and
(c) SH: 3 after 1 February 2009,
may not be placed on the market if the engine does not comply with the requirements of this Regulation and the emissions of pollutants in the exhaust gases do not comply with the emission characteristics of the engine set out in point 3 of Annex 2 to this Regulation, unless it is a mobile machine or a positive-ignition motor of a mobile machine intended for export to a State not a Member State of the European Union.
(1) The requirements set out in paragraphs 1 to 3 of Section 9 concerning the emission characteristics referred to in points 2 and 3 of Annex No 2 to this Regulation for type-approval, extension or placing on the market shall apply to positive-ignition engines of mobile machinery manufactured before the application of this Regulation after 1 August 2006.
(2) For positive-ignition engines of mobile machinery manufactured before the dates referred to in paragraphs 4 and 5 of Section 9, the time limits relating to emission characteristics referred to in points 2 and 3 of Annex 2 to this Regulation for type-approval, extension or placing on the market shall be extended by 2 years.
(3) The requirements referred to in § 9 (2) and (3) relating to the emission characteristics referred to in point 3 of Annex No 2 to this Regulation for type-approval, extension or placing on the market, apply after 1 August 2007 to a positive-ignition two-stroke engine of Class SN: 1 and SN: 2 in the snow mill.
(4) For spark-ignition engines in the following mobile machines:
(a) a hand-held chainsaw which complies with EN ISO 11681-1 is designed for cutting wood and its positive-ignition engine has a lifting capacity greater than 45 cm3 and is of class SH: 2 or SH: 3,
(b) a mobile machine which complies with EN ISO 11681-2 has a handle at the top, for example, a hand-held drill or a chainsaw for cutting wood and its positive ignition engine is SH category;
(c) a shrubbery kernel, which is hand-held, has a rotating blade of steel or plastic, is designed for cutting weeds, bushes, small trees and similar vegetation, is designed according to EN ISO 11806 so that it can be operated in multiple positions, its positive ignition engine has a lifting capacity greater than 40 cm3 and is of class SH: 2 or SH: 3;
(d) portable hedge shears which comply with EN 774 are hand held, are intended to be cut by live hedges and shrubs using one or more reversing blades, and their positive-ignition engine is SH category; and
(e) a hand-held motor cutter complying with EN 1454, having a rotating metal sheet, is designed to cut hard materials such as stone, asphalt, concrete, or steel, and its positive-ignition engine has a lifting capacity of more than 50 cm3 and is of class SH: 3, a mobile machine with a positive-ignition engine of class SN: 3 with a horizontal shaft having an engine power of not more than 2,5 kW. Such a mobile machine is, for example, an electric power generator, lawn aerator, cultivator and cylinder cutter,
the deadlines referred to in paragraphs 9 (4) and (5) relating to the emission characteristics referred to in point 3 of Annex 2 to this Regulation for type-approval, extension or placing on the market shall be extended by 3 years.
(5) The requirements referred to in § 9 (2) and (3) relating to the emission characteristics referred to in point 3 of Annex No 2 to this Regulation for type-approval, extension or placing on the market, apply to spark-ignition engines of class SN: 1 and SN: 2 produced by a manufacturer of small series of positive-ignition engines after 1 August 2007.
(6) For positive-ignition engines of mobile machinery produced by a manufacturer of small series of positive-ignition engines, the time limits referred to in paragraphs 9 (4) and 9 (5) relating to the emission characteristics referred to in paragraphs 2 and 3 of Annex 2 to this Regulation for type-approval, extension or placing on the market shall be extended by 3 years.
Efficacy
This Regulation shall enter into force on 1 January 2006.

ENGINE MARKING
1. A positive-ignition engine approved in accordance with this Regulation shall bear the basic marking; the content of the basic designation is:
(a) the trade mark or trade name of the engine manufacturer;
(b) the EC approval mark, which is the EC type-approval number in Annex 6 to this Regulation,
(c) the engine identification number.
2. The essential marking of the engine shall be durable during the service life of the engine, legible and indelible; if they are used for the essential marking of the engine, the label or label shall be durable during the service life of the engine and shall be destroyed in the attempt to remove them, or the particulars indicated therein shall become illegible.
3. The basic marking shall be placed on the part of the engine which is necessary for normal operation and which normally does not require replacement during the service life of the engine. The basic marking shall be placed on an engine fitted with all the auxiliaries necessary for its operation so that it is clearly visible to a person of average size.
4. Each engine and, where applicable, the mobile machine concerned shall bear, in addition to the basic marking, an additional removable label of durable material, which shall contain all the engine information referred to in point 1; the supplementary label shall be so placed that the information on it is clearly visible to a person of average size after the engine has been installed in the mobile machine.
5. The location of the parent engine of a mobile machine shall be specified by the manufacturer in the information document referred to in point 3 of Annex 4 to this Regulation. The approval authority shall specify this location in the EC type-approval certificate of an engine model set out in Annex 5 to this Regulation.
6. Before the engine leaves the production line, it shall bear a basic marking.

INTERNAL VALUES OF EMISSIONS OF DISTORTED SUBSTANCES, CONDITIONS OF THEIR INSURANCE, SUPERVISORY AND ASSESSMENT OF CONFORMITY OF PRODUCTION
1. the emission of gaseous pollutants from the engine submitted for testing shall be measured in accordance with this Regulation. In case of stage The emission characteristics of the positive-ignition engine shall be compared to the limit values specified in point 2 of Table 1. In case of stage II emission characteristics, the measured values are first corrected and the values thus adjusted are compared to the limit values specified in point 3 of Table 2.
2. Level I emission characteristics of the positive-ignition motor of the mobile machine. The measured emissions of pollutants in the exhaust gases, which are carbon monoxide, hydrocarbons, nitrogen oxides and the sum of the emissions of hydrocarbons and nitrogen oxides, shall not exceed the values given in Table 1 for stage I emission characteristics of the positive-ignition engine representing the engine type or parent engine of the engine family.

3. Level II emission characteristics of the positive-ignition motor of the mobile machine. The measured corrected emissions of pollutants in the exhaust gases, which are carbon monoxide, nitrogen oxides and the sum of the emissions of hydrocarbons and nitrogen oxides, shall not exceed the values given in Table 2 for stage II emission characteristics of the positive-ignition engine representing the engine type or parent engine of the engine family.

4. In the case of stage II emission characteristics, the measured and corrected emissions of pollutants in the exhaust gases of the positive-ignition engine of the mobile machine shall not exceed the values given in Table 2 for the entire period specified for the relevant class and durability category of that engine. Mobile machinery engines are divided into three categories of service life of emission properties according to the durability of their emission properties. The engine shall be classified in the relevant emission durability category by its manufacturer. The emission durability categories for positive-ignition engines of mobile machinery are defined as follows:

5. The corrected emissions of the pollutant shall be calculated by multiplying the measured value by an appropriate deterioration factor of more than 1 for stage II emission characteristics of the engine. The magnitude of the deterioration factor depends on the type of pollutant, the engine category and class. The deterioration factor shall be determined in accordance with Annex 8 to this Regulation and its value determined in the range 1,1 to 2,1.
6. Conditions for compliance with emission characteristics. When installing an engine in a mobile machine, the limits set for the scope of type approval and the following parameters of the approved engine shall be complied with:
(a) the intake vacuum shall not exceed the vacuum value for the approved engine as specified in the manufacturer's information document and other documents processed by the manufacturer in accordance with Annex 4 to this Regulation;
(b) the back pressure in the exhaust shall not exceed the back pressure value for the approved engine as specified in the manufacturer's information document and in other documents processed by the manufacturer in accordance with Annex 4 to this Regulation.
7. The engine manufacturer and, where applicable, the holder of the approval shall ensure effective quality control of production and conformity of production control, in particular:
(a) there shall be procedures in place in production to ensure that the requirements of paragraphs 1 and 2 of this Annex are consistently met and that further ensure conformity of production with the approved type;
(b) the manufacturer and, where applicable, the holder of the approval shall have guaranteed access to the test equipment;
(c) where applicable, the manufacturer shall record and keep records of the tests carried out;
(d) the manufacturer and, where appropriate, the holder of the approval shall analyse the results of each test.
8. Approval authority
(a) check records of tests carried out;
(b) carry out a control test to a specified extent at least once a year;
(c) in the event of non-conformity, carry out the additional tests referred to in point 8 at the request and at the expense of the manufacturer to demonstrate conformity of production on the basis of a statistical evaluation of the measured engine samples.
9. If, when checking the conformity of production, a controlled positive-ignition engine of a mobile machine does not comply with the requirements laid down in this Regulation for the emission of pollutants in exhaust gases, the manufacturer may request, for the demonstration of conformity of production, the re-measurement and statistical evaluation of a number of engines taken from the same series to which the engine was registered.
(a) In agreement with the approval authority, the manufacturer shall determine the number of additional engines to be subjected to a repeated check of conformity with the statistical assessment. The number of such engines will be n, where n is greater than or equal to 2. For engines taken for repeated tests, the emissions of pollutants shall be measured in accordance with this Regulation. The engine manufacturer shall transmit the engines to the tests in full or in part run-in, as appropriate.
(b) For each pollutant "x" the arithmetic mean X shall be determined from all "n" values of the measured value of that pollutant after correction, if applicable, for the relevant emission factor "xi"

(c) In addition, the measurement values shall be determined from the measured values after any correction for the relevant emission grade "xi" and from the arithmetic mean X by using the formula:

(d) Conformity of serial production shall be considered satisfactory if the condition for all pollutants is met

PARAMETERS DEFINITING THE FAMILY OF ENGINES AND DETERMINING THE BASIC ENGINE
1. Family of engines.
Only engines with similar exhaust emission characteristics may be included in the engine family. The engine family is determined by design parameters which are common to the family engines. For some engines, different design parameters may interact. When the engine is included in the family, it is necessary to apply knowledge of the interaction between the design parameters of the engine under consideration.
Engines belonging to the same family shall have the same basic parameters or characteristics:
(a) two-stroke or four-stroke combustion cycle;
(b) air, water or oil coolant;
(c) the lifting volume of a single cylinder shall be between 85% and 100% of the maximum lifting volume of the parent engine;
(d) air intake method;
(e) fuel type,
(f) combustion chamber design;
(g) valves and ducts, in particular whether the valves and ducts are of the same configuration, dimensions and number;
(h) the fuel system, in particular whether the carburettor fuel system, indirect injection or direct injection is used;
(i) design solutions; and
(j) the subsequent treatment of the exhaust gas, in particular whether the exhaust gases are processed by an oxidation catalyst or a reducing catalyst or a three-way catalyst or a heat reactor or a particulate filter.
2. Choice of parent engine.
When determining the parent engine that characterises the engine family
(a) the main criterion is the maximum fuel delivery per stroke at the speed indicated for the maximum torque; in the case of two or more engines simultaneously fulfilling this criterion, the maximum fuel delivery per stroke at rated speed shall be used as an additional condition for the choice of the parent engine;
(b) the approval authority may decide that the worst emission levels of pollutants of the engine family shall be determined by testing another engine or another engine; The approval authority shall then select another engine from the engine family for testing, the characteristics of which indicate that exhaust pollutant emissions will be the worst,
(c) it is necessary to take into account other other characteristics of the engine family which could be regarded as affecting the emission of exhaust pollutants and to take them into account when selecting the parent engine.
