DECLARATION
of 28 November 2024
amending Decree No 275 / 2022 Coll., on administrative security and on classified information registers
The National Security Authority shall determine, pursuant to Articles 23 (2) and 79 (8) of Act No. 412 / 2005 Coll., on the Protection of classified information and on security competence, as amended by Act No. 32 / 2008 Coll., Act No. 255 / 2011 Coll. and Act No. 267 / 2024 Coll.:
Decree No 275 / 2022 Coll., on administrative security and on classified information registers, is amended as follows:
1. in Article 1, the words "and the procedure for the cancellation of the register" shall be added at the end of the text of point (e).
2. in § 2 (c), (d) and (g), § 3 (1) (b) and (f), § 12 (1), § 21 (2) and (3), § 22 (2), § 26 (3), § 27 (1), § 28 (3), § 30 (1) (f), § 34 (2) (b) and § 35 (4) and § 35 (5), the words "or acting natural persons" shall be replaced by the words "pursuant to § 60b of the Law or of an entrepreneur."
3. In Article 4 (1), the words "or the name, surname and registered office of the natural person undertaking 'are replaced by the words" pursuant to Article 60b of the Act, by a commercial firm or by the name of the entrepreneur or by the name, surname and registered office of the entrepreneur'.
4. In Paragraph 4 (1), the words "second and third 'are replaced by the words" first and second'.
5. In the third sentence of Article 5 (3), the word "file 'shall be inserted after the words" Minutes in the control sheet'.
6. In Article 5 (4), the last sentence is replaced by the following: "After the exclusion, dispatch or cancellation of the classified document, the control sheet or records referred to in paragraph 3 shall be kept at the registration place where the classified document or file has been registered for at least 5 years, unless otherwise specified in Article 31 (3); the control sheet may be destroyed after that period. ';
7. in § 7 (1) (f), § 31 (4), § 32 (4) and § 33 (5), the words "or any natural person in business for whom" shall be replaced by the words "pursuant to § 60b of the Act or by an entrepreneur for whom."
8. In Article 7 (2), the words "or doing business by a natural person 'are replaced by the words" pursuant to Article 60b of the Act or by an entrepreneur'.
9. In Articles 7 (3) and 17, the words "or other registration marks' are deleted.
(10) In Paragraph 8 (1), the sentence "The additional marking referred to in the second sentence shall not contain a territorial limitation on the validity of the secrecy."
11. in Paragraph 8 (2):
"(2) The classified document in paper form shall be marked in the middle of the upper and lower edges of each side of the classified document containing the information. In the case of a classified document of a foreign authority, the classification level, including the abbreviation provided for in Article 21 (2) of the Act, shall be indicated at least in the middle of the top of the front of the first sheet of the classified document. If it is not possible to mark the classification in accordance with the first and second sentences, it shall be marked in another way. ';
12. In Paragraph 8, the following paragraphs 3 and 4 are inserted after paragraph 2:
"(3) The level of confidentiality may also be marked as part of the further classification of the classified document in:
(a) part of a classified document; or
(b) one or more successive paragraphs (hereinafter referred to as "section of text");
classified information contained therein. In the case of a part, the classification shall be indicated in accordance with the first sentence of paragraph 2. For the relevant section of the text, the classification level shall be indicated in brackets at the beginning and at the end of the section of the text verbally referred to in paragraph 1 or using the abbreviation "(PT) 'for the classification level Top Secret," (T)' for the classification level Secret, "(D) 'for the classification level Confidential and" (V)' for the classification level Reserved. In the event of a classification level being indicated on the same side of the classified document, the appropriate classification level shall be indicated for all sections of the text containing classified information and for sections of the text which do not contain classified information, in brackets at the beginning and at the end of the section of the text shall be marked in capital letters in writing or stamped with the word "NEUTAILED 'or abbreviation" (N)'.
(4) The originator shall be entitled to mark on a classified document sections of text which do not contain classified information by indicating, in brackets at the beginning and at the end of the section of text, in capital letters in writing or by stamping, the word "UNEUTAYED 'or abbreviation" (N)'. '.
Paragraphs 3 and 4 shall become paragraphs 5 and 6.
13. in Article 9 (1), "paragraph" is replaced by "section of text."
14. in Article 9 (2), the words "classified document or file as referred to in the first sentence" shall be replaced by "such classified document or file."
15. in Article 10 (3), the words "or the name, surname and registered office of the person who has received the classified document by mistake" shall be replaced by the words "pursuant to Article 60b of the Act, the company or the name and address of the entrepreneur or the name, surname and registered office of the person who has received the classified document by mistake."
16. in Article 11 (1), the words "natural persons engaged" shall be replaced by the words "pursuant to Article 60b of the Act, the entrepreneur."
17. in § 12 (1), § 16 (3), § 30 (1) to (3) and § 35 (1), the words "or an operating natural person" shall be replaced by the words "under § 60b of the Act or an entrepreneur."
18. In Paragraph 12 (2), the words "the receipt of a classified document or the assignment of a number of negotiations for a classified document 'are replaced by the words" the assignment of a number of negotiations for a classified document created or after the receipt of a classified document'.
19. in Article 12 (3), the words "sentences 2 and 4" shall be deleted;
20. in Paragraph 13 (5), the word "created" shall be deleted;
21. In Articles 14 (1), 14 (4) and 16 (1), the words "or the name, surname and registered office of the natural person in respect of whom" shall be replaced by the words "pursuant to Article 60b of the Act, a commercial firm or the name of the entrepreneur or the name, surname and registered office of the entrepreneur in respect of whom."
22. In Paragraph 14 (4), the words "classification level," and the words "and place" shall be deleted and the words "shall be added at the end of the third sentence"; if the Annex does not contain classified information, the words "Non-classified Annex No... k...." shall be inserted. "
23. In Article 14, at the end of paragraph 6, the sentence "Where the classification level of the Annex has been changed or deleted before disconnection, the person carrying out its disconnection shall enter on this Annex the text of the alert on the classified document or file referred to in the third sentence of Article 9 (1). ';
24. In Paragraph 19 (3), "3 'is replaced by" 5'.
25. in Article 21 (2) and Article 26 (3), the words "or an undertaking natural person" shall be replaced by the words "under Article 60b of the Act or by an entrepreneur."
26. in Articles 22 (4) and 23 (4) and (6), "courier services" is replaced by "courier."
27. in Article 22 (4), the words "or the name, surname and registered place of business of the natural person 'shall be replaced by the words" pursuant to Article 60b of the Act, by a business company or by the name and address of the entrepreneur or by the name, surname and registered office of the entrepreneur';
28. in Articles 22 (5) and 23 (2), the words "under the Protocol" shall be replaced by the words "at the registered place where the classified document is registered."
29. In Article 23 (4), at the end of the third sentence, the words "if the courier is a person under § 58a (1) of the Act, it shall be proved by a lesson and a service card if it has been issued to him."
30. In Article 23 (6), "2 to 'is replaced by" 4 a';
31. in Article 24 (1), the words "or the name, surname and registered office of the natural person undertaking" shall be replaced by the words "pursuant to Article 60b of the Act, the company or the name of the entrepreneur or the name, surname and registered office of the entrepreneur."
32. in Article 25 (1), the words "and surname" shall be inserted after the words "name only."
33. In Paragraph 26 (1), the word "returned" shall be replaced by "returned"; the word "returned" shall be replaced by the word "transmitted"; the words "or, if it is not possible to determine the year of the shredding procedure when the classified document or file is deposited, the shredding period shall be deleted; and the sentence" If not, when the classified document or file is deposited, the year of the shredding procedure shall be indicated. 34. 37. in Article 31 (3), the words "or dispatch" shall be replaced by the words "dispatch or cancellation of the security level."
38. in Paragraph 31 (4) (d), the words "or updates" shall be deleted;
39. in Paragraph 31 (4), in the final part of the provision, the words "in the form of a new list" shall be inserted after the word "updated."
40. in Article 32 (3), the words "to the auxiliary register" shall be deleted;
41. The heading of Part Four reads:
"PERSON CHANGES, LAW OF THE STATE AUTHORITY, LEGAL PERSONS REFERRED TO IN ARTICLE 60B OF THE LAW OR ENTERPRISE '.
42. The heading of § 35 reads:
"Ensuring the protection of classified information at the end of a State institution, an organisational component established by a State authority, a legal person under Section 60b of the Act or an entrepreneur '.
43. In Paragraph 35 (2), the words "natural persons engaged" are replaced by the words "entrepreneurs."
44. in Paragraph 35 (6), the word 'which' shall 'shall be replaced by' an entity to which ';
45. in Paragraph 36 (1), the words "in particular electronic, phototech, chemical, physicochemical, radiotech, optical and mechanical military technology and military equipment containing classified information" shall be replaced by "and military equipment containing classified information, in particular electronic, phototech, chemical, physicochemical, radiotech, optical and mechanical military technology, including assets of certified information systems and cryptographic devices."
46. In Annex No 1, the words "or operating natural persons' are replaced by the words" pursuant to § 60b of the Act or of the entrepreneur '; in the instructions for completion, the word "howls' is replaced by the word" were 'and the text "§ 26 (4)' is replaced by" § 28 (5) '.
47. 48. 49. In Annex 6, the words "or the name, surname and registered place of business of the natural person undertaking 'are replaced by the words" pursuant to Section 60b of the Act, the business name or name of the entrepreneur or the name, surname and registered office of the entrepreneur' and the words "or the natural person undertaking 'are replaced by the words" pursuant to Section 60b of the Act or the entrepreneur'.

56. In the heading of Annex No 15, the words "/ persons engaged in the activity 'are replaced by the words" pursuant to Section 60b of the Act / Entrepreneur'.
Transitional provision
Administrative aids drawn up in accordance with Annexes 1, 3, 4, 6 and 7, as effective before the date of entry into force of this Order, may be used after the entry into force of this Order, provided that they are carried out in the manner laid down in Decree No. 275 / 2022 Coll., on administrative security and on registers of classified information, as amended by that Order.
Efficacy
This Decree shall take effect on 1 January 2025.
