DECLARATION
of 6 September 2005
on the management of school documentation and school matrices and the transmission of school and school documentation data and school matrices (Decree on school and school documentation)
The Ministry of Education, Youth and Sports provides, pursuant to § 28 (6) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act):
Scope and form of management of school matrices
§ 1
Data on the course and results of the education of the child, pupil or student in the school matrices 1) contain, depending on the nature of the school's activities:
(a) the description of the framework training programme and the school training programme under which the child or pupil is trained, or, where appropriate, the accredited training programme under which the student is trained;
(b) a description of the rules for assessing the results of pupil and student education (2) in force at the time when education is provided to the pupil or student at the school concerned;
(c) the designation of the class, department or study group to which the child, pupil or student is assigned and the name and surname of the class teacher, head of department or head of study group teacher; in the case of a class, department or study group with a modified training programme or with an extended teaching of certain subjects or groups of subjects or classes with a sports focus, that fact shall also be indicated;
(d) the names of the relevant compulsory, optional, compulsory optional or optional subjects or other comprehensive sections of the teacher or, where appropriate, of the interest services, the names and surnames of their teachers or heads and the data on the assessment of the results of the education of the pupil or student in those subjects, other comprehensive sections of the teaching and interest services;
(e) educational measures and assessment of the behaviour of the pupil, where the conduct is assessed;
(f) the number of compulsory school years completed and the manner in which it is carried out, if the pupil carries out compulsory school years;
(g) data on school attendance, data on excused and unexcused missed lessons, data on days in which the suspended hours of compulsory pre-school education have been excused or unexcused;
(h) details of any transfer of a pupil or student between schools or reassignment to another school class or study group; and
(i) details of the issue of a certificate, certificate or diploma of discharge.
§ 1a
Data on the support measures recommended by the school guidance institution and granted and provided to the school or school establishment to a child, pupil or student with special educational needs registered in the school matrices (5) shall include:
(a) the predominant degree of support measures granted and the handicap identifier as recommended by the educational institution if issued (6);
(b) support measures provided for by the school or school facilities (6);
(c) adjustments to the content and expected outcomes of education;
(d) the organisational form of the training provided that it results from the recommendation of the educational institution;
(e) information on training under the individual training plan; and
(f) the validity of the recommendations of the educational institution.
§ 2
The school and the school institutions run the school matrix in electronic or paper form.
Transmission of data from school documentation and school facilities and from school matrices
§ 3
(1) The legal person carrying out the activities of the school or school establishment shall transmit from the documentation of the schools and school establishments and from the school register:
(a) data relating to individual children, pupils, students and applicants for admission to education (hereinafter referred to as "individual data") in the terms, manner and to the extent set out in Annex 1 thereto;
(b) data resulting from the aggregation of individual data and other data relating to schools or educational establishments (hereinafter referred to as "aggregated data") in the terms, manner and to the extent specified in Annex 2 to this Regulation;
(c) details of the support measures granted to the child, pupil or student (hereinafter referred to as "data on support measures") in the terms, manner and extent set out in Annex 3 to this Decree;
(d) the data from the reports and recommendations recommending the postponement of compulsory education and the comments on the individual education of the pupil issued by the educational institution at the dates, manner and extent specified in Annex 4 to this decree.
(2) The data transmitted shall be based on the content and documentation of the school or school establishment on the date set out in Annexes 1 to 4 to this Regulation (hereinafter referred to as the "applicable date '). The transmitted data referred to in paragraph 1 shall also include changes in the content of the school matrices and documentation of the school or school establishment that have taken place since the corresponding relevant date in the preceding calendar year.

(4) Upon transmission of the data referred to in paragraph 1, the legal person operating the school or school establishment shall indicate his telephone connection and e-mail address and, where appropriate, the name and surname of the natural person who prepared the data for transmission.
(5) The data referred to in paragraph 1 shall be transmitted to a database managed by the Ministry of Education, Youth and Sports (hereinafter referred to as "the Ministry ') or established and entrusted by a legal person. To the extent necessary for the performance of their tasks, the regional authorities and municipal authorities of the municipalities with extended scope to ensure the receipt of the data transmitted to the database shall also have access to this database. The individual data in the database shall be accessed only by authorised staff of the Ministry or by authorised staff of the legal person referred to in the first sentence.
(6) If the last day for data transmission is Saturday, Sunday or holiday, the last day for data transmission is the next working day.
§ 3a
The Ministry or the legal person established by it shall anonymise personal data processed under this Order as soon as the purpose for which they were collected has ceased, but no later than 30 years after their first processing.
§ 4
(1) Individual data shall be transmitted in accordance with the descriptions of individual data structures and code lists for the transmission of individual data in a published way allowing remote access.
(2) Aggregated data shall be transmitted on forms containing the data referred to in Annex 2 to this Regulation and the models of which shall be published in a way which allows remote access.
(3) The data referred to in Annex 3 to this Regulation are to be transmitted, in the case of parent schools, primary schools, secondary schools, conservatories and higher vocational schools, in accordance with the descriptions of individual data structures and code lists for the transmission of individual data in a manner that allows remote access, in the case of other schools and educational establishments, using a form containing the data listed in Annex 3 to this Regulation, and the model of which is published in a manner that allows remote access.
(4) The descriptions of the structures referred to in paragraph 1 shall be published no later than 3 months before the relevant date; the code lists referred to in paragraph 1 shall be published no later than 6 months before the date of transmission of individual data. Models of the forms referred to in paragraph 2 shall be published no later than 3 months before the relevant date or, where appropriate, no later than 6 months before the relevant date, in the case of the transmission of data relating to the period before that date.
(5) The descriptions of the structures and the model of the form referred to in paragraph 3 shall be published no later than 3 months before the relevant date; the code lists referred to in paragraph 3 shall be published no later than 6 months before the date of transmission of the individual data.
§ 4a
(1) Separated from school matrices and documentation of schools or school establishments shall be transmitted for each workplace in the case of:
(a) the data referred to in Article 6 of Annex 1 to this Decree and Article 8 of Annex 2 to this Order;
(b) primary schools the data referred to in Article 5 of Annex 1 to this decree and Article 9 of Annex 2 to this decree;
(c) secondary schools the data referred to in Article 4 of Annex 1 to this decree;
(d) school cooperatives the information referred to in Article 10 of Annex 2 to this decree;
(e) school catering facilities, the data referred to in Article 13 of Annex 2 to this Decree;
(f) the data referred to in Article 14 of Annex 2 to this Decree,
(g) pedagogical-psychological advice on the information referred to in Article 15 of Annex 2 to this Order;
(h) specifically the pedagogical centre, the data referred to in Article 17 of Annex 2 to this decree; and
(i) the training centres, the data referred to in Article 18 of Annex 2 to this Decree.
(2) For the purposes of paragraph 1, a place of work shall mean any place where education or provision of school services is carried out and, in the case of a forest nursery school, the territory where, in particular, a pedagogical programme is carried out and where the school has facilities, registered in the school register, which:
(a) they are not connected to another place or territory of the school or school establishment in a spatial way;
(b) is not linked to any other place or territory of the school or school establishment by construction or technical means; and
(c) not located on the same or adjacent parcel.
§ 5
Efficacy
This Decree shall take effect on the day of its publication, with the exception of the provisions of Paragraph 4 (3), which shall take effect on 1 January 2006.

Transmission of individual data

METHOD OF TRANSMISSION OF INDIVIDUAL DATA
Dates and means of transmission
(1) Individual data from school matrices and school documentation are transmitted electronically. Data other than data to be transmitted pursuant to paragraph 2 shall be transmitted to the database referred to in Article 3 (5).
(a) by 15 April at the relevant date of 31 March of the same school year, in addition to the information on applicants for admission to education; the data transmitted also include changes in the content of the school matrices and school documentation that have taken place since 1 September of the preceding calendar year; and
(b) by 15 October at the relevant date of 30 September of the same school year, except for data transmitted pursuant to Article 2, which shall be transmitted by 15 November at the relevant date of 31 October of the same school year.
(2) The data referred to in Article 3 (1) (f) (6), Article 4 (1) (f) (6), Article 5 (1) (f) (7), Article 5 (2) (f) (3) and Article 6 (1) (e) (3) shall be transmitted to the database referred to in Article 3 (5).
(a) by 15 April for the period 1 September to 31 January of the same school year; and
(b) by 15 October for the period 1 February to 30 June of the previous school year.
(3) The legal person performing the school's activities on the basis of individual data transmitted by it shall receive an electronic extract of aggregated statistical information from the transmitted data from the database referred to in Article 3 (5) and, if deficiencies are found in the inventory, shall ensure that it is corrected. The principal of the school shall confirm the accuracy of the data and shall send it without undue delay to the Ministry, if the school is established by the Ministry, or to the municipal authority of the municipality with extended competence, if the school is established by the municipality or association of municipalities, or the regional authority, if other schools are involved.
(4) The municipal authority of the municipality with extended competence or the regional authority shall draw up a report on the extract of aggregated statistical information from the school documentation after the school has transmitted the information referred to in paragraph 3 to it and transmit it to the Ministry or the legal person established by it. The municipal authority of the municipality with extended competence and the regional authority shall enter in the protocol the name, telephone connection and e-mail address of the employee who prepared the report.
(5) Individual data are not transmitted on students in the field of education in the field of security law in higher vocational schools established by the Ministry of Interior.

TRANSMISSION OF INDIVIDUAL DATA BY LEGAL PERSONS CARRYING OUT THE SCHOOL'S ACTIVITIES
Transmission of individual data from school matrices and documentation of higher education
(1) A basic set of data shall be transmitted on each student of a higher vocational school, which shall include:
(a) the school department identifier and the relevant date;
(b) student identification:
1. the birth number or, failing that, the date of birth and sex,
2. citizenship,
3. the municipality in which the place of permanent residence or, where applicable, the place of residence in the Czech Republic according to the type of residence of a stranger, or the State in which the student resides, if not the Czech Republic,
(c) details of previous student education:
1. previous place of employment of a newly admitted student, in particular secondary school, higher vocational school, foreign school,
2. the department identifier of the school in which the student obtained secondary education with a graduate examination, the field of education, the year of completion of the graduate examination,
3. the highest degree of education achieved by the student before taking up higher education,
(d) details of the start of education in the relevant higher vocational school, including the date and code of the start of education in the relevant field of education and the form of education;
(e) details of completion of education at the competent higher education institution:
1. the date and code of termination of education in the relevant field of education and the form of education in a higher vocational school;
2. an indication of how the training ends,
3rd series and the number of the form for the certificate of discharge issued and the diploma of discharge in a higher vocational school,
(f) details of the course of higher vocational training:
1. the code of the relevant field of education, including the last two or three numbers covered by the accredited training programme, form of education, duration of education;
2nd year in which the student is educated, the total duration of the suspension, including holidays,
3. identification of study group;
4. language of instruction, foreign language codes studied by the student,
5. code of course, repetition of year, interruption of education,
6. sources of student education funding,
(g) discharge data:
1. whether the student successfully carried out or failed to discharge, the date of discharge;
2. the code of the conduct of the test, in due time, of the tests, of the repair tests, of the repair defence or of the replacement tests,
3. the code of the foreign language from which the student performs discharge, or the code that the student did not pass the foreign language exam; and
(h) control items:
1. control resolution of student or graduate school,
2. date and type of data change code;
3. the beginning and expiry of the data sentence.
(2) A student with special educational needs, a student in a study group or a school set up under Section 16 (9) of the Education Act, a student in accordance with an individual curriculum and a gifted and extremely gifted student shall also be transmitted in an anonymous form supplemented by:
(a) the student code established by the legal person operating the school only for the purpose of transmitting individual data in anonymised form, which ensures that the transferred data are unmistakable with that of other students, but does not allow the student to be identified;
(b) an indication of whether the student is a student referred to in Article 16 (9) of the Education Act, which is included in a study group or school set up under Article 16 (9) of the Education Act, an indication of any training under an individual training plan and an indication of any talent or exceptional talent of the student;
(c) the nature of the disadvantage of the student which prevents the fulfilment of his or her educational possibilities on an equal basis with others, the handicap identifier; and
(d) an indication of the support measures granted and granted.
(3) The applicant for admission to higher education shall be provided with a set of data containing:
(a) the school department identifier and the relevant date;
(b) identification details of the tenderer:
1. the birth number or, failing that, the date of birth and sex,
2. citizenship,
3. the municipality in which the place of permanent residence or, where applicable, the place of residence in the Czech Republic according to the type of residence of a stranger, or the State in which the applicant has his place of residence, if not the Czech Republic,
(c) details of previous training of the tenderer:
1. previous position of applicant, in particular secondary school, higher vocational school, foreign school
2. the department identifier of the school in which the candidate obtained secondary education with a graduate examination, the field of education, the year of completion of the graduate examination,
(d) details of the training to which the applicant applies, including the field of education, duration and form of education; and
(e) details of the outcome of the admission procedure and, where applicable, information on the training for which the applicant has been accepted, including the field of education, duration and form of training and the registration of the candidate for training in the relevant higher vocational school.
Transmission of individual data from school matrices and conservatory documentation
(1) Each pupil of the Conservatory shall be given a basic set of data containing:
(a) the school department identifier and the relevant date;
(b) the student's identification details:
1. the birth number or, failing that, the date of birth and sex,
2. citizenship,
3. the municipality in which the place of permanent residence or, where applicable, the place of residence in the Czech Republic according to the type of residence of a foreigner, or the State in which the pupil is resident, if not the Czech Republic,
(c) details of previous education of the pupil:
1. the previous place of employment of a newly admitted student, in particular primary school, secondary school, foreign school,
2. the type and department identifier of the school in which the pupil was trained prior to admission to the Conservatory;
3. the highest degree of education achieved by the pupil before being admitted to the Conservatory;
(d) information on the start of education in the relevant conservatory, including the date and code of start of education in the relevant field of education and form of education;
(e) data on termination of training in the relevant conservatory:
1. date and code of termination of education in the relevant field of education and form of education in the Conservatory;
2. an indication of how the training ends,
3rd series and form number for the certificate of discharge issued and the diploma of discharge in the Conservatory and the certificate of graduation,
(f) data on the course of education in the Conservatory:
1. code of the relevant field of education, form of education, duration of education, type of education,
2nd year in which the pupil is educated, the total duration of the suspension, including holidays, of the number of compulsory school years completed,
3. information on education in the second main field,
4. language of instruction, codes of foreign languages studied by the pupil,
5. code of course, repetition of year, interruption of education,
6. indication of excused and unexcused missed lessons,
7. sources of education funding for the pupil,
(g) data on discharge or, where appropriate, graduation test:
1. an indication of whether the pupil has successfully completed or failed to complete the discharge or, where applicable, the final examination, the date of discharge or, where applicable, the final examination,
2. the code of the conduct of the test, in due time, of the tests, of the repair tests, of the repair defence or of the replacement tests,
3. the code of the foreign language from which the pupil performs the discharge, or, where appropriate, the comic test or the graduation exam, or the code that the pupil did not pass the foreign language exam; and
(h) control items:
1. control resolution of the pupil or graduate of the school,
2. date and type of data change code;
3. the beginning and expiry of the data sentence.
(2) When transmitting data on pupils with special educational needs, pupils who are trained in accordance with an individual training plan and a gifted and exceptionally gifted pupil, the provisions of Article 2 (2) shall be treated mutatis mutandis.
Transmission of individual data from school matrices and secondary school documentation
(1) A basic set of data is transmitted to each secondary school pupil, which contains:
(a) the school department identifier and the relevant date;
(b) the student's identification details:
1. the birth number or, failing that, the date of birth and sex,
2. citizenship,
3. the municipality in which the place of permanent residence or, where applicable, the place of residence in the Czech Republic according to the type of residence of a foreigner, or the State in which the pupil is resident, if not the Czech Republic,
(c) details of previous education of the pupil:
1. the previous place of employment of a newly admitted student, in particular primary school, secondary school, foreign school,
2. the type and department identifier of the school in which the pupil was trained before receiving secondary education;
3. the highest degree of education achieved by the pupil before receiving secondary school education;
(d) information on the start of education at the relevant secondary school, including the date and code of start of education in the relevant field of education and form of education;
(e) data on completion of education at the secondary school concerned:
1. date and code of termination of education in the relevant field of education and form of education in secondary school;
2. an indication of how the training ends,
3rd series and the number of the form for the final examination certificate issued and the teaching certificate or, where applicable, the graduation certificate,
(f) data on the course of secondary education:
1. code of the relevant field of education, form of education, duration of education, type of education,
2nd year in which the pupil is educated, the total duration of the suspension, including holidays, of the number of compulsory school years completed,
3. class identification,
4. language of instruction, codes of foreign languages studied by the pupil,
5. code of course, repetition of year, interruption of education,
6. indication of excused and unexcused missed lessons,
7. sources of education funding for the pupil,
(g) details of the completion of the senior or final examination:
