DECLARATION
of 28 June 2006
on the method of determination of the concentration of odour substances, the permissible levels of odour harassment and the method of detection
According to Article 55 (3) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Act on Air Protection), as amended by Act No. 92 / 2004 Coll., Act No. 180 / 2005 Coll., Act No. 695 / 2004 Coll., Act No. 385 / 2005 Coll. and Act No. 212 / 2006 Coll., ("the Act ') for the implementation of Article 10 (2) of the Act:
Allowed level of odour harassment
(1) The permissible level of odour annoyance is the state of odour in ambient air to be achieved, where available, by removing or limiting the harming odour.
(2) The excess of the permissible level of odour harassment shall be assessed on the basis of a written complaint from persons residing or working in the area where odour harassment occurs.
(3) The permissible level of odour harassment shall be exceeded whenever more than 20 persons complain of odour harassment in accordance with paragraph 2 and where at least one of the operators of stationary sources has been found to be in breach of the law which has caused the exceeding of the permissible level of odour harassment.
Method of determination of odour concentration
(1) The determination of the concentration of odour substances shall be carried out on the stationary sources listed in the Annex to this Decree in accordance with the procedure laid down in this Decree and the Czech Technical Standard ČSN EN 13725 (hereinafter referred to as "Technical Standard"). The determination of the concentration of odour substances does not apply to small stationary sources.
(2) The determination of the concentration of odour substances referred to in paragraph 1 shall be carried out:
(a) on the date laid down in the authorisation provided for in Article 17 (1) (d) of the Act when the stationary source is put into service;
(b) after any change to which a permit has been granted by the competent authority under Article 17 (2) (f) of the Act,
(c) after any significant and permanent intervention in the construction or fitting of a stationary source device which could lead to a change in the concentration of odour substances;
within 3 months of the occurrence of one of the facts referred to in points (a) to (c).
(3) The concentration of odour substances shall be assessed by the Panel referred to in the technical standard. The determination of the concentration of odoriferous substances may be waived where its determination poses a risk to the health of the members of the Commission.
(4) Sampling for the determination of the concentration of odour substances shall be carried out at the site prior to the result of waste gas into the air or elsewhere in accordance with the principles laid down in the Ministry of the Environment Bulletin.
(5) The sampling time shall be adjusted to the expected concentrations and carried out over a period of at least 1 hour, with each individual sampling time within 5 to 15 minutes.
(6) When determining the concentration of odour substances, at least 3 samples shall be taken at each measuring site. The resulting concentration of odoriferous substances in the source waste gas is the geometric mean of the results of each sampling.
Determination of odour concentration
Determine the concentration of odour substances at the latest
(a) by 1 August 2007 for the stationary sources listed in Part A of the Annex to this Decree,
(b) by 1 August 2008 for the stationary sources listed in Part B of the Annex to this Decree; and
(c) by 1 August 2009 for the stationary sources listed in Part C of the Annex to this Decree.
Efficacy
This Decree shall take effect on 1 August 2006.

Stationary sources for which the concentration of odour substances is determined
A.
1. Food Industry
1.1 A slaughterhouse with a slaughter capacity above 50 t / day
1.2. Fish processing
1.3 Bakeries
1.4. Dried eggs
1.5. Processing of chocolate products
1.6 Manufacture of tobacco products
1.7 Smokers
1.8 Roasting of coffee, coffee substitutes, cocoa beans or nuts
2. Extract of vegetable oils and animal fats and refining of vegetable oils
3. Laminating of wood, metal, textile, fibres and plastics (manufacture of composite materials based on organic resins).
B.
1. Rubber processing and rubber production
2. Residues of wood and virgin pulp paper - valid for production capacity from 20 tonnes / day inclusive
3. Industrial wood processing - drying of native wood in drying plants with a design capacity of more than 50 m3 and drying of its disintegrated particles in drying plants with a design capacity of more than 3t / h, production of fibreboard, fibreboard and OSB plates.
C.
1. Waste water treatment plants
1.1 Urban waste water treatment plants with a projected capacity of 2000 or more equivalent inhabitants
1.2 Industrial waste water treatment plants handling waste water in excess of 50 m3 / day from the processes of emiting sulphan or ammonia or chlorine
2. Veterinary rendering equipment
3. Manufacture of feedingstuffs from slaughter by-products
4. Manufacture of technical fats from slaughter by-products
5. Industrial composting plants and equipment for waste treatment
6. Manufacture of pharmaceutical intermediates
7. Landfills that receive more than 10 tonnes of waste per day or have a total capacity of more than 25 000 tonnes, except for the landfill of inert waste.
