DECLARATION
of 4 November 2013
amending Decree No 314 / 2007 Coll., on the minimum limit on claims and minimum standards on insurance contracts of insolvency administrators
The Ministry of Justice provides pursuant to § 39 of Act No. 312 / 2006 Coll., on Insolvency Managers, as amended by Act No. 296 / 2007 Coll.:
Decree No 314 / 2007 Coll., on the minimum limit of claims and minimum standards of insurance contracts of insolvency administrators, is amended as follows:
1. Paragraph 2 shall be added at the end of the text of paragraph 1 "; for natural persons who have the right to perform the function of insolvency administrator of the debtor referred to in Article 3 (2) of the Act, the amount of CZK 10 000 000 'shall be determined.
2. In Article 2 (2), the words "the amount of CZK 1 000 000 multiplied by the number of members declared 'are replaced by the words" the sum of the amounts which would have been fixed to each of the members declared pursuant to paragraph 1'.
3. In Article 2, the following paragraph 3 is added:
"(3) The minimum level of insurance premiums is set for one insurance event."

Minimum standards for insurance contracts
The insurance shall be subject to the liability of the insolvency administrator for any damage caused by his or her performance or omission in the performance of the functions of the insolvency administrator, or in connection with him or her, or by the performance or omission of his or her staff in the performance of his or her duties, where the performance or omission occurred during the period of insurance. ';
Transitional provision
The insurance contract, which fulfils the conditions laid down in Decree No 314 / 2007 Coll., as effective before the date of entry into force of this Order, shall be deemed to comply with the conditions of Decree No 314 / 2007 Coll., as effective after the date of entry into force of this Order.
Efficacy
This Decree shall take effect on 1 January 2014.
