on Members of the Czech National Council
The Czech National Council decided on this law:

ČÁST PRVNÍ

GENERAL PROVISIONS
Basic provisions
§ 1
(1) The post office is a matter of social honor and responsibility. Members of the Czech National Council (hereinafter referred to as "Members') participate in the implementation of state power by the Czech National Council. They act as members of the Czech Socialist Republic High Representative Corps on fundamental issues of internal policy, participate in the creation and implementation of laws and other resolutions of the Czech National Council and control their implementation and compliance.
(2) Members shall ensure that all their activities are worthy of the trust of their constituents. In the performance of its duties, it shall be governed by social interests. It acts to reconcile social interests, local and individual interests.
(3) Members help to develop the active participation of citizens in the governance and administration of the state and defend their legitimate interests. They are involved in the preparation and implementation of election programmes of the National Front in their constituencies.
§ 2
Members are in contact with and cooperate with their constituents. In their constituencies, they shall continue to cooperate in particular with the national committees, the National Front authorities and the organisations in the National Front, the working groups and the authorities themselves. They consult voters on the issues discussed by the Czech National Council, take care of proposals, initiatives and comments from voters and use the lessons learned in their activities in the Czech National Council and in its institutions.
Members' term of office
§ 3
(1) The Member shall acquire his or her rights and obligations by election. The procedure for elections is governed by the Czech National Council law.
(2) The Czech National Council, acting on a proposal from the Mandate and Immunity Committee, verifies the validity of the election of a Member.
§ 4
(1) The Member takes a constitutional oath at the constituent meeting of the Czech National Council. It will do so by 'I promise' and by giving a hand to the President. A Member who did not make a promise at the constituent meeting, or who was elected in the supplementary elections, shall make a promise at the meeting of the Czech National Council, which will take part for the first time.
(2) Refusal of a promise or a promise, subject to reservation, shall result in the loss of a mandate. The Czech National Council, acting on a proposal from the Mandate and Immunity Committee, will issue a loss of mandate.
§ 5
Upon verification of the validity of the election, the Member shall receive a Member's pass.
§ 6
(1) The term of office of a Member ends on the end of the term of office of the Czech National Council.
(2) The term of office of Members who are members of the Bureau of the Czech National Council ends with the election of the Bureau of the newly elected Czech National Council.
§ 7
The Member may be removed from the decision of his or her constituents at any time; the procedure for the removal of a Member is governed by the law of the Czech National Council.
§ 8
(1) A Member who has ceased to be electable loses his mandate. The Czech National Council, acting on a proposal from the Mandate and Immunity Committee, will issue a loss of mandate.
(2) The Member also loses his mandate for the reasons laid down by the Constitutional Law.
§ 9
The Member may waive his mandate in writing. The mandate will expire on the day on which the Presidency of the Czech National Council takes note of the resignation.

THE ACTIVITIES OF THE MEMBERS IN THE CZECH NATIONAL COUNCIL AND IN THE RESULTS
Activities of Members in the Czech National Council and its bodies
§ 10
(1) The Member is obliged to participate actively and actively in the negotiations and work of the Czech National Council and its bodies to which he has been elected and to contribute with his knowledge and experience to addressing the issues under discussion.
(2) If, for serious reasons, a Member cannot take part in the proceedings or work of the Czech National Council or of its institution, he shall apologise to the President of the Czech National Council or to the President of the institution of which he is a member.
§ 11
The Member has the right to decide on all issues discussed in the Czech National Council and its bodies of which he is a member; elects the bodies of the Czech National Council and can be elected to them.
§ 12
Members shall in particular be entitled to:
(a) make proposals on all matters falling within the competence of the Czech National Council;
b) submit draft laws of the Czech National Council to the Czech National Council and initiatives to draft laws of the Czech National Council,
c) Submit initiatives to the Czech National Council to submit a bill to the Federal Assembly,
(d) submit proposals, initiatives and comments to the Czech National Council and its bodies on the draft laws submitted;
e) request from the Bureau of the Czech National Council the assistance and information needed to perform the parliamentary function and request information from the President of the Czech National Council,
(f) take part in the consultative meetings of committees of which they are not members,
(g) to interfere with the Government of the Czech Socialist Republic and its members and to ask them questions about their respective responsibilities,
h) request from the members of the Government of the Czech Socialist Republic as well as from the heads of the other central bodies of the Czech Socialist Republic the information, explanations and documentation necessary for the performance of the parliamentary function;
(ch) request from the heads of other state bodies and socialist organisations the information, explanations and supporting documents necessary for the performance of the parliamentary function;
i) on the basis of the mandate of the Czech National Council or its bodies to participate in cooperation with the Slovak National Council and the Federal Assembly and their bodies,
j) participate in surveys organised by the bodies of the Czech National Council, if they are in charge.
Activities of Members in electoral districts
§ 13
(1) Members are obliged to be in contact with their constituents.
(2) Members shall cooperate with the national committees, the national front bodies and the organisations associated with it, the working groups, the authorities of self-administration, as well as other bodies and organisations in the constituency. They use their knowledge and experience in their activities in the constituency, the Czech National Council and its institutions.
(3) In cooperation with the regional authorities of the National Front, Members may inform the public about their activities and activities of the Czech National Council also through mass media.
§ 14
(1) Members are obliged to file accounts with voters of their activities in the Czech National Council and in the constituency and report to them on the activities of the Czech National Council.
(2) Members shall also be obliged to account voters for their activities if voters so request through the competent authority of the National Front operating in their constituency.
(3) Members use, in particular, public meetings of citizens, plenary sessions of national committees, meetings of organisations associated in the National Front and assembly of collective labour.
§ 15
Members shall in particular:
(a) consult voters, the National Front authorities and organisations in the National Front, working groups and self-government bodies on draft laws and other serious measures to be discussed in the Czech National Council and its bodies;
b) explain to voters the fundamental issues of socialist state policy, familiarise them with the laws and other measures taken by the Czech National Council, obtain them for their fulfilment and inform them of their implementation;
(c) to use in their parliamentary activities the experience of contacts with voters, the national front authorities and the organisations involved in it, working groups and self-government bodies, as well as their initiatives, comments and complaints;
(d) respond to the voters' comments and suggestions and inform them how they have been dealt with.
§ 16
Members shall in particular be entitled to:
(a) to attend the plenary sessions of the national committees in their constituency, with the vote of the consultative committees and the meetings of their bodies;
(b) participate in meetings and meetings convened in its constituency by the national committees, the national front authorities and the organisations associated with it, the authorities of self-administration and the working groups meetings;
(c) draw the attention of the Heads of State bodies and socialist organisations to infringements of the law, state discipline and labour discipline and to demand their immediate removal;
(d) to participate in the hearing and handling of complaints, notifications and initiatives of citizens and organisations in their constituency by state authorities and socialist organisations;
(e) cooperate with the popular control committees in their constituencies and encourage them to carry out checks and verifications. Use the results of the monitoring activities of the popular control committees in their parliamentary work.

ARRANGEMENTS
§ 18
Regional association of Members
(1) The Regional Assembly of Members brings together Members elected in constituencies in the territory of the same region or in the territory of the capital city of Prague (hereinafter referred to as the "regions").
(2) In regional associations of Members, Members, in cooperation with the National Front Regional (City) Committee, are familiar with the important issues of the economic and social development of the region. The Regional Assembly of Members shall also discuss the tasks related to the activities of its members in the constituency, or proposals submitted to the Czech National Council, if relevant, to address important social issues as well as those related to the development of the region. They also help unify the work of Members in constituencies and contribute to the exchange of experience in the performance of parliamentary functions.
(3) Incentives obtained in regional associations of Members are used by Members in their activities in the Czech National Council and in the constituencies.

GUARANTEES OF EMPLOYMENT
§ 19
General principles
(1) The State guarantees the necessary conditions for the performance of the parliamentary function.
(2) Members are protected by the Constitution and enjoy parliamentary immunity.
(3) The publication of the speeches of Members delivered in the Czech National Council and its institutions is not subject to any restrictions, not on a private meeting or part thereof.
(4) Those who prevent Members from exercising their rights and obligations or affect their honour and dignity as public officials shall be liable under the law.
(5) State bodies and socialist organisations and their heads of staff provide assistance to Members in the performance of their duties.
Obligations of the institutions and organisations
§ 20
(1) Members of the Government of the Czech Socialist Republic, the heads of other central bodies of the Czech Socialist Republic, the heads of other state bodies and the heads of socialist organisations are obliged to provide the Members with information, explanations and documentation relating to the performance of their duties and to accept it at his request; in urgent cases, they shall be obliged to receive Members without delay.
(2) The heads of the institutions and organisations referred to in paragraph 1 are required to deal with the initiatives and observations of Members and to inform them of their use or processing within 30 days at the latest. In the same way, they are obliged to inform Members of the handling of complaints, initiatives and notifications made to them by citizens and to allow them to participate in the examination of such complaints.
§ 21
(1) The Heads of State institutions and socialist organisations are required to inform Members of the measures they have taken to remedy the breach of legality, state discipline or labour discipline which they have been brought to their attention within 30 days at the latest.
(2) If the Member is not satisfied with the measures taken, the superior bodies or organisations shall, at the request of the Member, examine the procedure of the subordinate body or organisation within 30 days and report thereon.
§ 22
The National Committee of the City of Prague, the Regional National Committees and the Regional National Committees working in the constituencies of Members invite Members to their plenary sessions. They also invite Members of the Federal Assembly to their meetings.
§ 23
The Regional National Committees, in cooperation with the National Front authorities and the organisations associated with them, are required to provide public meetings of citizens and meetings with voters and to provide the necessary material and organisational assistance to Members. They shall perform the same duties against Members of the Federal Assembly.

DISCIPLINARY MEASURES
§ 28
(1) Members who make a statement at the meeting of the Czech National Council or of its institution which is contrary to the status and honour of the Member may be subject to disciplinary action.
(2) Disciplinary proceedings with a Member are governed by the Act on Rules of Procedure of the Czech National Council.

§ 29
This Act shall take effect on 1 April 1989.
