on ensuring the accuracy of selected meters
In agreement with the relevant ministries and central authorities pursuant to Section 9 of Act No. 35 / 1962 Coll., the Standards and Measurement Office provides for a measure service:
Rights and obligations of national measure services bodies
The Office for Standardisation and Measurement (hereinafter referred to as "the Authority ') shall ensure consistency and correctness of selected operational meters (hereinafter referred to as" measuring instruments'); in particular:
(a) lay down the details of the measuring instruments, in particular the conditions for their eligibility for official verification, the tolerance from accuracy and the method of verification;
(b) establish a technical procedure for the testing and verification of measuring instruments;
(c) carry out type-verification of samples of mass-produced measuring instruments where they are subject to type-verification;
(d) issue type verification directives;
(e) allow, in exceptional cases, verification of measuring instruments which do not have all the required requirements;
(f) may carry out tests and verifications of any type of measuring instrument;
(g) proclaims the state and business verification marks of measuring instruments;
(h) specify in which cases the designation of measuring instruments by state verification marks may be waived in whole or in part.
(1) Regional Unit of the Office in particular:
(a) carry out official verification of measuring instruments and ensure appropriate disposal of incorrect measuring instruments (destruction of verification marks, sealing etc.);
(b) approve samples of mass-produced meters, unless they are subject to type-verification;
(c) carry out compulsory registration and keep a systematic and complete record of the manufacturers and repairers of measuring instruments in the county;
(d) check the state of the measuring instruments and the manner in which they are used in all sectors of the national economy, the state of the body of the organisation and the activities of their bodies supervising the measuring instruments.
(2) When carrying out the check, the authorities of the State measure services shall discuss the removal of the identified defects with the management organisation and shall set a time limit for redress; At the same time, they provide technical assistance to organisations for the rapid removal of detected defects and for the exchange of experience to do everything possible to improve the work of the organisation's measuring bodies and to discuss with responsible leaders the possibilities of introducing best organisation working methods or other ways of improving measurement work.
(3) In the event that the head of the organisation fails to implement the deficiencies identified during the revision within the specified time, the regional department shall inform the authority responsible for the organisation. That authority shall inform the Regional Department of the Office of the measures it has taken to remedy the defects and to avoid recurrence.
Entry into the races
(1) In the performance of their tasks, the authorities of the national measure service are entitled to enter the operating rooms of organisations; it shall comply with the specific rules applicable to the entry into the various operating rooms of the organisations. They shall be accompanied by a special card issued by the Office.
(2) In addition, the authorities of the State measure service shall be entitled to require the inspection organisations to submit the measuring instruments used and to provide all necessary information.
Ensuring consistency and correctness of selected operational meters
Official verification of measuring instruments
(1) Selected operating meters used in all sectors of the national economy as well as the main business ethalons of such meters (precision control meters) are subject to mandatory official testing and verification ("official verification"); the measuring instruments subject to official verification and the duration of official verification are listed in the Annex to this Order.
(2) Manufacturers, purchasers of imported goods and repairers are required to submit the measuring instruments which they have manufactured, imported, after repair, to the competent regional department of the Office for official verification before they are put into circulation and, if the measuring instruments intended for their own use, before they are put into use.
(3) They shall be required to submit such measuring instruments for re-official verification each time before the expiry of the verification period.
(4) If the measuring instrument has been found to be correct in the official test, it shall be verified by the prescribed state verification marks; otherwise they must be taken out of service.
Validity of official verification
(1) The validity of official verifications shall begin on the date on which such verifications were carried out. The period of validity of the official verifications, as set out in the Annex, shall be calculated from the beginning of the calendar year following the year in which the official verification of the measuring instrument was carried out.
(2) Validity of the verification of the gauge shall cease if:
(a) its period of validity has expired;
(b) amendments, modifications or repairs to the measuring instrument are made which may affect the characteristics relevant for its verification or extend the scope of its use;
(c) one of the national brands has been infringed, removed, degraded or has become illegible;
(d) the prescribed markings have been arbitrarily modified or the unauthorised markings, divisions, etc., have been affixed;
(e) the gauge has been so damaged that it may have lost some property determined for its verification;
(f) it is also evident in the case of an intact verification that the gauge has become incorrect or that it no longer has the prescribed requirements.
(3) If the verification has expired, the meter shall not be used on the national holding unless it is officially verified again.
Business verification
(1) The Standardisation and Measurement Office may, in agreement with the relevant ministries, central authorities or regional authorities, and, where appropriate, regional national committees, instruct organisations to carry out business tests and verifications of specified types of measuring instruments which produce, repair or use; such business verification shall replace official verification.
(2) The measuring instrument which has been found correct in this test will bear the prescribed business verification mark. Otherwise, these gauges shall be subject to official verification without modification.
Implementation of official verification
Meters newly manufactured and repaired
(1) Official verification of newly produced and repaired meters takes place
(a) the laboratories of the regional departments of the Office;
(b) in the organisation's measuring services;
(c) at the request of the organisations, directly on the site of use of measuring instruments.
(2) The official verification of measuring instruments carried out by the national measure service authorities shall not replace the technical inspection between each operation, the control take-over at the plant or the testing of completed measuring instruments.
In-service gauges
Official in-service verification of measuring instruments
(a) the laboratories of the regional departments of the Office;
(b) outpatient tours carried out by regional departments of the Office as planned;
(c) in the organisation's measuring services;
(d) at the request of the organisations, on the spot of use of measuring instruments.
Measuring instruments imported from abroad
(1) On importation of individual pieces of foreign measuring instruments, the buyer of the imported goods shall report the consignment to the Office within 3 days of its receipt. The Office shall arrange for the official verification to be carried out.
(2) In the case of mass imports of measuring instruments, the buyer of the imported goods shall, before submitting a proposal for the conclusion of the relevant economic contract with the foreign trade undertaking, obtain the agreement of the Office on the import of measuring instruments subject to official verification and ensure that official consent is indicated on the draft economic contract. The Authority may request the submission of a sample of a measuring instrument. Upon delivery, the customer of the imported goods shall report to the office the receipt of the consignment in order to ascertain whether they correspond to a pre-approved sample with the examination of the measuring instruments supplied.
Cooperation between organisations
Manufacturers and repairers of measuring instruments
(1) Organisations producing or repairing measuring instruments are required to submit a registration to the competent regional department of the Office before the manufacture or repair of the equipment.
(2) Organisations producing mass gauges must submit samples of gauges subject to type-verification by the Authority before the start of manufacture and, if the gauges are not subject to type-verification, to the competent regional department of the Office; to carry out the tests, the organisation shall transmit samples of measuring instruments to the Office or to the Regional Department of the Office at their request free of charge. This number may be increased by agreement if necessary. Only after approval of the sample can the production of the measuring instrument be started.
(3) Organisations shall ensure the accuracy of manufactured or repaired meters before submitting them for official verification by comparing them with officially certified main business ethalons.
(4) Organisations shall submit, by 30 September at the latest, to the competent regional department of the Office, a draft annual measuring plan on the basis of which an official verification plan will be drawn up next year.
(5) On official verification, the organisation shall ensure a smooth and uniform supply of measuring instruments to the authorities of the regional department of the Office.
(6) Where official verifications are carried out on the basis of a specific authorisation in the testing rooms of organisations, the organisation shall provide the authorities of the regional departments of the Office with a suitable room free of charge, all necessary testing facilities, auxiliary and technical staff and shall ensure all other conditions necessary to carry out official verifications.
(7) Where official verification is carried out at the request of the organisation on the site of use of the measuring instrument, the organisation shall ensure the conditions necessary for carrying out the test (if necessary auxiliary labour).
User measuring instruments
(1) Organisations are responsible for the selection of appropriate measuring instruments, their proper status, proper maintenance and storage, as well as for correct measurement; to this end, organisations shall in particular:
(a) familiarise workers with the entrusted measuring instruments and their correct use;
(b) to test personnel using gauges requiring special knowledge (e.g. bridge and wagon scales) in their operation;
(c) carry out continuous monitoring of gauges and measurements.
(2) Organisations are required to keep and supplement the inventory of all measuring instruments used where they are subject to mandatory verification. Before official examination, they shall submit to the Authority's regional department all necessary data on the number of such gauges and their technical characteristics; the same data shall be submitted by the organisation to the Regional Department of the Office at its invitation.
(3) Organisations using measuring instruments are required to submit their measuring instruments for official verification to the relevant regional departments of the Office; the organisation shall comply with the deadlines specified by those departments when carrying out the official verification in bulk.
(4) Paragraph 10 (5), (6) and (7) applies mutatis mutandis.
Final provisions
Public
(1) Only persons who have demonstrated their ability to test and have made the required promise (public weighting) may serve public scales and issue weighing lists.
(2) The members of the public shall carry out an examination and make a promise to the regional department of the Office responsible for their residence. The regional department of the Office shall issue a certificate of examination.
(3) The regional departments of the Office shall supervise the performance of the office of public serious persons.
Management
(1) The rules on administrative proceedings shall apply, unless otherwise provided for, to proceedings before the national measure service authorities.
(2) The application for the examination and verification of the measuring instrument shall be submitted to the competent regional department of the Office.
(3) No finding (certificate, certificate, certificate, certificate, etc.) shall be issued on the examination and verification of the measuring instrument or its refusal, unless otherwise provided for in Article 1 (a).
