Government Regulation
of 28 March 1950
on the exercise of public administration in matters of navigation.
The Government of the Czechoslovak Republic orders pursuant to § 1 paragraph 1 of Act No. 143 / 1949 Coll., on Changes in the Organisation of Public Administration and in the jurisdiction of its bodies, and pursuant to § 19 paragraph 3 of Act No. 280 / 1948 Coll., on the Regional Establishment:
In the interests of the exploitation of public administration in matters of navigation, the following shall be deleted:
a) Czechoslovak sailing office in Prague,
b) Navigational office for the Elbe area located in Prague and Navigational office for the Danube region located in Bratislava,
(c) the exposition of the Elbe office of the Elbe region based in Ústí nad Labem and the exhibition of the Danube office of the Danube region based in Komárna.
They will be liquidated by the Ministry of Transport.
(1) With the exception of the matters referred to in paragraph 2, the national committees shall be the subject of the duties of the Office which have been repealed.
(2) The Ministry of Transport is responsible for:
(a) norm, planning, management and supervisory activities;
(b) the management of navigability of waterways and the defence of the interests of navigation on waters with regard to supranational aspects;
(c) the eligibility of vessels and their crews;
(d) the granting of authorisation for a navigational business operating within the perimeter of two or more regions (without prejudice to water-rights negotiations);
(e) tariff (pricing) cases;
(f) the approval of the rules of carriage of undertakings operating in the perimeter of two or more regions;
(g) decisions on essential matters relating to navigation and port operations;
(h) central management of the establishment, maintenance and operation of the media in navigation;
(i) maritime affairs.
(1) The work carried out by the national committees referred to in Article 2 (1) shall be carried out in economic reports.
(2) The Ministry of Transport shall, in agreement with the Ministry of the Interior and with the other central authorities involved, issue regulations specifying in detail the scope of the activity of economic reports in matters of navigation.
The staff of the cancelled offices, which will necessarily be required to exercise the powers delegated under Paragraph 2 (1) to national committees, shall be assigned by the Ministry of Transport, in agreement with the Ministry of Interior, within the framework of the planned workforce of the Regional National Committees. Other staff of the cancelled offices are transferred to the Ministry of Transport.
Provisions governing the matter covered by this Regulation, in particular:
a) Act No. 315 / 1920 Coll., on the establishment of the Czechoslovak office of navigation,
b) Government Decree No. 416 / 1920 Coll., defining the jurisdiction of the Czechoslovak Navigation Authority,
(c) Government Decree No. 377 / 1921 Coll., on the organisation of maritime authorities for the Elbe and Danube regions,
d) Decree of the Minister of Public Works in agreement with the Minister of Trade No. 183 / 1925 Coll., on the opening of the jurisdiction of the Elbe Regional Navigation Authority, based in Prague,
(e) Government Decree No. 42 / 1926 Coll., on the organisation of the exposition of the Elbe Shipbuilding Office based in Ústí nad Labem and the exposition of the Danube Shipbuilding Office based in Komárna,
(f) paragraph 1 of the Decree of the Minister for Public Works in agreement with the Minister for Trade No. 63 / 1930 Coll., on the change made in the organisation of the Elbe Regional Navigation Office,
(g) Government Decree No. 198 / 1939 of the Coll. on the flag and register of inland waterway ships;
they shall cease to be valid if they are contrary to this Regulation or to the provisions adopted pursuant to it.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister for Transport in agreement with the Minister for the Interior and other participating members of the Government.
