DECLARATION
of 17 December 2019
amending Decree No 132 / 2018 Coll., on plant protection products and aids
The Ministry of Agriculture, in cooperation with the Ministry of Health and the Ministry of the Environment, pursuant to § 88 (3) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts, as amended by Act No. 131 / 2006 Coll., Act No. 291 / 2009 Coll., Act No. 490 / 2009 Coll., Act No. 245 / 2011 Coll., Act No. 199 / 2012 Coll. and Act No. 299 / 2017 Coll. (hereinafter "the Act '):
Decree No 132 / 2018 Coll., on preparations and plant protection products, is amended as follows:
1. Paragraph 2 (5) is deleted.
2. In Article 2, the following paragraph 5 is added:
"(5) The batch number of the formulation manufacturer and the date of manufacture of the formulation manufacturer and, where appropriate, the additional information referred to in paragraph 2 shall be given in the form of a 2D code; 2D code means a two-dimensional barcode with a high information value and detection and repair capability in breach. ';
3. In Article 6 (2), the words "and humidity 'are deleted.
4. Paragraph 7 (2) is deleted.
Paragraphs 3 and 4 shall become paragraphs 2 and 3.
5. In Article 7, the following paragraph 2 is inserted after paragraph 1:
"(2) Where the batch number of the formulation manufacturer and the date of manufacture of the formulation of the product or the auxiliary product are indicated by means of a 2D code, the distributor shall keep records in electronic form to enable the records to be linked to the corresponding 2D codes. ';
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
6. Paragraph 10 (5) is deleted.
7. In Article 10, the following paragraph 5 is added:
"(5) The batch number of the formulation manufacturer and the date of manufacture of the formulation manufacturer and, where appropriate, the additional information referred to in paragraph 2 shall be given in the form of a 2D code; 2D code means a two-dimensional barcode with a high information value and detection and repair capability in breach. ';
8. Paragraph 12 (1) reads as follows:
"(1) Samples of preparations or aids in packages of up to and including 25 kg shall be taken of the whole package and, where appropriate, of more packages of the same lot. where technically possible, larger packages may be collected in this way. ';
9. In Paragraph 12 (2), the introductory part of the provision reads: "In the absence of the complete packaging as referred to in paragraph 1, they shall be used for the sampling of preparations or aids' and the word" sample 'in the last sentence shall be replaced by the words "individual final sample in the sample list'.
10. In Article 12, the following paragraph 6 is inserted after paragraph 5:
"(6) The Institute of Sampling for the second expert opinion shall ensure that:
(a) for packages of up to and including 2 kg or 2 l, at least two of these packages and, where appropriate, twice the number of packages required to carry out analyses,
(b) in the case of packages of more than 2 kg or 2 l, one package shall be taken and a sample for the purposes of the second expert opinion shall be subsequently secured by the laboratory of the Institute of Packaging, and
(c) at least two samples of the same sample are provided when sampling for samples. "
Paragraph 6 shall become paragraph 7.
Efficacy
This Regulation shall enter into force on 1 January 2020, with the exception of Article I (2), (5) and (7), which shall take effect on 1 July 2022.
