DECLARATION
of 23 November 2010
amending Decree No. 433 / 2009 Coll., on the method of submission, form and particulars of the statements of insurance and reinsurance undertakings
The Czech National Bank shall determine, pursuant to § 136 (1) (d), (e), (i), (n), (r), (s), (v) and (3) of Act No. 277 / 2009 Coll., on Insurance, (hereinafter referred to as the Insurance Act) and under § 41 (4) of the Act No. 6 / 1993 Coll., on the Czech National Bank, as amended by Act No. 57 / 2006 Coll.:
Decree No. 433 / 2009 Coll., on the method of submission, form and particulars of the insurance and reinsurance undertakings' statements, is amended as follows:
1. in Paragraph 4 (1) (c) (2), "65- 0" is replaced by "65- 01."
2. Paragraph 9 (1) and (2) reads as follows:
"(1) A local insurance undertaking or a domestic reinsurance undertaking presents to the POJ (CNB) statement 70-04" Reporting on the organisational structure and qualifying interests of the insurance / reinsurance undertaking "Czech National Bank a graphic representation of the group, which includes all controlled and associated persons of the domestic insurance undertaking or of the domestic reinsurance undertaking, all its controlling persons and all controlled or associated persons of the controlling persons of the domestic insurance undertaking or domestic reinsurance undertaking. Where controlling persons of a domestic insurance undertaking or of a domestic reinsurance undertaking are subject to group supervision or supervision on a consolidated basis or to additional supervision of a financial conglomerate and publish information on their group, the graphic representation may include only controlled and associated persons of a domestic insurance undertaking or of a domestic reinsurance undertaking and all its controlling persons.
(2) The information referred to in paragraph 1 shall be submitted annually on 1 January to 31 January of the relevant calendar year, in electronic form to the address of the Czech National Bank published in the Bulletin of the Czech National Bank or via the data box 2) Czech National Bank. If there is a change in the structure of the group, the domestic insurance company or the domestic reinsurance undertaking will submit a new graphic representation of the group structure to the Czech National Bank without undue delay after it has become aware of it. "
3. In Paragraph 13 (2), the words "including the name and identification number of the person of the certification service provider who issued it 'shall be added at the end of the text.
(4) In Annex 1, POJ (CNB) report 10-04 Balance sheet of the insurance / reinsurance undertaking for supervisory purposes, Part 1 Balance sheet assets, Contents, second paragraph, in the sentence of the second sentence, the words "broken down into fair value securities against cost and income accounts, bonds held to maturity by the OECD Member State and other securities held to maturity" shall be inserted after the words "debt securities."
5. In Annex 1, POJ report (CNB) 15-04 Additional information on the financial statements of the insurance / reinsurance undertaking, Part 3 Profit / loss from investment - life insurance, Content, the following sentence is added at the end of the text: "The data area also contains the difference between the use and creation of the adjustment items for bonds valued at accrued value."
6. In Annex No 1, POJ (CNB) report 15-04 Additional information on the financial statements of the insurance / reinsurance undertaking, Part 4 Profit / loss on investment, Content, the following sentence is added at the end of the text: "The data area also contains the difference between the use and the formation of adjustment items for bonds valued at accrued value."
7. In Annex 1, Statement of POJ (CNB) 34-04 For the purposes of this Regulation, the following definitions apply:
8. In Annex No 1, Statement of POJ (ČNB) 34-04 This is the total amount of subordinated mutual member accounts that meet the criteria for Tier 2.
9. In Annex No 1, Statement of POJ (ČNB) 35-04 This is the absolute value of the liabilities sensitive to the spread risk on bonds and advances, after the shock.

In Annex No 1, POJ (CNB) Statement 46-04 Statement of the Insurance / Reinsurance undertaking of the investment composition, Part 1 Investment 1, Data area DOP46 _ 41 Debt securities, Contents, the words "and name" and the words "belonging to the group," shall be inserted after the words "relationship to the valuation of the security,"
12. in Annex 1, POJ (CNB) 46- 04 Report of the insurance / reinsurance undertaking on the investment composition, Part 1 Investment 1, DOP46 _ 51 Derivatives, the second sentence is: "For individual derivatives, the ISIN and the name of the derivative, the identification number (ID or NIC) of the underlying asset, the name and state of the counterparty's registered place of business and the maturity date, the type of derivative, the financial value of the hedged derivative, the currency of the hedged portfolio, the currency of the hedged asset, the equity of the underlying asset, the notional value of the underlying asset, the number of units, the amount of the hedged item, the currency of the currency of the hedged derivative, the currency of the hedged and purchased, the currency of the hedged currency of the hedged derivative, the hedged derivative, the hedged hedge.
13. In Annex 1, POJ (CNB) Statement 50-02 Selected indicators of the insurance / reinsurance undertaking - cross-border activities, Content, the words "or reinsurance" are inserted after the word "insurance."
14. In Annex 1, Statement of POJ (CNB) 50-02 Selected indicators of insurance / reinsurance undertaking - cross-border activities, Part 2 The following shall be inserted after the word "intermediaries," "both in the distinction between the type of activity for insurance and reinsurance activities," for the operation of insurance activities in the form of a branch and without the establishment of a branch. "
Efficacy
This Decree shall take effect on 1 January 2011.
