GOVERNMENT REGULATION
of 27 September 2000
on the use of part of the income of the Land Fund of the Czech Republic for the implementation of the Rural Recovery Programme, for the promotion of suckler cows, for the promotion of sheep farming, for the management of milk fat surplus, for the processing of domestic raw honey and for the promotion of the management of the honey market in 2000
The Government orders pursuant to § 15 paragraph 7 of Act No. 569 / 1991 Coll., on the Land Fund of the Czech Republic, as amended by Act No. 308 / 2000 Coll.:
(1) The Land Fund of the Czech Republic shall transfer:
(a) the amount of CZK 200 000 000 to the Ministry of Regional Development;
(b) an amount of CZK 220 000 000 to the Ministry of Agriculture (hereinafter referred to as the Ministry);
(c) an amount of CZK 130 000 000 to the State Agricultural Intervention Fund (hereinafter referred to as the Fund);
(d) the amount of CZK 7,000 000 to the Czech apiculture association (hereinafter referred to as the Union).
(2) The Ministry of Local Development shall use the amount transferred under paragraph 1 (a) as a subsidy in accordance with the budget rules of the Republic1 to implement the Rural Recovery Programme ("the Programme") in 2000.
(3) The Ministry shall use the amount transferred under paragraph 1 (b) as a subsidy in accordance with the budget rules of the Republic1) to support suckler cows and to support sheep farming in 2000.
(4) The Fund shall use the amount transferred under paragraph 1 (c) as aid in accordance with the specific legislationsof m2 to address milk fat surplus in 2000.
(5) The association shall use the amount transferred pursuant to paragraph 1 (d) for the processing of domestic raw honey and to support the solution of the honey market in the Czech Republic as a subsidy to the price of purchased domestic raw honey (hereinafter "honey"). The grant for the price of honey shall be granted on the basis of the application and the documents submitted showing the origin, quality and weight of the honey up to CZK 12 per 1 kg of honey purchased in 2000.
Rules on the grant of the Programme's implementation
(1) The Ministry of Regional Development will provide the municipality with a subsidy on request to:
(a) renewal and maintenance of rural buildings and amenities;
(b) adaptation of public spaces;
(c) renewal and establishment of public green;
(d) repair and construction of local communications and public lighting;
(e) education and advice on rural development and village renewal;
(f) the processing and implementation of projects enabling the interconnection of individual measures under points (a) to (e) with active employment policy; or
(g) interest on investment credits for infrastructure.
(2) The subsidy provided for in paragraph 1 (a) to (d) shall be granted only to municipalities of up to 1 000 inhabitants.
(3) The subsidy may not exceed 70% of the costs incurred by the applicant for this purpose in 2000.
Rules on suckler cow support and sheep support
(1) The Ministry shall provide a natural or legal person who keeps on agricultural parcels in the cadastral territory with an allocated average price for agricultural parcels under the special legislation3) up to CZK 3.50 per 1 m2 (hereinafter referred to as "breeder") on request for a subsidy of:
(a) suckler cows in a minimum number of 5 animals which are calves of the licensed bovine meat breeds or meat types born between 1 September 1999 and 15 October 2000; or
(b) sheep with a minimum of 5 head.
(2) The aid shall be granted to the farmer at the rate of:
(a) up to CZK 4,000 per cow referred to in paragraph 1 (a);
b) up to 1,500 CZK for each ram or ewe.
Support rules for tackling milk fat surplus
(1) In order to address the milk fat surplus in 2000, the Fund will grant aid to milk processors (the dairy farm) for the export of butter following an application from the Fund.
(2) Aid may be granted to a dairy undertaking which:
(a) to buy only raw cow's milk from natural or legal persons at a minimum price laid down under specific legislation, 4)
(b) show, on 30 April 2000, the state of stocks of butter in the statistical report under the special legislature5.
(3) Exports of butter referred to in paragraph 1 to the Slovak Republic shall not be considered as exports for the purposes of this Regulation.
(4) Aid shall be granted only for products which are made from raw material originating exclusively from the Czech Republic.
(5) The aid may be granted up to a maximum of CZK 32 700 per tonne of butter exported in 2000.
(1) Applications for grants or aid may be submitted to the Ministry of Regional Development, the Ministry, the Fund or the Union by 20 October 2000 at the latest.
(2) Paragraph 1 shall not apply to persons who have already received a grant or aid for the purposes laid down in this Regulation in 2000.
The funds intended for the purposes set out in Section 1, which will not be used up until 31 December 2000, shall be returned by the Ministry of Local Development, the Ministry, the Fund or the Czech Union of Beekeepers to the Land Fund of the Czech Republic.
Efficacy
This Regulation shall enter into force on the day of its publication.
