GOVERNMENT REGULATION
of 18 September 2000
on remuneration for the performance of the duties of members of the councils
The Government orders the implementation of Act No. 128 / 2000 Coll., on Municipality (municipal establishment), Act No. 129 / 2000 Coll., on Counties (regional establishment) and Act No. 131 / 2000 Coll., on Capital City of Prague:
(1) This Regulation lays down the conditions for granting:
(a) monthly remuneration and other remuneration, which is due for the performance of the duties of the members of the municipal councils, (1) released to the representatives of the urban districts or the urban areas of the territorial subdivisions of the statutory cities, (2) released to the members of the regional councils, (3) released to the members of the council of the capital of Prague (4) and released to the representatives of the urban parts of the capital of Prague (5) (hereinafter referred to as "the vacations of the councils"),
(b) the monthly remuneration and other remuneration which may be provided for the performance of the duties of the non-authorised members of the representatives of the municipalities, (6) the non-authorised members of the town councils or of the urban areas of the territorial subdivided statutory cities, (7) the non-authorised members of the county councils, (8) the non-authorised members of the town councils of the capital of Prahy9) and the non-authorised members of the city councils of Prague (10) (hereinafter referred to as "the non-authorised members of the councils").
(2) The members of the representatives referred to in paragraph 1 (a) shall mean the members of the representatives of the municipalities, (1) the members of the representatives of the urban districts or the urban areas of the territorial subdivisions of the statutory cities, (2) the members of the regional councils, (3) the members of the council of the capital of Prahy4) and the members of the municipal councils of the capital of Prague, (5) if they are long-term vacancies for the performance of their duties, (11) the members who were not in employment before being elected to the office of the representative, but who are in the same scope as long-term vacations of the members of the representative. Unreleased representatives referred to in paragraph 1 (b) shall be understood as other representatives.
Monthly remuneration
(1) The monthly remuneration of the representatives of the municipalities, the municipal districts or the urban areas of the territorial subdivided statutory cities, the Prague City Council and the Prague City Councils constitute a fixed component determined according to the type of function to be carried out (hereinafter referred to as the "fixed component") and a supplement by population. The monthly remuneration of relaxed and unreleased regional councils is only a solid component.
(2) The monthly remuneration to the members of the councils shall be due as from the day of the calendar month in which they took the oath under the law; the monthly remuneration is not due to them from the date of termination of the mandate under the special legislature12) or from the date of their resignation. Similarly, the monthly remuneration that may be paid to non-released members of the councils shall be paid.
(3) Annex No 1 provides:
(a) the amount of the fixed component and the amount of the surcharge according to the population of the municipality, city district or urban part of the territorial division of the statutory city and the urban part of the capital city of Prague, which is due for the performance of the entrusted function by the members of the municipal councils, the members of the town councils or the urban parts of the territorial division of the statutory cities and the members of the representatives of the urban parts of the capital of Prague,
(b) the maximum amount of the fixed component and the maximum amount of the surcharge according to the population of the municipality, the city district or the urban part of the territorial division of the statutory city and the urban part of the capital of Prague, which may be provided for the performance of the entrusted function by the unreleased members of the municipal councils, the unreleased members of the municipal councils or the urban parts of the territorial subdivisions of the statutory cities and the unreleased members of the municipal districts of Prague.
(4) Annex 2 sets out the amount of the fixed component which is due for the performance of the function entrusted to the members of the regional councils and the maximum amount of the fixed component which may be provided for the performance of the determined function by the non-released members of the regional councils.
(5) Annex 3 sets out the amount of the fixed component and the amount of the surcharge according to the number of inhabitants of the capital city of Prague, which is due for the performance of the function entrusted to the members of the council of the capital of Prague, and the maximum amount of the fixed component and the maximum amount of the surcharge according to the number of inhabitants of the capital of Prague, which can be provided for the performance of the determined function by the unreleased members of the representative of the capital of Prague.
(6) Released representatives
(a) a municipality with an authorised municipal office;
(b) municipalities with a construction office;
(c) municipalities with a matrix office;
(d) urban districts or urban areas of territorial subdivisions of statutory cities whose offices have been transferred by the Statute to at least part of the jurisdiction of the entrusted municipal authority or whose offices exercise the competence of the building office or the matrix office;
(e) the capital of Prague; or
(f) the urban areas of the capital city of Prague to which the authorities have been delegated by law or statute at least part of the jurisdiction of the entrusted municipal office;
the increase of the monthly remuneration is due to the amount of CZK 2,000. Monthly remuneration is increased only by CZK 2,000 even if a claim is made for several reasons.
(7) If the members of the representatives do not perform their duties throughout the calendar month, they shall be paid a monthly remuneration equal to the number of days of actual service.
Other remuneration
(1) For each calendar year in which they have actually performed a function of at least 90 calendar days, additional remuneration shall be payable to the elected members of the councils if the performance of their duties has not been completed.
(a) in the first half of the year before 31 May or 30 June, if the condition of office is fulfilled for a specified number of days until June;
(b) in the second half of the year before 30 November or 31 December, if they fulfil the condition for the performance of their duties for a specified number of days until December.
(2) An additional remuneration may be granted to the non-released members of the Councils under the same conditions as in paragraph 1.
(3) Pending the period referred to in paragraph 1, the period of time during which the members of the Councils have not performed their duties because of sickness, injury, pregnancy or maternity shall not be taken into account. The period of the other waived absence for which the representatives have not performed their duties shall be counted against that period for a period not exceeding 45 calendar days in the calendar semester.
(4) (13) No further remuneration shall be granted for the calendar half-year in which their term of office ends in cases where remuneration is paid to the elected or non-authorised members of the representative.
(5) Any additional remuneration which would otherwise be due to the elected members of the councils or which could otherwise be granted to the non-released members of the councils shall not be granted for the calendar half-year in which their mandate has expired under special legislation12) or in which they have resigned; This does not apply if the termination of the mandate or resignation of a member of the council took place on the last day of the calendar semester.
(6) A further remuneration shall be granted at the rate of the monthly remuneration to which the last member of the representatives to be released has been entitled, including an increase of CZK 2 000, if they belong to them, or which was or could last be granted to the non-released members of the councils, unless otherwise provided for in this Regulation.
(7) The additional remuneration to the members of the councils released and unreleased shall be due at the earliest date fixed for payment of the monthly remuneration after entitlement to the next remuneration has been established. Before fulfilling the conditions for entitlement to the additional remuneration laid down in paragraphs 1 to 5, the municipality, the county, the capital of Prague or the city of the capital of Prague may provide up to two advances for the additional remuneration, provided that they agree with the members of the councils to repay them if they are not entitled to the additional remuneration or to repay the amount by which the advance granted exceeded the amount of the additional remuneration.
Transitional provisions
(1) In 2000, the monthly remuneration provided for in this Regulation shall be for the first time in November for the vacant members of the municipal councils, city councils or urban areas of the territorial subdivided statutory cities, the Prague City Councils and the City Councils of the capital of Prague; the same procedure shall apply to the payment of the monthly remuneration which may be granted to the non-released members of such representatives.
(2) In order to qualify for further remuneration, the members of the municipal councils, city councils or urban areas of the territorial subdivided statutory cities, regional councils, Prague City Councils and Prague City Councils in 2000, the total duration of the term of office in the second half of the year shall be taken into account; the same procedure shall be followed when the term of office is calculated for the purposes of payment of an additional remuneration which may be granted to non-released members of such representatives.
(3) Released members of municipal, urban or urban councils, regional councils, district councils, Prague City Councils and city councils of the capital of Prague are entitled for the second half of 2000 to receive a further remuneration of half the amount to which they would otherwise be entitled. For the second half of 2000, the non-released members of these councils may receive an additional remuneration of half the amount which they would otherwise have been able to receive under this Regulation.
(4) A further remuneration of half of the amount to which they would otherwise be entitled is payable to the elected members of the Councils in 2002. An additional remuneration of half of the amount which would otherwise have been available to the non-released members under this Regulation may be granted in 2002. The additional remuneration, calculated in accordance with this paragraph, shall be rounded up to the whole hundred crowns.
They shall be deleted:
1. Government Decree No. 262 / 1994 Coll., on Rewards to Members of Councils in Municipality.
2. Government Decree No. 20 / 1997 Coll., amending and supplementing Government Decree No. 262 / 1994 Coll., on the remuneration of members of councils in municipalities.
3. Government Decree No. 130 / 1998 Coll., determining the amount of additional remuneration paid to long-term members of municipal councils in 1998.
4. Government Decree No. 23 / 1999 Coll., amending Government Decree No. 262 / 1994 Coll., on Rewards to Members of Councils in Municipality, as amended by Government Decree No. 20 / 1997 Coll.
5. Government Decree No. 137 / 2000 Coll., determining the amount of additional remuneration to long-term members of municipal councils in 2000.
This Regulation shall enter into force on the day of the elections to regional councils in 2000.
