DECLARATION
of 18 August 2020
amending Decree No. 99 / 2012 Coll., on Minimum Personnel Security Requirements for Health Services, as amended
According to Section 120 of Act No. 372 / 2011 Coll., on Health Services and Conditions of Provision of Health Services (Health Services Act), as amended by Act No. 111 / 2019 Coll., for the implementation of Section 11 (4) of the Health Services Act:
Decree No. 99 / 2012 Coll., on Minimum Personnel Security Requirements for Health Services, as amended by Decree No. 287 / 2013 Coll., Decree No. 285 / 2017 Coll. and Decree No. 304 / 2019 Coll., is amended as follows:
1. In Annex No 1, Part IA, point 2, first sentence, the words "and non-medical health professionals' are replaced by the words" with specialised competence, specific competence or specific specialised competence and staff of non-medical medical professions with professional competence '; and in the sentence, the words "or special competence' are replaced by the words" special competence or specialised competence of doctors and competence, specialised competence or specific competence of non-medical staff '.
2. in Annex No 1, Part I B, points 1.2 (a), 1.2.1 (a), 1.15.1. (a), 1.29.1. (a), 1.29.1. (a), 1.37. (a), 1.40. (a), 1.43.1. (a), 1.46. (a) and Part I B, 2. 2.1 (b), the words "or special specialised" shall be inserted after the words "professional."
3. In Annex No 1, Part II B, point 5, the words "or specific competence 'are replaced by the words", specific competence or specialised competence'.
4. In Annex No 2, point 1, the words ", a physician with a specific specialised competence in the relevant field 'shall be inserted after the words" professional competence in the relevant field'.
5. In Annex 2, point 3, first sentence, the words "and non-medical health professionals' shall be replaced by" with specialised competence, specific competence or specific specialised competence and staff of non-medical medical professions with professional competence '; and in the second sentence, the words "or specific competence' shall be replaced by the words", special competence or specialised competence of doctors and proficiency, specialised competence or specific competence of non-medical health professionals'.
6. In Annex No 2, point 4 (b), the words "or specific competence 'are replaced by the words", specific competence or specialised competence'.
7. In Annex 3, Part I, points 9 to 12, "16.00 'is replaced by" 15.30'.
8. In Annex 3, Part I, point 9 (a):
"(a) by a doctor with specialised competence, specific professional competence or specific specialised competence in the relevant field,"
9. In Annex 3, Part I, point 9 (c), the words "passing a baseline strain for the relevant field 'are inserted after the words" certificate 14' and the number "20 'is replaced by" 30'.
10. In Annex 3, Part I, point 10 (a), the words "specialised competence, specific professional competence or specialised specialisation 'shall be inserted after the words" doctor'.
11. in Annex 3, Part I, point 11 (a) and point 12, the word "radiological" shall be replaced by "neurosurgical, cardiothoracic surgery."
12. In Annex 3, Part I, point 11 (b), the words "passing the baseline strain referred to in point (a) 'are inserted after the word" certificate14' and the number "20 'is replaced by" 30'.
13. In Annex 3, Part I, point 14 reads as follows:
"14. The general or regional anesthesia, analgoseation or monitored anaesthesiological care of staff in the operating room is as follows:
(a) an anesthesiologist,
(b) 2 doctors, of which one with specialised competence, specific professional competence or specific specialised competence in the relevant field in which the patient's healthcare is provided; in small-scale performance, such as selected laparoscopic performance, a doctor with specialised competence, specific competence or specific specialised competence in the relevant field,
(c) a nurse for non-supervised perioperative care; if surgery is performed in gynecology and obstetrics, a nurse for perioperative care without supervision or a midwife for perioperative care without supervision,
(d) a nurse for intensive care without supervision; if surgery is carried out in gynecology and obstetrics, nurse for intensive care without supervision or midwife for intensive care; and
(e) general nurse.
If there are multiple operating rooms in the health care facility at the same time performing in general or regional anaesthesia, analgoseation or monitored anaesthesiological care, care may always be provided in two rooms.
(a) by an anaesthesiologist,
(b) by a doctor with competence with a certificate (14); and
(c) a nurse for intensive care without supervision; if surgery is carried out in gynecology and obstetrics, nurse for intensive care without supervision or midwife for intensive care.
In every room there are always
(a) two doctors, one of them with specialised competence, specific professional competence or specific specialised competence in the relevant field in which care is provided to the patient; in small-scale performance, such as selected laparoscopic performance, a doctor with specialised competence, specific competence or specific specialised competence in the relevant field,
(b) a nurse for non-supervised perioperative care; when performing surgery in gynecology and obstetrics, a nurse for perioperative care without supervision or a midwife for perioperative care without supervision; and
(c) general nurse.
The safety of health professionals and other professionals beyond the specified requirements depends on the spectrum of performance performed. ';
14. in Annex 3, Part I, point 19 (a), the words "or specific competence" shall be replaced by the words "special competence or specialised competence."
15. in Annex 3, Part II, point 1.1.1. read:
"1.1.1. Personnel security of surgical fields is as follows
(a) a doctor with a specialised, specific professional competence or specific specialised competence in the relevant field of 2.0 time;
(b) a doctor with a competence of 2,0 hours, of which up to 1,0 with a certificate (14);
(c) a general nurse with specialised competence in the field without supervision of 1,0 time;
(d) a general nurse without supervision and a general nurse or medical assistant, a total of 8,5 hours, and
(e) an orderly or caregiver of 4,0 time.
Health care provided on working days between 15.30am and 7.00am of the following day, and on Saturday, Sunday and sveating17) may also be provided by orthopaedic care, orthopaedic care and trauma of the movement system by a physician with specialised competence with a basic surgical stem and care in urology by a surgeon, provided that the availability of a urologist is ensured. '
16. Point 1.2.1. of Part II of Annex 3 reads as follows:
"1.2.1. Personnel security of internal fields is as follows
(a) a doctor with specialised competence, specific professional competence or specific specialised competence in the relevant field of 2.0 time;
(b) a doctor with a competence of 2,0 hours, of which up to 1,0 with a certificate (14);
(c) a general nurse with specialised competence in the field without supervision of 1,0 time;
(d) a general nurse without supervision and a general nurse or medical assistant, a total of 8,0 hours, and
(e) an orderly or caregiver of 3,5 time.
Health care provided on working days between 15.30am and 7.00am of the following day, and on Saturdays, Sundays and at day17) can also be provided by a neurologist and care in the field of neurology by a doctor with specialised competence with a basic internal tribe. "
17. in Annex 3, Part II, point 1.2.2. (a):
'(a) a doctor with specialised competence, specific professional competence or specific specialised competence in the relevant field of 1.5 time;';
18. In Annex 3, Part II, point 1.6 (a), the words "or specific specialised competence 'shall be inserted after the words" eligibility'.
19. in Annex 3, Part II, points 1.11 (a) and (b), the words "or specific competence" shall be replaced by the words "special competence or specialised competence."
20. In Annex 3, Part II, point 3.2, including the title:
"3.2. Addictive diseases
(a) a psychiatrist or doctor with a specific professional capacity or a specific specialised competence in addictive diseases 0,3 time-limits;
(b) a doctor with a competence of 1,0 time, of which 0,5 with a certificate (14); a doctor's or a professional's and certificate's (14) time may also be provided by a clinical psychologist within the scope of 0,5 time;
(c) a psychiatric care nurse without supervision or an adictologist without supervision of 1,0 time;
(d) a general nurse without supervision and a general nurse or medical assistant in total 7,0 time; a general nurse's or a medical assistant's time range of 1,0 may be provided by a clinical psychologist or adictologist, provided that the general nurse's presence without supervision is always ensured,
(e) an orderly or a nurse of 2,0 time; and
(f) a clinical psychologist or a health psychologist, 0,2 if the availability of a clinical psychologist is ensured.
Staff security of health care provided on working days from 15.30am to 7.00am of the following day, and on Saturdays, on Sundays and at day17) shall be provided by health professionals referred to in point 11 (b) and (c) of Part I, and by psychiatrists, gerontopsychiatrists, doctors with special competence or specialised competence in addictive diseases, sexologists, doctors with specialised competence in fields with a common basic strain of internal, surgical, orthopaedic, gynecological, neurologic, anesthesiological, dermatoenerological, urological, opthalmological, otorinolaryngological or general practical medicine. '
21. in Annex 3, Part II, points 3.4 and 3.7, "16.00" is replaced by "15.30."
22. In Annex 3, Part II, point 3.6, including the title,
"3.6. Spa rehab treatment
(a) a doctor with specialised competence, specific professional competence or specific specialised competence in the field according to the focus of rehabilitation treatment 0,5 time, of which within a minimum of 0,1 time, a rehabilitation doctor,
(b) a physician with a competence of 0,5 time;
(c) a general nurse with specialised competence or special competence of 0,5 time, 0,25 time for each additional 60 beds up to 300 beds, and 0,2 time for each additional 60 beds,
(d) a general nurse with no supervision and a general nurse or medical assistant with a total of 6,0 hours, of which up to 1,0 days may provide for the care of physiotherapists; 2.0 per additional 60 per bed up to 300 per bed and 1.0 per additional 60 per bed,
(e) an orderly, nurse or masseur of at least 3,0 time; of which a general nurse or medical assistant may provide care to the extent of 1,0 time; and
(f) a physiotherapist and an ergotherapist of at least 3,0 hours, of which 0,2 hours of physiotherapists without supervision; of which 1,0 can be provided by a general nurse or medical assistant.
The amounts referred to in points (e) and (f) shall be 8,0 in total.
No care is required for a health-care worker or other professional - social worker.
Personnel security requirements are set at 60 beds designated and used for the provision of spa rehabilitation care.
Health care provided on working days from 15.30am to 7.00am of the following day and on Saturdays, on Sundays and on Saturdays 17) is provided by health professionals eligible for the non-medical medical profession in continuous operation, but at least by one healthcare professional without supervision for patients for every 300 beds. Where care is provided to children, the availability of a child doctor or a doctor with specialised competence, specific competence or specialist competence in the relevant fields of childcare shall be ensured. ';
23. in Annex 3, Part II, point 4.1 (a):
'(a) a doctor with specialised competence, specific professional competence or special specialised competence of 0,2 time-limits,';
24. in Annex 3, Part II, point 4.5 (a):
"(a) a physician with specialised competence in the field who has an internal, neurological, surgical, orthopaedic, urological, anaesthesiological, general practical, otorinolaryngological, ophthalmological, physician with specific competence or specialised competence in the field of palliative medicine, doctor with special competence or special specialised competence in the field of long-term care medicine or an algeziologist of 0,2 commitment,";
25. in Annex 7, point 1.1 (a), the words "or specific competence" shall be replaced by the words "competence, specific competence or specific specialised competence."
Transitional provision
The bed care provider providing bed care on the date of entry into force of this decree must comply with the minimum staff security requirements for bed care under Decree No. 99 / 2012 Coll., as effective from the date of entry into force of this decree, within 15 months of the date of entry into force of this decree.
Efficacy
This Decision shall enter into force on 1 January 2021.
