on medical fitness for military active service
The Ministry of Defence provides pursuant to § 21 (7) and § 29 (6) of Act No. 585 / 2004 Coll., on the defence obligation and its provision (the Defence Act), as amended by Act No. 47 / 2016 Coll., and in agreement with the Ministry of Health pursuant to § 3 (2) (a) of Act No. 221 / 1999 Coll., on professional soldiers:

COMMON PRINCIPLES FOR HEALTH ELIGIBILITY ASSESSMENT

HLAVA I

ASSESSMENT OF HEALTH ELIGIBILITY
§ 1
Health
(1) Assessment of medical fitness for military active service is carried out
(a) in the course of a medical examination in the context of a withdrawal or review procedure, unless otherwise specified;
(b) in the framework of the selection of a citizen seeking an occupation in the service of an occupational soldier (hereinafter referred to as "candidate"),
(c) in the case of a citizen who has requested to be placed on an active reserve, to participate in a military exercise or to be predestined for replenishment of the armed forces;
(d) a soldier in reserve.
(2) Medical fitness is also assessed during a medical examination of a soldier in active duty, namely:
(a) before his official appointment to a post requiring special expertise (hereinafter referred to as "specialist"); or
(b) on termination of military active duty.
§ 2
Medical degree
(1) The degrees of medical fitness are determined for the needs of the medical classification according to the degree of competence of the person under assessment to perform the military active service. The degrees of medical fitness shall be marked by the classification mark A, BI, BII, BIII, C or D assigned to the disease or defect according to the list of diseases and defects set out in Annex 1 to this Decree.
(2) The degrees of medical fitness shall be expressed by:
(a) "Schopen (mark A)" for the first stage;
(b) "Schopen subject (mark B)" for second degree,
(c) "restricted (mark C)" for third degree;
(d) "Unable (D-mark)" for the fourth degree.
(3) The first degree of medical fitness may be determined by a citizen in a withdrawal procedure, a candidate, a citizen who has requested to be placed on an active reserve, to take part in a military exercise or a pre-designation for the addition of the armed forces, or a soldier, provided that their medical fitness permits the exercise of an active military service, including operational deployment (4), without limitation, with the exception of certain special military expertise referred to in Annexes 1 and 2 to this Regulation, which impose specific medical requirements.
(4) A second degree of medical fitness may be established for a citizen in the course of an emergency procedure, a citizen who has requested to be placed on an active reserve, to participate in a military exercise or to be predestined for replenishment of the armed forces, or to a former career soldier who has been placed on standby, provided that his medical fitness permits normal work and allows him to carry out a military active service, with the exception of military expertise and professional qualifications, requiring increased physical fitness, mental activity or intellectual quality, or increased requirements for the accuracy and readiness of sensory authorities.
(5) The third degree of medical fitness may be determined by the applicant or professional soldier, provided that their medical fitness permits the performance of military active duties on all types of troops and services, but limits classification to certain posts in accordance with Annexes 1 and 2 to this Regulation and requires:
(a) the occasional provision of short-term allowances in the performance of duties under specific conditions of service for a maximum period of 3 months; or
(b) the provision of long-term relief in the performance of service obligations under the conditions of service in the relevant service classification of the professional soldier under consideration, for a maximum period of six months.
(6) The fourth degree of medical fitness may be established for a citizen in a withdrawal procedure, for a soldier in a review procedure, for a candidate, for a citizen who has applied for an active advance, for participation in a military exercise or for a predestination for replenishment of the armed forces, or for a soldier whose
(a) the disease or defect is classified by that degree in Annex 1 to this Decree; or
(b) the current medical condition shall not allow military active duty to be carried out for more than 12 months.
(7) The second degree of medical fitness "Schopen subject to (mark B) 'may be determined individually or in different combinations of the following sub-groups of the following degree of medical fitness:
(a) "Schopen, not for I (BI mark)" may be determined by a citizen in the course of the proceedings, a citizen who has requested to be placed on an active reserve, to participate in a military exercise or to be predestined for the addition of a military force, a soldier of a team, a petty officer or a medical officer who allows normal work activities and allows the exercise of military active duties, other than military expertise and professional qualifications, requiring increased physical fitness requirements in accordance with Annexes 1 and 2 to this Regulation;
(b) "Schopen, not for II (BII mark)" may be determined by a citizen in the course of the proceedings, a citizen who has requested to be placed in an active reserve, to participate in a military exercise or to be predestined for the addition of armed forces, a soldier of a team or a minor officer in medical fitness, which allows normal work activities and allows the exercise of military active duties, other than military expertise and professional qualifications, requiring increased requirements for mental activities and intellectual quality;
(c) "Schopen, not for III (brand BIII)" may be determined by a citizen in the course of the proceedings, a citizen who has requested to be placed in an active reserve, to take part in a military exercise or to be predestined for the addition of a military force, a soldier of a team, petty officers or medical officers, which allows normal work activities and allows the exercise of military active duties, other than military expertise and professional qualifications, which require the accuracy and readiness of sensory authorities.
§ 3
Determination of the degree of medical fitness for a fixed period
The third degree of medical fitness "Schopen with a restriction (mark C) 'may be determined only for a fixed period, ranging from 12 to 60 months, taking into account the anticipated development of the occupational health status of the professional soldier affecting the reduction of his medical fitness to perform an active military service.
§ 4
General medical assessment procedures
(1) The medical fitness shall be assessed on the basis of an extract from the medical documentation of the registrant, the results of the medical examination or any other necessary professional examinations.
(2) The medical examination for the assessment of medical fitness is aimed at identifying diseases, defects and conditions which exclude or restrict the exercise of military active service in accordance with the lists set out in Annexes 1 and 2 thereto. The results of the medical examination shall be presented by the doctor in his medical report.
(3) Where the information contained in the extract from the medical file of the registrant or the results of the medical examination referred to in paragraph 2 do not allow the medical assessment of the medical fitness of the person under assessment to be carried out in an active military capacity, the medical assessor shall require the health service providers to carry out further technical examinations.
(4) The medical assessor shall issue a medical opinion on the medical fitness for an active military service classified by the degree of medical fitness. The medical examination referred to in paragraph 2 or the medical examination referred to in paragraph 3 for medical assessment shall not be carried out more than 90 days before the medical opinion is issued; This period shall not apply to professional examinations in the case of stable health.
§ 5
Specific medical requirements
(1) Specific medical fitness requirements for special expertise
a) explorer, diver and operator of anti-tank complexes,
(b) a paratrooper,
(c) driver of military vehicles and leaders of military vessels;
(d) radio operator,
(e) operator of radio-tracking and radio-targeting techniques; or
f) Guard service at guard units and Castle guards
are set out in Annex 2 to this Order.
(2) Medical fitness for special expertise is expressed in the opinion on medical fitness for military active service
(a) "fit for special expertise,"
(b) "fit for special expertise only under certain conditions"; the medical assessment shall include the conditions under which the person assessed is fit to exercise special competence; or
(c) "unfit for special expertise."
§ 6
Adjustments to the terms and conditions for the performance of soldier's duties
The modification of the conditions for the performance of the soldier's duties as a result of his medical indisposition shall be carried out by the military provider in accordance with the principles set out in Annex 3 to this Decree as part of the soldier's treatment regime.

§ 7
(1) The medical examination carried out for the purpose of assessing medical fitness for an active military service shall include:
(a) verification and completion of family, personal and work history data;
(b) anthropometric measurements;
(c) a basic chemical test of urine to detect the presence of protein, glucose, ketones, urobilinogen, blood and pH of urine;
(d) physical examination of the internal character, including measurement of blood pressure and pulse,
(e) indicative neurological examination,
(f) indicative examination of hearing and vision, including examination of colour,
(g) indicative examination of the musculoskeletal apparatus and skin; and
(h) an indicative assessment of psychological functions aimed at detecting obvious psychopathology.
(2) A medical examination carried out for the purpose of assessing the medical fitness for the military active service of the person under consideration,
(a) which, according to personal and occupational history, medical reports or medical documentation, shows signs of impaired social adaptation or social malpractice; or
(b) which have been provided health care in the field of psychiatry in the form of berth or outpatient care for mental disorders or behavioural disturbances leading in particular to pathological dependencies;
include, in addition to the examination referred to in paragraph 1, a specialist psychiatric examination.

§ 8
Assessment of the medical fitness of an active soldier
The medical fitness of an active soldier shall be assessed in medical examinations carried out as:
(a) initial medical examination;
(b) preventive annual medical examination of the professional soldier;
(c) an extended preventive search of the professional soldier; or
d) an exit medical examination of the soldier.
§ 9
Entry medical examination of the soldier
(1) Entry medical examination of the soldier
(a) in the occupation of a soldier in reserve for service;
(b) upon the entry of a soldier in reserve:
1. military exercises,
2. for the performance of service in operational deployment; or
3. to perform an extraordinary service.
(2) In addition to the examinations provided for in Article 7 (1), the contents of the initial medical examination carried out in accordance with paragraph 1 shall also include an indicative dental examination.
(3) The entry medical examination carried out at the time of the boarding of a soldier in advance for a military exercise of less than 14 days shall contain only verification and completion of family, personal and work history data.
§ 10
Preventive annual medical examination of an occupational soldier
(1) The content of the preventive annual medical examination of the professional soldier is to supplement the data of his family, personal and occupational history with a view to identifying changes in his medical fitness and assessing the impact of risk factors of the relevant professional classification on his health; risk factors for the purposes of this decree are those which are part of the service of an occupational soldier and which may, in the light of scientific knowledge, be an initiation mechanism for the development of, in particular, ischaemic heart disease, hypertension, fat metabolism or metabolic syndrome.
(2) Where a specified medical fitness of an occupational soldier is classified by the degree "Schopen with a restriction (mark C) ', the specific time limit for that medical classification shall be determined in accordance with § 2 (5) or § 3, taking into account the foreseeable development of the occupational health status of the professional soldier affecting the reduction of his medical fitness to perform an active military service.
§ 11
Extended preventive search of an occupational soldier
(1) Extended preventive inspection is carried out for professional soldiers in age groups 25, 30, 35 and 38 and over 40 years of age. In the case of professional soldiers in an age group over 40 years of age, the extended preventive inspection shall be carried out annually.
(2) The content of the extended preventive inspection of the professional soldier is the examination referred to in § 7 (1) and
(a) laboratory tests for blood and blood serum in the range of:
1. blood count and differential leukocyte count,
2. erythrocyte sedimentation,
3. total cholesterol,
4. HDL-cholesterol,
5. LDL-cholesterol,
6. triglycerides,
7. glucose,
8. alanintransaminase,
9. gamagglutamyl transferase,
10. aspartate aminotransferase,
11 bilirubin,
12. creatinine,
13. urea,
14. uric acid and
15. Prostatic specific antigen in men over 40 years of age,
(b) a resting electrocardiogram;
(c) differentiated preventive oncological examination in the range of:
1. rectum examination,
2. examination of the occult bleeding stool in persons over 40 years of age, with frequency every 2 years; the examination of the occult bleeding stool may be replaced in an occupational soldier older than 55 years of age by a screening colonoscopic examination performed with a frequency of 5 years or more;
(d) mammographic examination in women over 40 years of age, with a frequency of every 2 years;
(e) ultrasound examination of the mammary gland in women:
1. aged 35 to 40 years each year,
2. above 40 years of age, in each calendar year in which the examination referred to in point (d) is not carried out; and
(f) ultrasound examination of the lower abdomen in women over 35 years of age, with a frequency of every 2 years.
§ 12
Output medical examination of the soldier
(1) A soldier's exit medical examination is carried out at the end of a military active service.
(2) The provisions of Section 10 (1) shall apply mutatis mutandis for the purpose of carrying out an exit check.
(3) During the final medical examination, the assessor shall identify the medical condition of the soldier in the active service and prepare a medical report describing the current medical condition of the soldier in the active duty and the impact of the service on the medical condition found by him or her or on the results of any further professional examinations carried out.

HLAVA IV

ASSESSMENT OF HEALTH ELIGIBILITY
§ 13
(1) The medical examination for the medical assessment of the candidate's medical fitness shall include the entry part, which shall be a controlled interview of the candidate with a medical assessor to evaluate the essential facts of his medical condition on the basis of the information and information provided by him or her, and, where appropriate, the documents giving evidence of his or her medical history.
(2) In addition to the tests provided for in Section 7 (1), the medical examination intended to assess the medical fitness of the applicant also includes:
(a) electrocardiographic examination;
(b) laboratory tests for blood and blood serum in the range of:
1. determination of blood group,
2. blood cell counts and differential leukocyte counts,
3. detection of erythrocyte sedimentation,
4. serological examination for syphilis,
5. detection of hepatitis B surface antigen,
6. Determination of total bilirubin,
7. detection of direct bilirubin,
8. blood glucose testing,
9. testing for alanintransaminase,
10. testing for aspartate aminotransferase,
11. Determination of total cholesterol,
(c) microscopic examination of the urinary sediment,
(d) X-ray of the thoracic organs,
(e) examination of the nasal cavity, ears, speech, voice and hearing,
(f) oral examination and dental status,
(g) indicative surgical, neurological, psychiatric and skin examinations;
(h) expert gynaecological examination in women; and
(i) clinical-psychological examination.
(3) In the case of a candidate who is presumed to be engaged in a military active service for Military Intelligence and whose professional classification is subject to protection under the Law on the Protection of classified information, the medical fitness of a military active service shall be assessed by a military medical practitioner in the field of general practical medicine of a military provider operating a medical facility covered by the Military Intelligence (2); a military provider operating a medical facility included in the Military Intelligence (2) shall also provide a psychological examination for applicants under this paragraph.
§ 14
(1) A candidate whose established medical fitness corresponds to the medical classification "Schopen (mark A) 'or" Schopen with a restriction (mark C)' in column II of Annex 1 to this Decree and the requirements set out in Annexes 2 and 3 thereto shall be eligible for the military active service.
(2) The applicant referred to in Article 13 (3) is fit for the exercise of an active military service if his medical fitness corresponds to the medical classification referred to in paragraph 1 or, taking into account the anticipated service classification in Military Intelligence, also the health classification "Schopen, not for I (BI brand)" or "Schopen limited (C brand)."

HLAVA V

ASSESSMENT OF THE HEALTH ELIGIBILITY OF THE CITIZENS WHO HAVE ASKED TO APPROACH TO THE ACTIVE BASIS, PARTICIPATION IN MILITARY CLAIMING OR PRESENTATION FOR THE IMPLEMENTATION OF THE RESULTS
§ 15
The medical fitness of a citizen who has requested to be placed on an active reserve, to participate in a military exercise or to be predetermined to supplement the armed forces shall be assessed in accordance with the procedure laid down in Section 4.
§ 15a
In addition to the examinations provided for in § 7 (1) and (2), the contents of a medical examination intended to assess the medical fitness of a citizen who has applied for an active advance shall also include:
(a) electrocardiographic examination;
(b) indicative examination of speech and passageway of the nasal cavity;
(c) an indicative examination of the oral cavity and the dental status,
(d) a comprehensive examination by a clinical psychologist aimed at detecting psychopathic conditions;
(e) expert gynecological examination in women unless a record of a gynecological preventive examination has been documented over the last 12 months;
(f) a managed interview pursuant to Article 13 (1).
§ 15b
In addition to the examinations provided for in § 7 (1) and (2), the medical examination intended to assess the medical fitness of a citizen who has requested to participate in a military exercise shall also include:
(a) electrocardiographic examination;
(b) indicative examination of speech and passageway of the nasal cavity;
(c) an indicative examination of the oral cavity and the dental status; and
(d) a managed interview pursuant to Article 13 (1).
§ 15c
In addition to the examinations provided for in paragraphs 7 (1) and 7 (2), the medical examination intended to assess the medical fitness of a citizen who has requested a pre-designation to supplement the armed forces shall also include:
(a) an indicative examination of the speech and passageway of the nasal cavity; and
(b) an indicative examination of the oral cavity and the state of the teeth.
§ 16
A citizen whose established medical fitness is equivalent to the health classification "Schopen (mark A) 'or" Schopen, not for I, II, III (mark BI, BII, BIII)' as set out in column I of Annex 1 to this decree and the requirements set out in Annex 2 to this decree shall be eligible for active backup, military training or pre-designation.

HLAVA VI

ASSESSMENT OF THE HEALTH ELIGIBILITY OF CITIZENS IN THE EXTRA PROCEDURE
§ 17
In addition to the tests provided for in § 7 (1) and (2), the medical examination intended for the detection of the medical fitness of a citizen in a levy procedure shall also include:
