DECLARATION
Ministry of Environment
of 11 July 2002
laying down air quality requirements for fuels
According to Section 55 (3) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act) ("the Act '), the Ministry of Environment provides for the implementation of Section 3 (11) of the Act:
§ 1
Subject matter
(1) This decree, in accordance with the law of the European Communities (1), lays down requirements for the different types of fuels and for the verification of their quality.
(2) This Order does not apply
(a) the quality of motor vehicle fuel covered by specific legislation, 2)
(b) co-incineration of waste with fuel covered by specific legislation.3)
§ 2
Basic concepts
For the purposes of this decree:
(a) fuel - solid, liquid or gaseous combustible material intended for combustion in sources of pollution to obtain its energy content which complies with the requirements laid down in this Decree. With the exception of plant materials meeting the requirements laid down in § 3 (2) (e) and (f), the fuel is not waste under special legislation, 4)
(b) alternative fuel - a mixture of combustible materials of natural or artificial origin without dangerous properties listed under codes H1, H4 to H14 in Annex 2 to the Specific Legislation. (4) The actual composition of the alternative fuel shall be verified by an authorized test.5) The characteristics of the incineration products (gaseous waste gases and solid residues) shall be verified by an authorised person in accordance with Article 15 of the Act on a specific pollution source installation;
(c) heavy fuel oil - any liquid fuel derived from oil referred to in the subheadings of the Customs Tariff (6) as code 2710 1961 to 2710 1969 or any liquid fuel derived from oil other than gas and medium oils as defined under (d) and (e) which, as a result of its distillation range, falls within the category of heavy oils intended for use as fuel and from which less than 65 per cent by volume (including losses) distils to 250 ° C using the CSN EN ISO 3405 method. If distillation cannot be carried out according to the CSN EN ISO 3405 method, the product is considered to be heavy fuel oil,
(d) gas oil - any liquid fuel derived from oil referred to in the subheadings of the Customs Tariff (6) as code 2710 1941 to 2710 1949, or any liquid fuel derived from oil which, as a result of its distillation range, falls within the category of heavy oil - gas oils intended for use as fuel and from which less than 65 per cent by volume (including losses) distils to 250 ° C using the CSN EN ISO 3405 method and distils to 350 ° C at least 85 per cent by volume (including losses);
(e) medium oil - any liquid fuel derived from crude oil referred to in the subheadings of the Customs Tariff (6) as code 2710 1929 or any liquid fuel derived from crude oil, which, as a result of its distillation range, falls within the category of medium oils intended for use as fuel and from which less than 90 per cent of the volume (including losses) is distilled up to 210 ° C using the CSN EN ISO 3405 method and distils up to 250 ° C at least 65 per cent of the volume (including losses);
(f) specific sulphur content of solid fuels - the content of all sulphur, expressed in original state in g.MJ-1 of the calorific value of the spent fuel.
§ 3
Fuel types
(1) The fuels are divided into solid, liquid and gaseous fuels according to their state.
(2) Solid fuels shall be considered as:
(a) coal and fuel produced from it, such as briquettes, coke and other products;
(b) brown coal and fuels produced from it, such as briquettes, semi-coke and other products;
(c) peat briquettes or fuel peat;
(d) natural pieces of wood, including attached bark, rattle and cones;
(e) natural non-split wood in the form of briquettes, chips, sawdust or other products;
(f) biomass, 7)
(g) alternative fuel.
(3) Liquid fuels shall be considered as:
(a) liquid natural gas processing products;
(b) gas oil,
(c) medium oil;
(d) heavy fuel oil;
(e) methanol or ethanol and other pure liquid hydrocarbons;
(f) liquid products of coal, oil and oil processing;
(g) alternative fuel.
(4) Gas fuels shall be considered as:
(a) natural gas, coal, oil and oil processing products;
(b) natural gas, propane or butane or their mixture and other pure gaseous hydrocarbons;
(c) coke oven gas, degas, blast furnace gas, converter gas, biogas, refinery gas, sulphur-containing synthesis gas up to 0,1% by weight and other industrial gases up to 0,1% by weight of sulphur.
§ 4
Fuel quality requirements
(1) Briquettes may be manufactured only using such binders, (8) which are known not to cause more harmful or higher pollutant emissions during combustion than the combustion of fuels on which they are produced.
(2) Wood briquettes may only be made of wood material which has not been chemically treated before brickering and which meets the following maximum permissible values:

(3) The alternative fuel can only be burned in a plant of a particularly large, large or medium source of pollution on which the combustion test has been carried out, including emission measurements and the conditions for its use are specified in the set of technical operational parameters and technical organisational measures of the source. These pollution sources are subject to selected general emission limits under a specific legislation. 9)
(4) The maximum sulphur content in heavy fuel oil made available on the market and intended for combustion must not exceed 1% by weight from 1 January 2003.
(5) The condition set out in paragraph 4 shall not apply to combustion plants:
(a) equipped with a desulphuriser and meeting the relevant emission limits in accordance with specific legislation, 7)
(b) not falling within point (a), if the emissions of sulphur dioxide from the combustion plant do not exceed the emission limit expressed by mass of 1700 mg.m-3 in dry flue gas at an oxygen concentration of 3% vol. in relation to normal state conditions;
(c) located in refineries in cases where the average monthly emissions of sulphur dioxide averaged over all plants of the refinery, excluding combustion plants falling within point (b), regardless of the type of fuel or combination of fuels used do not exceed the emission limits of 1700 mg.m- 3
(6) The maximum sulphur content of gas oils and medium oils made available on the market and intended for combustion must not exceed:
(a) 0,2% by weight until 1 January 2008,
(b) 0,1% by weight as from 1 January 2008.
(7) Liquid fuels shall meet the additional requirements set out in Annex 2 to this Regulation and the content of polychlorinated biphenyls (hereinafter "PCBs') shall not exceed 10 mg.kg-1
(8) Gas fuels must comply with the requirements set out in Annex 2 to this Regulation.
(9) The content of all sulphur in solid fuels for small resources and the population expressed as specific sulphur content shall not exceed the values for:

§ 5
Fuel sampling
Sampling of its production
(a) a producer of fuels intended for direct combustion, taking a sample of the production referred to in Annex 1 to this Regulation, in order to balance the content of the limit values throughout the production of such fuels, but at least once a month;
(b) an importer of fuels intended for direct combustion, which takes a sample from each supply in accordance with Annex 1 to this Decree. The results of the analyses and data on the quantities of fuel imported shall be transmitted to the competent regional authority in order to verify the accuracy of the data, but not later than 1 month after the imports have taken place.
§ 6
Verification of fuel quality
Analyses of samples taken for verification of the quality of solid, liquid and gaseous fuels shall be carried out in laboratories entrusted with the Czech Trade Inspection. 10)
§ 7
Fuel quality certificate
(1) The fuel quality certificate is evidence of compliance by law with the obligations imposed on manufacturers, importers and fuel vendors.
(2) When offering fuel, the manufacturer, importer and seller shall certify its quality. The fuel quality certificate shall contain:
(a) in the case of a natural person - name and surname, date of birth and address of the place of permanent residence and, where appropriate, a distinguishing supplement;
(b) in the case of a legal person - a business name, registered office, identification number, if any. Furthermore, the applicant shall indicate the number of the trade licence, if issued, or a similar document of the relevant authorisation, and, where he is a natural person authorised to do business, shall indicate the trade name or business name under which he operates,
(c) the type of fuel and its production description;
(d) a declaration of non-compliance with the applicable fuel limit values (for alternative fuels, a declaration of non-compliance with the applicable emission limits);
(e) weight,
(f) the date of loading,
(g) the name and surname of the official who issued the certificate.
(3) In catalogues on the quality of coal, commercial offers and in the delivery documentation of each supply of coal intended for the population, the manufacturer shall indicate the maximum content of all sulphur in the anhydrous state, the average ash content in the anhydrous state, the average content of all water in the original state, the minimum calorific value in the original state and declare compliance with the corresponding value of the maximum specific sulphur content.
(4) The fuel quality certificate shall be registered by any legal or natural person who has recorded the production or trade in fuels or the import or export of fuels in the Commercial Register.
§ 8
Sampling shall begin within six months of the date of application of this Decree.
§ 9
Efficacy
This decree shall take effect on the day of its publication.

SAMPLING
Sampling to meet the requirements of Section 5 to obtain a representative sample shall be carried out in accordance with procedures standardised in technical standards. The sampling shall verify the occurrence of systematic errors within the meaning of those standards.
1) Solid fuels:

METHODS FOR DETERMINING FUEL QUALITY
1) Solid fuels
(a) The reference methods for determining the content of all sulphur in solid fuels shall be the following standardised procedures, as amended:
CSN 44 1379 Solid fuels. Determination of all sulphur content by ESCHKA method,
EN ISO 351 (44 1353) Solid fuels. Determination of total sulphur content - high temperature combustion method.
(b) The measured sulphur content is calculated using the formula

(c) The following standard procedures shall be used for determining the calorific value of solid fuels:
CSN ISO 1928 (44 1352) Solid fuels. Determination of combustion heat by calorimetric method in the pressure vessel and calculation of calorimetry.
Related valid CSN and CSN ISO for the determination of water, ash, carbon, hydrogen and volatile flammable substances.
2) Liquid fuels
(a) The reference methods for determining the sulphur content of liquid fuels shall be the following standardised procedures, as amended:
for heavy fuel oil
ČSN EN ISO 8754 (65 6035) Petroleum products - Determination of sulphur content - Method of X-ray fluorescence with energy dispersion and ČSN EN ISO 14596 Petroleum products, determination of sulphur - long-wave dispersion fluorescent spectrometry
for gas oil

Method of combustion according to Wickbold (ISO 4260: 1987), CSN EN ISO 8754 (65 6035) Petroleum products - Determination of sulphur content - Method of X-ray fluorescence with energy dispersion and CSN EN ISO 14596 Petroleum products, determination of sulphur - long-wave dispersion fluorescent spectrometry
The arbitration method for determining the sulphur content of liquid fuels is CSN EN ISO 14596 Petroleum products, determination of sulphur - long-wave dispersion fluorescent spectrometry.
b) Statistical interpretation of the verification of the sulphur content of gas oil will be in accordance with ČSN EN ISO 4259 Petroleum products - Determination and use of conformity data in relation to test methods.
(c) The quality requirements for liquid fuels are set out in the standard as amended by ČSN 65 7991 Petroleum products. Heating oils. Technical requirements.
(d) The reference method for determining the PCB content in liquid fuels is CSN EN 12766-1,2 (65 6205) Petroleum products and used oils - Determination of PCBs and similar products.
Part 1: Separation and determination of PCB congeners by gas chromatography (GC) using an electron trap detector, using EN 12766-2 (65 6205) Petroleum products and used oils - Determination of PCBs and similar products.
Part 2: Calculation of the polychlorinated biphenyl content.
3) Gas fuels
The quality requirements for gaseous fuels and reference methods are set out in the following standards, as amended:
