THE LAW
of 9 December 1999
amending Act No. 92 / 1996 Coll., on Varieties, Seeds and Propagating Plants, and Act No. 368 / 1992 Coll., on Administrative Charges, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the plant variety, seed and planting law
Act No. 92 / 1996 Coll., on Varieties, Seeds and Propagating Plants, is amended as follows:
1. in Article 2, the following point (h) is inserted after point (g):
"(h) propagating material of breeding material corresponding to the description of the variety in the care of the breeder of the variety, which serves to produce basic propagating material and is not subject to recognition. At the request of the keeper, it may be recognised for use in the production of certified propagating material, '.
Points (h), (i), (j), (k) and (l) shall be renumbered (i), (j), (k), (l) and (m).
2. in Article 2 (i), the words "Central Audit and Examination Institute of Agriculture (hereinafter referred to as" Institute ")" shall be deleted;
3. In Article 2 (j), the words "or recognised breeding animals' shall be inserted after the words" from the basic 'and the words "by the Constitution' shall be deleted.
4. In Section 3, the word "Constitution 2 'is replaced by" Central Audit and Examination Institute of Agriculture (hereinafter referred to as "Institute') 2 '.
5. In Article 4 (1), the words "and their hybrids' are deleted.
6. In Article 6 (2) (d), the words "and under what name 'shall be inserted after the words" countries'.
7. In Article 6 (2), at the end of point (i), the dot is replaced by a comma and the following point (j) is added:
"(j) information as to whether the variety is intended exclusively for export."
8. In Article 7 (4), the dot at the end of point (g) is replaced by a comma and the following point (h) is added:
"(h) varieties for which registration is required only for export."
9. In Article 7, the following paragraph 7 is added:
"(7) The costs of the test operations linked to the registration procedure shall be borne by the registrant."
10. In Article 9, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) A foreign variety shall be left with its original name if it complies with paragraph 1. ';
11. in Paragraph 12 (3):
"(3) The Institute shall:
(a) publish annually a list of all varieties registered in the State Variety Book, including the address details of their keepers and persons entitled to the variety under a special law, 3)
(b) publish the results of the tests on the value of the newly registered varieties referred to in Article 7 (4). "
12. In Article 15 (1), the following sentence is inserted after the first sentence: "Varieties of fruit and ornamental trees, hops and vines shall be registered for 15 years."
13. in Paragraph 15 (4):
"(4) An application for renewal shall be submitted to the Institute no later than two years before the expiry of the registration period. ';
14. in Article 20 (1) (a), the words "including the results of their examinations" shall be inserted after the words "established by the Constitution."
15. in Article 20 (1), the comma at the end of point (b) shall be replaced by a dot and point (c) shall be deleted;
16. In Paragraph 20 (2), the words "to familiarise itself with the" s' sub-heading "shall be replaced by 'and the word' field 'shall be deleted.
17. in Paragraph 21 (1) (a), the word "Constitution" shall be deleted;
18. in Paragraph 22 (1) (a) read:
'(a) the crops used for the production of basic or certified propagating material; the crop of genetic components used for the production of hybrid varieties is considered as a pre-stage in the category of basic propagating material, in the case of vegetables as breeding material,';
19. in Paragraph 22 (2), at the end of point (f), the dot is replaced by a comma and the following point (g) is added:
"(g) the consent of the breeder of the breeding certificate, (3) if the variety is protected, or the consent of the breeder of a variety not protected under the special legislation3) for the production of basic or certified propagating material for circulation; where there are more than one maintenance unit, the consent of one of them shall suffice. ';
20. In Article 22, the following paragraph 13 is added:
"(13) The costs of professional activities linked to recognition shall be borne by the applicant for recognition."
21. Paragraph 23 (1) reads:
"(1) Standard propagating material must be produced under the supervision of the keeper."
22. In the second sentence of Section 24, the words "for standard propagating material 'are deleted.
23. In Paragraph 25, paragraphs 2 to 6 are deleted and paragraph 1 is deleted.
24. In Article 26 (1), the words "species" shall be inserted after the words "material of the mixture."
25. in Article 26 (3), the words' its quantity 'shall be deleted and the words' names' shall be inserted after the words' individual species';
26. in Article 27 (1) and (2), including footnote 6):
"(1) The customs authority shall place propagating material under the free circulation customs procedure (6) or inward processing procedure (6) if, when the declaration is lodged, the declarant (6) submits an authorisation to import propagating material issued by the Institute. No authorisation is required for imports of propagating material
(a) a variety which may be put into circulation in the Czech Republic under Section 4 of this Act;
(b) species not included in the species list referred to in Article 4 (4).
(2) The authorisation to import propagating material which will be regulated, reproduced or grown exclusively for export under the contract shall be issued by the Institute at the request of the person intending to import the propagating material, hereinafter referred to as the importer,
(a) where an administrative fee is paid; and
(b) where sampling is ensured by a post-inspection institute.

27. In Paragraph 27, the following paragraphs 4 and 5 are inserted after paragraph 3:
"(4) Basic or certified propagating material may be imported and put into circulation, (6) only if it is officially recognised as basic or certified in the country of origin and is accompanied by the appropriate official document.
(5) The importer shall notify the Institute of each individual case of import of basic certified and standard propagating material no later than seven days after its importation. ';
Paragraph 4 shall become paragraph 6.
28. In Paragraph 28 (3), the words "or mixture 'shall be added at the end of point (b).
29. In Paragraph 28 (3), at the end of the dot, point (i) is replaced by the following:
"(i) the name of the person who ensures the production or import of propagating material."
30. In Paragraph 28, the following sentence is added at the end of paragraph 4: "The costs of the purchase of official labels and fuses shall be borne by the applicant. '.
31. The heading under Paragraph 31 reads: "Registration of activities, reporting and record keeping obligations."
32. in Paragraph 31 (1):
"(1) Person (1) who ensures the production or import of propagating material for the purpose of putting it into circulation, (6) must be registered with the Institute for this purpose. The Institute registers a person on request, 1) which
(a) demonstrate competence in accordance with the requirements published by the Ministry in the Journal;
(b) pay the administrative payment.4) ';
33. In Paragraph 31, the following paragraph 2 is inserted after paragraph 1:
"(2) Registration may be revoked if the law is infringed. '
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
34. in Paragraph 31 (4), "paragraphs 1 and 2" shall be replaced by "paragraphs 1 and 3";
35. in Paragraph 32 (1):
"(1) The Ministry may, if the supply of the market with certified propagating material of certain species listed in the list of species is seriously jeopardised, lay down and notify in the Journal the species whose propagating material may be put into circulation as commercial for a period of one year from the date of notification in the Journal, the characteristics which it must possess and the manner of its control. ';
36. in Paragraph 33 (2) (a), the words "and the land concerned" shall be inserted after the words "the material is produced."
37. in Paragraph 33 (3) (a), the words "and the land concerned" shall be inserted after the words "the material is produced."
38. in Paragraph 34 (2) (e), the words "registration or" shall be inserted after the words "not to comply."
39. Annex No 1, including footnote 11, reads:

TRANSITIONAL PROVISIONS
Persons registered pursuant to § 31 (1) of Act No. 92 / 1996 Coll., on Varieties, Seeds and Propagating Plants, must apply for registration under this Act within 60 days of its entry into force, otherwise the registration ceases.
