DECLARATION
of 6 December 2023
determining the extent to which the price of services provided is to be charged by type of service
Pursuant to Article 150 (5) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 310 / 2006 Coll., Act No. 110 / 2007 Coll., Act No. 261 / 2007 Coll., Act No. 304 / 2007 Coll., Act No. 247 / 2008 Coll., Act No. 153 / 2010 Coll., Act No. 468 / 2011 Coll., Act No. 214 / 2013 Coll., Act No. 258 / 2014 Coll., Act No. 252 / 2017 Coll., Act No. 311 / 2019 Coll., Act No. 150 / 2021 Coll., Act No. 374 / 2021 Coll., and Act No. 202 / 2023 Coll., implementing § 64 (13) Act on Electronic Communications:
Definition of terms
For the purposes of this decree:
(a) the pricing plan shall provide a set of basic price and, where appropriate, quality parameters for the service agreed by the subscriber who is the end user or, where applicable, the user of the publicly available electronic communications service for the purpose of establishing and using the service;
(b) a free unit of service which is paid in the flat-rate price for the settlement period;
(c) the unit of measurement of the quantity provided, consumed or charged by each type of service;
(d) the flat-rate price of the regular price for the price plan for the settlement period to be paid by the subscriber who is the end user or, where applicable, the user of the publicly available electronic communications service, regardless of the actual volume of consumption.
Forms for charging the price of services provided by type of service
(1) The pricing of Internet access services provided or number-based interpersonal communications services (hereinafter referred to as "service") by each individual service specified in the separate price list item (hereinafter referred to as "type of service") submitted by the service provider (hereinafter referred to as "provider") to the subscriber who is the end user or, where applicable, the user of publicly available electronic communications services, shall include at least:
(a) a telephone number, if allocated for the type of service concerned;
(b) an indication of the agreed price plan;
(c) the definition of the settlement period on the date of the first and last day of the settlement period;
(d) an indication of the time at which the status of the provider's recording equipment was taken over on the last day of the settlement period, unless the status was taken over at 24.00 hours;
(e) breakdown of different types of services, broken down by operation within the Czech Republic, within the European Union and outside the European Union and, for an interpersonal communication service based on numbers, broken down by operation in the Czech Republic into its own network, operation in the Czech Republic outside its own network and other operations into numbers with access codes to the service or group of services determined by the nature of the service under the legislation governing numbering plans of the electronic communications networks and services, with a distinction of operations according to different daily periods, if they are charged differently, to individual agreed price plans with the following data:
1. the number of available spare units in the price plan in the given settlement period, indicating the unit of measurement;
2. the number of additional units of the price plan provided in one-off increments in a given settlement period, indicating the unit of measurement;
3. the number of units consumed, indicating the unit of measurement,
4. the total number of units charged, specifying the unit of measurement;
5. the flat-rate price for the settlement period in Czech crowns indicating whether the price is with or without value added tax;
6. the price for the one-off increase of additional units in the Czech crowns in the given settlement period, indicating whether the price is with or without value added tax,
7. the total price in Czech crowns indicating whether it is the price with or without value added tax,
8. Value added tax rate,
(f) information on the number of unused units transferred from the previous or subsequent settlement period, specifying the unit of measurement if transferred;
(g) settlement of advances, overpayments or arrears;
(h) the total amount to be paid in Czech crowns by indicating the total amount excluding value added tax, value added tax and the total amount with value added tax;
(i) the date of payment of the amount charged;
(j) information on the way in which the claim is applied, including an indication of where and within which time limits the claim can be applied.
(2) The formalities referred to in paragraph 1 (e) (3) and (4) shall not be provided for the provision of an unrestricted Internet access service and unlimited voice services.
(3) Where the price bill referred to in paragraph 1 is issued for more than one connection, for more than one subscriber's station or for more than one telephone number, it shall include the items referred to in paragraph 1 (a) to (f) for each of these connections, participating stations or for each telephone number. Similarly, if multiple telephone numbers are used for one connection or a participating station, it shall be done.
Repeal
Decree No. 135 / 2012 Coll., on determining the extent of the price bill by type of service, is deleted.
Efficacy
This Decree shall take effect on 1 July 2024.
