DECLARATION
of 24 October 2016
on the establishment of protection zones of natural mineral water sources washed by BQ-2 in the cadastral territory of Rohatec and the definition of specific protective measures
According to § 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Points and on the amendment of certain related laws (Spa Act), for the implementation of § 21 (1), § 22 (5), § 23 (3) and § 24 (2):
Establishment of protection zones
(1) In order to protect the source of natural mineral water ingested with BQ-2, located on land parcel No 3256 / 1 of the cadastral territory of Rohatec, Hodonin county, South Moravian Region ("the source"), protection zones of Grade I and II are established.
(2) Level I protection zone consists of the immediate vicinity of the output of the source, is defined by a square of 10 m side and is graphically marked in a copy of the cadastral map, which is annexed to this decree, and on a map of 1: 10 000 scale, which is annexed to this decree. Level I protection is also a zone of physical protection of the source.
(3) Level II protection zone is established for the protection of the infiltration territory of the established source structure. It is graphically marked in a copy of the cadastral map, which is annexed to the Order No 1 and on a map of the scale of 1: 10 000, which is annexed to the Order No 2.
Definition of specific safeguard measures
(1) Entry shall be prohibited in the territory of the Class I protection zone.
(2) Level II protection zone is prohibited
(a) to build or operate petrol stations and oil boilers;
(b) to build or operate waste landfills and to store waste;
(c) place field fertilizers or silage storage facilities;
(d) to export the contents of immediate pit, urine or manure of livestock to land;
(e) to build or operate permanent storage areas for petroleum products, fertilisers and chemical products;
(f) apply chemical plant protection products for which the quality or quantity of groundwater or source cannot be clearly excluded;
(g) treat particularly dangerous or harmful substances to a greater extent or where treatment is associated with an increased risk of contamination of surface or groundwater;
(h) to build or operate objects for agricultural production, industrial production objects and other objects in which it is a significant component of the technology of handling defective substances which may jeopardise the quality of surface or groundwater;
(i) the discharge into surface or groundwater of uncleaned waste water and of harmful substances liable to endanger the quality of surface or groundwater;
(j) dispose of the contents of the cesspool and of the urine pit;
k) implement wells and heat pumps or build wells; or
(l) carry out mining activities, activities carried out in a mining manner or by tearing work.
Physical protection zone
The band of physical protection of the source shall be fenced with a fixed fence.
Efficacy
This Decision shall enter into force on 14 November 2016.
