of 18 December 2014
amending certain laws in connection with the adoption of a law on the competence of the customs authorities of the Czech Republic in respect of the enforcement of intellectual property rights
Parliament has decided on this law of the Czech Republic:
Amendment to the Consumer Protection Act
Act No. 634 / 1992 Coll., as amended by Act No. 217 / 1993 Coll., Act No. 40 / 1995 Coll., Act No. 104 / 1995 Coll., Act No. 110 / 1997 Coll., Act No. 356 / 1999 Coll., Act No. 36 / 2008 Coll., Act No. 151 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 227 / 2004 Coll., Act No. 214 / 2003 Coll., Act No. 439 / 2003 Coll., Act No. 119 / 2004 Coll., Act No. 186 / 2004 Coll., Act No. 227 / 2003 Coll.
1. In § 14a, at the end of the text, the words "or the customs administration of the Czech Republic 'are added.
2. in Article 23 (1), the words "and 8 to 12 and 16 'are replaced by the words", 7 to 11 and 15';
3. Paragraph 23 (6) is deleted.
Paragraphs 7 to 16 shall become paragraphs 6 to 15.
4. In Article 23 (6), the words "under customs supervision 22) 'are replaced by the words" in respect of which the customs office exercises jurisdiction under the directly applicable European Union law' and the words "to the customs office responsible (23), (24) for carrying out the customs procedure and further proceedings' are replaced by the words" customs office '.
footnotes 22 to 24 are deleted.
Transitional provisions
1. The procedure under Act No. 634 / 1992 Coll., as effective before the date of entry into force of this Act, which was initiated before the authorities of the Customs Administration of the Czech Republic before the date of entry into force of this Act, shall be completed in accordance with Act No. 634 / 1992 Coll., as effective before the date of entry into force of this Act.
2. If the authority of the Customs Administration of the Czech Republic has decided to suspend the sale of products or the provision of services or the closure of an establishment pursuant to Act No. 634 / 1992 Coll., as effective before the date of entry into force of this Act, the authorities of the Customs Administration of the Czech Republic shall, when granting written consent to the renewal of the sale of products or the provision of services or the opening of an establishment pursuant to Act No. 634 / 1992 Coll., as effective before the date of entry into force of this Act.
Amendment of copyright law
In Act No. 121 / 2000 Coll., on copyright law, on copyright law and on the amendment of certain laws (Copyright Act), as amended by Act No. 81 / 2005 Coll., Act No. 61 / 2006 Coll., Act No. 186 / 2006 Coll., Act No. 216 / 2006 Coll., Act No. 168 / 2008 Coll., Act No. 41 / 2009 Coll., Act No. 227 / 2009 Coll., Act No. 153 / 2010 Coll., Act No. 156 / 2013 Coll., Act No. 303 / 2013 Coll., Act No. 64 / 2014 Coll., Act No. 228 / 2014 Coll., Act No. 18 / 2012 Coll.
Transitional provision
The procedure under Act No. 121 / 2000 Coll., as effective before the date of entry into force of the Act, which was initiated before the authorities of the Customs Administration of the Czech Republic before the date of entry into force of the Act, shall be completed under Act No. 121 / 2000 Coll., as effective before the date of entry into force of the Act.
EFFECTIVE
This Act shall take effect on 1 January 2015.
