of 29 June 2006
laying down the methods and conditions for registration, operation, testing of historical and sports vehicles and the methods and conditions for testing of road vehicles registered in the road vehicle register
The Ministry of Transport (hereinafter referred to as "the Ministry ') provides, pursuant to Paragraph 91 (1) of Act No. 56 / 2001 Coll., on the Conditions for the Operation of Vehicles on the Road and amending Act No. 168 / 1999 Coll., on the Insurance of Liability for Vehicle Operation and on the Amendment of Certain Related Laws (Act on Vehicle Liability Insurance), as amended by Act No. 307 / 1999 Coll., as amended by Act No. 411 / 2005 Coll., (hereinafter referred to as" the Act'), for the implementation of § 7 (4), § 79a (5) and § 79b (7):
§ 1
Subject matter
This decree regulates
(a) the manner and conditions of registration of a historic and sports vehicle;
(b) a model for the historical vehicle;
(c) the conditions of operation of the historic and sports vehicles;
(d) the method and conditions of testing the historical and sports vehicle;
(e) a model application for testing of a historical and sports vehicle;
(f) the method and conditions for testing a road vehicle which is registered in the register of road vehicles ("road vehicle");
(g) a model application for recognition of the testing of a road vehicle;
(h) a model of evidence of recognition of the testing of a road vehicle for historical originality.
§ 2
Registration of a historical vehicle
(1) The local competent authority shall enter the assignment of the special registration mark for historical vehicles, the data on the owner of the historical vehicle and the data on the operator of the historical vehicle, unless the owner is simultaneously the operator of the historical vehicle, as well as the technical data on the historical vehicle in the historical vehicle licence. The historical vehicle licence shall improve the colour photographs of the historical vehicle and, if necessary, lay down specific conditions for its use on the road according to the registration given in the application for testing of the historical vehicle. The validity of the testing and the result of the technical examination of the historical vehicle shall be verified locally by the competent authority and shall be indicated in the historical vehicle certificate when it is issued. The vehicle registration certificate shall indicate the assignment of the special registration mark for historical vehicles, the historical vehicle owner data or the historical vehicle operator data, unless the owner is the operator of the historical vehicle at the same time, the technical details of the historical vehicle and the entry in the "other records' box" shall be carried out by means of the "PAYMENT OF THE HISTORIC VEHICLE '.
(2) Where the owner or operator of a historical vehicle intends to operate more than one historical vehicle under one special registration mark for historical vehicles, he shall submit a registration application together with the prescribed documents for all such vehicles. The local competent authority shall carry out a summary registration of all such historical vehicles and shall assign only one special registration mark to the applicant for historical vehicles, which it shall enter on the issue of all historical vehicle licences and shall issue a vehicle registration certificate for all such historical vehicles.
(3) If the owner or operator of a historic vehicle intends to operate another historical vehicle and has already been assigned a specific registration mark for an existing historical vehicle, he shall submit to the application for the extension of the registration of another vehicle under that special registration mark the documents provided for the registration of that additional vehicle.
(4) The competent authority shall place in the file of the historical vehicle the original registration documents and documents of origin, if any, and an application for testing of the historical vehicle containing the positive test report and, where appropriate, other documents submitted. In the register of historical and sports vehicles, the competent authority shall, locally, include scanned copies of such documents.
(5) The model of the historical vehicle certificate is set out in Annex 1 to this Regulation, the model application for registration of the historical vehicle in the register of historical and sports vehicles is set out in Annex 2 to this Regulation and the model application for testing of the historical vehicle is set out in Annex 3 to this Regulation.
§ 3
Registration of a sports vehicle
(1) The local competent authority shall enter the assignment of a special registration mark for a sports vehicle, data on the owner of a sports vehicle or data on the operator of a sports vehicle, unless the owner is simultaneously an operator of a sports vehicle, and technical data on the sport vehicle in the register of historical and sports vehicles. In the vehicle registration certificate it shall enter the assigned special registration mark for a sports vehicle, the information on the owner of the sports vehicle or the information on the operator of the sports vehicle, if the owner is not the owner of the sports vehicle at the same time, and the technical information on the vehicle and in the box "other records' the entry" PAYMENT WITH THE SPORT VEHICLE 'shall be made.
(2) Each sports vehicle is assigned a special registration mark for sports vehicles. On the front of a sports car, a plate with a special registration mark for sports vehicles may be replaced by a plate printed on a self-adhesive film with dimensions 330 x 85 mm, where the characters of letters and figures must be at least 56 mm high and 30 mm wide, the line thickness being 8 mm. The standard table with a special registration plate for a sports vehicle is located inside a sports car on the right rear door. In the case of a sports motorcycle, the special registration mark for sports vehicles may be replaced by a printed on a self-adhesive sheet of 80 x 100 mm size, where the characters of letters and figures must be at least 28 mm high and 15 mm wide, the line thickness being 4 mm.
(3) The local competent authority shall establish the original external registration documents in the sport vehicle file if the vehicle has been registered abroad. A copy of the technical drawings and other documents provided for the rebuilding or construction of the sports vehicle shall be included in the sport vehicle file.
(4) The model of the application for registration of a sports vehicle in the register of historical and sports vehicles is set out in Annex 4 to this Regulation and the model of the application for testing of a sports vehicle is set out in Annex 5 to this Regulation.
§ 4
Operation of the historic road vehicle
The historical vehicle may only be operated on road traffic if it meets the technical requirements for position lights applicable to the category of vehicle at the time of the first approval of the technical competence of the vehicle in the Czech Republic. If the vehicle is not equipped with the prescribed number of position lights from the vehicle manufacturer, it shall be equipped with two white position lights at the front and two red position lights at the rear, except for one-stop vehicles which shall be equipped with one white light at the front and one red-colour at the rear. In the case of historical vehicles, an accompanying vehicle with a yellow warning light may be prescribed to ensure the safe transport of over-sized vehicles or military combat vehicles, its maximum speed and other road traffic conditions, as determined by the competent authority locally. This shall be recorded on the historical vehicle licence.
§ 5
Operation of a sports vehicle on the road
The operation of a sports vehicle on the road is allowed in the framework of a sports competition, which is published in national sports schedules, which are part of the calendar of national and international car and motorcycle sports competitions. The organizer of the sport competition shall carry out technical acceptance of sports vehicles with the participation of technical commissioners who check that the sports vehicle meets the technical requirements laid down by the International Automotive Federation or the International Motorcycle Federation and the technical conditions laid down by law. All sports vehicles registered for the sport competition shall be subjected to technical acceptance. If a sports vehicle does not have valid testing, it cannot be technically taken over. A sports vehicle cannot be technically taken over if it shows defects in the technical acceptance.
§ 6
Testing of a historical or road vehicle
(1) The testing of a historic or road vehicle is carried out by a legal person authorised by the International Federation of Historical Vehicles under the International Technical Code of the International Federation of Historical Vehicles - FIVA, International Technical Code (hereinafter referred to as the International Technical Code), as amended, or by the International Automotive Federation, in accordance with Annex K to the International Sports Code - FIA, Appendix K to the International Sporting Code (hereinafter referred to as the International Sports Regulations).
(2) The legal person who has carried out the testing of the vehicle for historical originality shall electronically provide the Ministry with vehicle data which has been tested with a positive result, within the scope of the factory brand, type, vehicle identification number (VIN), owner and operator, and a scanned copy of the complete and validated application for testing the historical vehicle.
(3) When testing a historical or road vehicle, its historical originality shall be verified. The result of the testing of a historical or road vehicle shall be marked by a legal person in the application for testing of a historical vehicle and in the certificate of a historical vehicle, if issued.
(4) Annex 6 to this Decree lays down rules for uniform testing of historical vehicles.
(5) For the testing of a road vehicle, Annex 6 to this Decree shall apply mutatis mutandis.
(6) The model of the application for recognition of the testing of a road vehicle is set out in Annex 7 to this Regulation and the model of the evidence of recognition of the testing of a road vehicle on historical origin is set out in Annex 8 to this Regulation.
§ 7
Testing of sports vehicles
(1) Testing of sports vehicles is carried out nationally once per calendar year. The testing shall be carried out at the technical inspection station, at no more than four times through a legal person authorised by the International Automotive Federation or the International Motorcycle Federation.
(2) The place and dates of national testing shall be determined by the legal person referred to in paragraph 1 in agreement with the Ministry. The testing shall be carried out with the participation of the Ministry in the testing centre, the measurements carried out at the expense of the owner or the operator of the sports vehicle.
(3) When testing sports vehicles, testing officers shall check that the sport vehicle complies with the certificate, national or international sports regulations and approved technical regulations. The testing shall include carrying out a specific technical inspection of the vehicle in full range of the periodic technical inspection at the technical inspection station, the external noise control of the vehicle and the level of vehicle pollution emissions in the exhaust gases. The measurement of pollutant emissions in exhaust gases shall not be subject to sports motorcycles.
(4) If a sports vehicle reports in the test of a defect, the testing shall be terminated and the result shall not be entered in the sport vehicle licence. Repeated testing shall be carried out in agreement with the legal person at the designated replacement date in the designated test room.
(5) Where the technical competence of a sports vehicle placed in service is approved or the vehicle is imported individually from abroad outside the dates of regular testing of sports vehicles, testing of such sports vehicles may be carried out outside the specified dates in the designated testing centre.
(6) Where a sports vehicle has been tested positively in accordance with paragraph 4 or 5, the Ministry shall indicate in the sport vehicle licence the road traffic permit.
§ 8
Transitional provisions
(1) The validity of tables bearing the special registration mark - permanent handling which have been allocated to historical vehicles expires on 31 December 2006.
(2) The validity of certificates of historical vehicles issued to historical vehicles pursuant to Decree No. 240 / 2002 Coll. expires on 31 December 2008.
(3) The validity of the tables bearing the standard registration mark allocated to sports vehicles before the entry into force of this Decree expires on 31 December 2008.
§ 9
Repeal
Decree No. 240 / 2002 Coll., on registration and testing and operation of historical vehicles and sports vehicles is hereby repealed.
§ 10
Efficacy
This decree shall take effect on the day of its publication.

Rules for uniform testing of historical vehicles
1. In order to maintain the uniformity of testing of historical vehicles for historical originality, this testing is carried out in the Czech Republic according to the International Technical Code or the International Sports Code.
2. According to the International Technical Code, a mechanical vehicle of at least 30 years old, the type of which is no longer produced and which is stored and maintained in the historical state and the technical characteristics of its main components have not been subject to substantial changes and is therefore part of the technical and cultural heritage.
3. The applicant for testing the vehicle for historical originality, together with the completed application for testing the historical vehicle in accordance with the model set out in Annex 3 to this Regulation, shall present the vehicle for verification of the actual state of the vehicle and at the same time prepare documents to verify the data in the application and to verify the historical originality which may arise in the testing. The colour photographs of the vehicle attached to the application may be in electronic form or the size of 6 x 9 cm on hard glossy photo paper.
