DECLARATION
of 16 October 2003
amending Decree No. 89 / 2002 Coll., on the protection against the introduction of harmful organisms on the import, transit and export of plants, plant products and other objects and against their spread within the Czech Republic and on systematic phytosanitary inspection
The Ministry of Agriculture, after consulting the Ministry of Transport, the Ministry of Finance and the Ministry of Industry and Trade, provides pursuant to Article 45 (1) of Act No. 147 / 1996 Coll., on Phytosanitary Care and Amendments to Certain Related Acts, as amended by Act No. 409 / 2000 Coll. and Act No. 314 / 2001 Coll., (hereinafter "the Act '):
Decree No 89 / 2002 Coll., on the protection against the introduction of harmful organisms on the import, transit and export of plants, plant products and other objects and against their spread within the Czech Republic and on systematic plant health control, is amended as follows:
1. In Article 1, at the end of paragraph 1, the dot is replaced by a comma and the following points (k) to (m) are added:
"(k) continuous operating mode - a mode of operation in which plant health checks are carried out at the point of entry at import and transit without time limits, 24 hours a day, 7 days a week,
(l) intermittent operating regime - an operational regime in which the worker of the plant health administration is present at the point of entry and the performance of the plant health inspection of consignments at import and transit is carried out only at the specified operating time and as determined by the notification of the plant health administration;
(m) an operating call regime - a special operating regime whereby the presence of a plant health worker at the point of entry shall be ensured in advance by the importer or declarant, upon prior request, in a manner specified for each point of entry in public contact; where appropriate, an inspection of the consignment shall be agreed at the time specified in the operating rules of the point of entry. ';
2. in Paragraph 3 (4) (d):
"(d) whether or not a registered plant is imported, grown or produced, whether it intends to apply for the issue of replacement passports pursuant to Article 7 (1) of the Act and whether it has been authorised to issue plant passports pursuant to Article 7e (4) of the Act,";
3. in Article 7 (1) (b), the word "district" shall be deleted;
4. in Article 8 (3) (a), the word "district" shall be deleted;
5. In Article 9 (1) (c), the word "district 'is deleted.
6. The heading of Section 19 reads: "Quarantine harmful organisms whose presence or suspected occurrence is subject to exceptional plant health measures and the method of professional investigation."
7. In Article 19, the following paragraph 1 is added:
"(1) Quarantine harmful organisms which have been found to occur or suspected of occurring subject to exceptional plant health measures under Article 15 of the Act are listed in Annexes 8 and 9."
The current text becomes paragraph 2.
8. In Annex 4, point 9 reads as follows:

Winsl. et al., byly zničeny; zbylé rostliny v místě produkce nesmějí být uváděny do oběhu v okrese, v němž nebyl zjištěn výskyt Erwinia amylovora (Burr.) Winsl. et al.“. |
9. In Annex 4, point 12, the words "-Apricot chlorotic leafroll phytoplasma 'are deleted.
10. In the second indent of point 15 (b) of Annex 4, the words "during the last six complete growing seasons' are deleted.
11. in Annex 4, point 16.1 (b) (1), second indent, the words "during the last three completed growing seasons" shall be deleted;
12. in Annex 4, point 16.2 (b) (1), second indent, the words "during the last three completed growing seasons" shall be deleted;
13. In Annex 4, point 31 is added:

This Decree shall take effect on 1 November 2003, with the exception of points 8 to 12 and point 14, which shall take effect on the date of its publication. This decree will expire on the date of entry into force of the Treaty of Accession of the Czech Republic to the European Union.
