GOVERNMENT REGULATION
of 17 December 1997
amending and supplementing Government Decree No 79 / 1994 Coll., on the pay ratios of armed forces, security forces and services, customs authorities, fire protection officers and employees of certain other organisations (Staff Regulations), as amended
The Government orders pursuant to § 23 (b), (c), (d) and (f) of Act No. 143 / 1992 Coll., on the salary and remuneration of on-call time in the budget and in certain other organisations and bodies, as amended by Act No. 40 / 1994 Coll.:
Čl. I
Government Decree No 79 / 1994 Coll., on the pay ratios of employees of armed forces, security bodies and services, customs authorities, fire protection officers and employees of certain other organisations (Staff Regulations), as amended by Government Decree No. 143 / 1995 Coll., Government Decree No. 72 / 1996 Coll. and Government Decree No. 327 / 1996 Coll., are amended as follows:
Article 1 (2) (b) reads as follows:
"(b) Member and civil servant of the Police of the Czech Republic,"
2. the following words are added at the end of Paragraph 1 (2) (e): "except for civil servants included in the Fire Department of the Czech Republic and in the educational and technical facilities of the Department of Interior Fire Protection,"
3. Paragraph 1 (2) (g), including footnote 1, reads as follows:
"(g) a civil servant of the Office for Foreign Relations and Information and a civil servant of a budgetary organisation or of a contribution organisation in which pay ratios are governed by law, (1) if the Ministry of Defence is the founder of such organisations.
1) Paragraph 1 (1) (b) of Act No. 143 / 1992 Coll., on the salary and remuneration of on-call time in the budget and in certain other organisations and bodies. '
4. the following point (c) of Article 3 (2) is added:
"(c) the rules governing the inclusion in the grade of staff members who do not meet the requirements for the proper performance of their duties
1. the requirements laid down by the employer under point (b);
2. the qualification requirements laid down in a specific regulation, (3) unless otherwise specified in this specific regulation.
3) For example, § 53 of Act No. 20 / 1966 Coll., on the care of the health of the people, as amended by Act No. 548 / 1991 Coll., § 51 of Act No. 29 / 1984 Coll., on the System of Primary Schools, Secondary Schools and Higher Vocational Schools (Education Act), as amended by Act No. 138 / 1995 Coll., Decree of the Ministry of Education, Youth and Sports No. 139 / 1997 Coll., on the conditions of professional and pedagogical competence of teaching staff and on the conditions of qualification of educational advisers. '
5. In the second sentence of Paragraph 4 (2), the words "degree, focus or field of education 'are replaced by" degree of education'.
6. In Paragraph 4 (3), the words "degree, focus or field of education 'are replaced by" degree of education'.
7. Article 4 (3) (d) reads as follows:
"(d) it shall be classified in no more than the seventh grade, provided that, for the proper performance of the required work, the employer fulfils the conditions laid down in a specific regulation or the requirement of professional learning laid down in accordance with Article 3 (2) (a)."
8. Article 4 (3) (g), including Notes 9) and 9a, reads as follows:
"(g) satisfies the conditions of professional and pedagogical competence laid down in the Specific Regulation9) or the qualification conditions for the performance of the duties laid down in the Specific Regulation. 9a)
9) Paragraph 2 (4) of Decree No. 139 / 1997 Coll., on the conditions of professional and pedagogical competence of teachers and on the assumptions of qualifications of educational advisers.
9a) For example, the Decree of the Ministry of Interior of the Czech Republic No. 374 / 1992 Coll., implementing the Act of the Czech National Council No. 186 / 1992 Coll., on the service relationship of members of the Police of the Czech Republic, as amended by Decree No. 33 / 1993 Coll. and the Ordinance of the Ministry of Interior No. 304 / 1996 Coll., Decree of the Ministry of Defence No. 113 / 1996 Coll., implementing certain provisions of the Act No. 76 / 1959 Coll., on certain service conditions of soldiers, as amended by the Ordinance of the Ministry of Interior No. 21 / 1996 Coll. '
9. in Article 5 (1) (b) and (c), the words "when a staff member is first assigned to the relevant grade" shall be deleted;

"(4) For the purposes of a staff member's advance to a higher grade, the period of full work required shall be included in the deductible practice if the employer does not include, on the basis of an assessment of the employee's performance in accordance with the internal regulation (Paragraph 2 (3)), the period of work required to the lower extent. '
11. in Article 10 (12), the following words shall be inserted after the words "in vocational training": "and to a teaching staff member performing the work of a class teacher,"
12. Paragraph 14 (6), including footnote 7, reads as follows:
"(6) The employer who is a health care institution and provides health care covered by health insurance (7) may, with the prior agreement of the founder, negotiate in a collective agreement a method of determining the wage rate for employees in the fourth to twelfth grade within the range of the salary rates set for the lowest to highest grade in the relevant grade.
7) Article 13 (1) of Act No. 48 / 1997 Coll., on Public Health Insurance and on the amendment and addition of certain related laws. "
13. Paragraph 18 is deleted.

Čl. II
A further salary (Paragraph 12) will be paid in 1998 only half the amount to which employees would otherwise be entitled.
Čl. III
This Regulation shall enter into force on 1 January 1998.
