THE LAW
of 18 December 2014
amending Act No. 526 / 1990 Coll., on Prices, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 526 / 1990 Coll., on Prices, as amended by Act No. 135 / 1994 Coll., Act No. 151 / 1997 Coll., Act No. 29 / 2000 Coll., Act No. 141 / 2001 Coll., Act No. 276 / 2002 Coll., Act No. 124 / 2003 Coll., Act No. 354 / 2003 Coll., Act No. 484 / 2004 Coll., Act No. 217 / 2005 Coll., Act No. 377 / 2005 Coll., Act No. 230 / 2006 Coll., Act No. 261 / 2007 Coll., Act No. 183 / 2008 Coll., Act No. 403 / 2009 Coll., Act No. 457 / 2011 Coll., Act No. 18 / 2012 Coll. and Act No. 303 / 2013 Coll., is amended as follows:
1. In the first sentence of Paragraph 10 (2), the words "Ministry of Finance in the Price Bulletin," shall be deleted.
2. In the second sentence of Article 10 (2), the words "their issue 'are replaced by the words" the communication on their issue'.
3. In Article 10 (2), the last sentence shall be replaced by the sentence "The price decision shall take effect on the day of its publication in the relevant Journal and on the date set out in the price decision, but first on the date of its publication."
4. The following Section 10a is inserted after Section 10:
Price schedule
(1) The Ministry of Finance publishes price decisions pursuant to Article 10 (1) in the Price Bulletin; a communication on their extradition is published in the Collection of Laws pursuant to a special legislation (8a). The price list shall be kept in both electronic and paper form, both of which have the same legal effects.
(2) The price decision shall take effect on the day of its publication in the Price Bulletin and shall take effect on the date set out in the Price Decision, but first on the day of its publication. The publication shall be understood as the date of disclosure of the Price Bulletin, which shall appear in its header on the public administration portal.
(3) The Ministry of Finance will allow free consultation of pricing decisions at the Ministry of Finance.
(4) The Ministry of Finance shall keep one copy of the price decision in paper form in order to assess the conformity between the paper and the electronic form for a period of 10 years from the date of its publication. ';
5. In Article 11 (1) (c), the words "the person buying goods for purposes other than business' are deleted and the following footnote 10 is inserted after the word" consumer ':
"10) Act No. 634 / 1992 Coll., on Consumer Protection, as amended. '
6. In Paragraph 14, the following sentence is added at the end of paragraph 1: "The authorisation of a person to carry out a price check may take the form of a licence. The document shall be issued by the price control body within whose jurisdiction the price control falls in respect of the monitoring of the performance of obligations the infringement of which is referred to in Article 15 (1) (g) to (j) or (l) or Article 16 (1) (g), (h) or (i) or (3) (a) or (c). The licence shall indicate the name, surname, authority that issued the licence, the function of the person to whom the inspection authority has delegated the inspection, the scope of the authorisation to check and the definition of the validity of the licence. The card shall bear an official stamp and be signed by the person who issued the licence, giving its name and surname. ';
Efficacy
This Act shall take effect on the 15th day following its publication.
