amending Decree No 237 / 2002 Coll., on details of the method of re-collection of certain products, as amended by Decree No 505 / 2004 Coll., and Decree No 383 / 2001 Coll., on details of waste management, as amended
The Ministry of the Environment provides pursuant to § 13 (4), § 14 (5), § 16 (5), § 18 (4), § 21 (5), § 22 (2), § 29 (3), § 31 (7), § 34 (4), § 37 (4), § 38 (10), § 39 (11), § 40 (5), § 41 (4) and § 51 (5) of Act No. 185 / 2001 Coll., on Waste and on the amendment of certain other laws, as amended by Act No. 477 / 2001 Coll., Act No. 76 / 2002 Coll., Act No. 275 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 356 / 2003 Coll., Act No. 167 / 2004 Coll., Act No. 188 / 2004 Coll.
Amendment of Decree No 237 / 2002 Coll., on the details of the method of re-collection of certain products, as amended by Decree No 505 / 2004 Coll.
In Section 1 of Decree No 237 / 2002 Coll., on the details of the method of re-collection of certain products, as amended by Decree No 505 / 2004 Coll., paragraph 1 reads as follows:
"(1) This Decree applies to all the products referred to in § 38 (1) (a) to (e) of the Act. Only the provisions of paragraphs 3 and 3 shall apply to electrical equipment originating in households [Paragraph 38 (1) (f) of the Act]. '
Amendment of Decree No. 383 / 2001 Coll., on Details of Waste Management, as amended by Decree No. 41 / 2005 Coll. and Decree No. 294 / 2005 Coll.
Decree No. 383 / 2001 Coll., on Details of Waste Management, as amended by Decree No. 41 / 2005 Coll. and Decree No. 294 / 2005 Coll., is amended as follows:
1. In Article 21, paragraph 3 is added, including footnote 11a:
"(3) Operators of an electrical waste collection, treatment, recovery and disposal facility which keeps a continuous waste register under a specific legislation shall not keep a waste register under this Decree.
11a) Decree No 352 / 2005 Coll., on the details of the management and financing of electrical equipment and electrical waste (Ordinance on the management of electrical equipment and electrical waste). '.
2. in Paragraph 22, the following paragraph 2 is inserted after paragraph 1:
"(2) Operators of an electrical waste collection, treatment, recovery and disposal facility subject to the reporting obligation under Paragraph 39 (2) of the Act shall send annual production and waste management reports for the previous year in accordance with special legislation11a. ';
Paragraphs 2 to 4 shall become paragraphs 3 to 5.
The report on the treatment, recovery and disposal of electroowaste shall be sent using the form set out in Annex 8 to the Specific Legislation 11a) to the competent municipal authority of the municipality with extended scope for the first time in 2006.
EFFECTIVE
This decree shall take effect on the day of its publication.
