GOVERNMENT REGULATION
of 17 December 1997
amending and supplementing Regulation No 253 / 1992 of the Government of the Czech Republic Coll., on the pay ratios of employees of public administrations, certain other institutions and municipalities, as amended
The Government orders pursuant to § 23 (b) and (c) of Act No. 143 / 1992 Coll., on the salary and remuneration of on-call time in the budget and in certain other organisations and bodies, as amended by Act No. 40 / 1994 Coll.:
Decree of the Government of the Czech Republic No. 253 / 1992 Coll., on the pay ratios of employees of public authorities, certain other bodies and municipalities, as amended by Government Decree No. 78 / 1994 Coll., Government Decree No. 142 / 1995 Coll., Government Decree No. 71 / 1996 Coll. and Government Decree No. 326 / 1996 Coll., are amended and supplemented as follows:
1. In Paragraph 1 (2), point (f) is replaced by "a 'and point (g) is deleted.
Point (h) shall be renumbered as point (g).
2. the following words shall be added at the end of Paragraph 1 (3) (a): "except for civil servants included in the Fire Department of the Czech Republic and in the educational and technical facilities of the Department of Interior Fire Protection,"
3. In Article 1 (3) (d), the words "employees of the Ministry of the Interior who work in the security section, a 'are deleted.
4. the following point (c) shall be added to Article 3 (2), including footnote 5:
"(c) the rules governing the inclusion in the grade of staff members who do not meet the requirements for the proper performance of their duties
1. requirements (4) established by the employer under (b);
2. the qualification requirements laid down in a specific regulation, (5) unless otherwise specified in this specific regulation.
5) E.g. § 53 of Act No. 20 / 1966 Coll., on the care of the health of the people, as amended by Act No. 548 / 1991 Coll., Decree No. 88 / 1996 Coll., implementing the Act on Municipal Police. '
5. In the second sentence of Paragraph 4 (2), the words "degree, focus or field of education 'are replaced by" degree of education'.
6. In Paragraph 4 (3), the words "degree, focus or field of education 'are replaced by" degree of education'.
7. Article 4 (3) (d) reads as follows:
"(d) it shall be classified in the seventh grade at most, provided that, for the proper performance of the required work, the employer fulfils the conditions laid down in a special regulation or the requirement of professional learning laid down in Article 3 (2) (a)."
8. in Article 5 (1) (b) and (c), the words "when a staff member is first assigned to the relevant grade" shall be deleted;

"(4) For the purposes of a staff member's advance to a higher grade, the period of full work required shall be included in the deductible practice if the employer does not include, on the basis of an assessment of the employee's performance in accordance with the internal regulation (Paragraph 2 (3)), the period of work required to the lower extent. '
(10) Paragraph 11 (4), (5), (6) and (7) shall be added, including footnote 8e:
"(4) An officer who does not meet the qualification requirement of full secondary education may be included by the employer in the fifth grade for a period of more than two years, provided that he fulfils the technical requirements laid down in the special regulation. (e)
(5) The officer referred to in paragraph 4 shall be credited by the employer to the period of commensurate practice for the full duration of the officer's work and shall deduct the period of two years if he has achieved secondary education or four years if he has achieved only basic education.
(6) The athlete, with the exception of the coach, may be included by the employer in a grade for which he does not meet the qualification requirement (§ 3) for a period of more than two years.
(7) Athletes, with the exception of a coach who is in the fourth and upper grades, may determine the salary tariff by analogy in accordance with paragraph 1.

11. Paragraph 15 is deleted.
12. In Annex No 1 Catalogue of works part 6. The following example No 7.06 is added:
"7.06. Training for swimming in compulsory primary school physical education according to established teaching plans and the conduct of physical training courses. '
1. A further salary (Paragraph 10a) shall be granted in 1998 only half the amount to which the staff member would otherwise have been entitled.
2. Civil servants included in the Directorate of the Fire Rescue Department of the Czech Republic and in the educational and technical equipment of the Department of Interior fire protection are not reconsidered due to the application of this regulation. Where an employee has exceptionally been included in the grade in accordance with Article 4 (2) (b) of Government Decree No 79 / 1994 Coll., on the pay ratios of armed forces, security forces and services, customs authorities, members of the Fire Protection Corps and of certain other organisations (Staff Regulations), as amended by Government Decree No. 143 / 1995 Coll., the duration of this exceptional classification under the Staff Regulations shall be assessed.
This Regulation shall enter into force on 1 January 1998.
