THE LAW
of 18 September 2001
on the use of national symbols of the Czech Republic and on the amendment of certain laws
Parliament has decided on this law of the Czech Republic:
USE OF STATE SYMBOLS BY THE CZECH REPUBLIC
Preliminary provisions
(1) The Act provides for the use of national symbols of the Czech Republic, 1):
(a) a large national character and a small national character (hereinafter referred to as the "national character");
(b) State flags;
(c) the flag of the President of the Republic;
(d) State seals; and
(e) national anthem.
(2) State symbols may be used only in an appropriate and dignified manner.
(3) Seals and seals with a national emblem may be used only under the conditions laid down by this law.
Signature
(1) The national character is entitled to use:
a) Chamber of Deputies and Senate, Member and Senator, Chamber of Deputies and Senate Office,
(b) the President of the Republic and the President's Office;
(c) Government and Government Office of the Czech Republic,
(d) the Ombudsman and the Ombudsman's Office,
(e) ministries and other administrative offices,
(f) counties, municipalities, urban districts or urban areas of territorial subdivided statutory cities and the urban part of the capital of Prague;
(g) the Constitutional Court,
(h) courts and prosecutors,
(i) armed forces and security forces;
(j) diplomatic missions and consular offices of the Czech Republic,
k) Security Information Service and Office for Foreign Relations and Information,
(l) the Office for the Protection of Personal Data,
(m) the Supreme Audit Office;
n) Council of the Czech Republic for Broadcasting,
(o) Czech National Bank,
(p) State funds;
(r) higher education2), schools and schools registered in the school register under a special law, 3)
(s) national cultural and scientific institutions;
(t) legal and natural persons entrusted by law or by law with the exercise of public administration, 4)
u) athletes in representation of the Czech Republic,
(v) units of the voluntary municipal fire department, units of the fire brigade of undertakings, units of the voluntary fire brigade of undertakings and associations operating in the fire protection sector;
(w) medical emergency services,
(hereinafter referred to as authorised persons).
(2) The national character may be used for the authorised persons referred to in paragraph 1 (a) to (t) in the context of the exercise of the powers of the authorised person, authorised under the internal rules of the authorised person or authorised by the head of the authorised person.
(1) Large national character
(a) is part of the mayor's hanging badge;
(b) be part of the external marking of the service uniforms of the staff and of the members of the authorised persons referred to in Article 2 (1) (e) and of the members of the authorised persons referred to in Article 2 (1) (i) and (k), to the extent and in the manner laid down by specific legislation;
(c) is used to indicate the national borders of the Czech Republic;
(d) it shall appear on the documents issued by the administrative authorities of the Czech Republic, where specific legislation so provides;
e) appears on banknotes, securities and other prices of the Czech Republic,
(f) it shall appear in the collections of the decisions of the Constitutional Court, the Supreme Court and the Supreme Administrative Court given by those courts under special legislation;
g) is used for external marking of athletes' jersey representing the Czech Republic.
(2) A major national character may also be:
a) depict the academic insignia, the primary insignia and the insignia of honours;
(b) use on the relevant documents of the authorised persons referred to in Article 2 (1) (a) to (e) and (g) to (m);
(c) to place on the front of the room where the authorities of the authorised persons referred to in § 2 (1) (a) to (s) meet and act;
d) depict the armed forces of the Czech Republic on their honorary badges and fighting battalions,
e) to be displayed on the honor badges and security corps' banners,
(f) use in the context of the exercise of the powers of authorised persons referred to in Article 2 (1) (a) to (t);
(g) use for the external identification of the uniforms of the members of the units of the voluntary fire-fighting units of the municipalities, of the fire-fighting units of the undertakings, of the units of the voluntary fire-fighting units of the undertakings and of the associations operating in the fire protection sector.
(1) The buildings in which the authorised persons referred to in § 2 (1) (a) to (s) are located may be identified by a large State emblem. If there are more than one authorised person in the building, the building shall be marked with only one major national character.
(2) A large State emblem is placed in the middle above the front of the building, above the main entrance to the building or on the side of the main entrance to the building. Should such a location be technically impracticable, the State emblem may be placed in another suitable location on the building.
(3) If the building ceases to serve as the registered office of authorised persons referred to in § 2 (1) (a) to (s), the large State emblem by which it is marked shall be removed from the building without delay unless it is part of its architectural decoration.
In cases where the law imposes or permits the use of a large national character, the authorised person may also use his unique colour imitation of metal, stone, glass, ceramics or other material, which corresponds with the image of a large national character.
A small State emblem is used by the authorised persons referred to in § 2 (1) (a) to (t) on decisions and other instruments certifying the essential facts, issued in the exercise of State authority, which have been conferred on them by law or by law (5a); may also be displayed on coins of the Czech Republic.
(1) the official stamp shall be a stamp producing a circular imprint of 20 mm, 25 mm or 36 mm in diameter, marked with a small national character; a small national emblem is displayed within a circle whose circumference includes the designation of the authorised person and, where appropriate, the designation of its organisational component and seat. Where the beneficiary uses more than one official stamp, the latter must also include serial numbers. The stamp shall be printed in one colour.
(2) The official stamp must not contain a large national character.
(1) The seal of the Ministry of Foreign Affairs is a seal which produces a circular imprint of 36 mm in diameter, marked with a small national emblem; a small national emblem shall be displayed within a circle around which the identification of the authorised person referred to in paragraph 2 and, where appropriate, the designation of its organisational component and seat. In the case of representative offices (6), the name of the representative office may also be considered as an authorised person. If the beneficiary uses more seals of the Ministry of Foreign Affairs, these seals must also include serial numbers.
(2) Only the Ministry of Foreign Affairs, including representative offices, may use the seal.
(3) The seal of the Ministry of Foreign Affairs can be used
(a) to confirm the inviolability of a copy of an international contract;
(b) to seal the diplomatic post,
(c) in other cases where this is normal.
State flag
(1) The State flag shall be issued by the authorised persons referred to in § 2 (1) (a) to (s) on the buildings in which they are based, on the occasion of the public holidays (5b) and on occasions of national importance, in particular on the day of mourning or on the day of state mourning, declared by the Government.
(2) Flags shall, as a general rule, begin at 16 hours of the day preceding and end at 8 hours of the day following the date referred to in paragraph 1.
(3) On the occasion of the occasion referred to in paragraph 1, a imitation of the flag may be used instead of the flag of the State with a different ratio of width and length.
(4) On buildings in which the authorised persons referred to in § 2 (1) (a) to (o) are located, the flag of the State may be permanently displayed.
(5) State flag may be displayed by the heads of diplomatic missions and consular offices of the Czech Republic on service vehicles on festive occasions and if this is usual in their country of operation.
(6) Other natural and legal persons and State bodies may use the national flag in an appropriate and dignified manner at any time.
(1) The flag shall always be placed in the most honorable place if the flag of the State is simultaneously issued by the State flags of other States; This is from the front view of the object
(a) to the left when two national flags are displayed;
(b) in the middle when the odd number of State flags is displayed,
(c) in the middle pair on the left when the even number of national flags is displayed,
(d) first from left, or last from row, when the number of flags is higher than 5.
(2) Similarly, the rules laid down in paragraph 1 shall apply when a State flag is issued with other flags.
The following rules shall be complied with when using the flag:
(a) at horizontal position, the blue wedge faces to the right at the front of the object on which the flag is located; white is always on top,
b) at vertical position, when facing the object on which the flag is located, the white colour is always left and the blue wedge is always pointing down,
(c) the national flag shall be displayed only on the front of the building;
(d) the national flag shall always be placed in the Bureau of the Assembly; the national flag shall be placed on the left of the speaker's counter at the front of the counter;
(e) the State flag shall not be used to cover the monument or the plate to be revealed;
(f) the flagpole shall not bear any ornaments and shall not bear any flag other than the flag of the State;
(g) the flag of the State shall be raised and taken without interruption; the flag of the State shall not touch the ground when erecting or shooting;
(h) when using a national flag as a sign of sadness, the national flag shall be launched at half-mast;
(i) in the event of funeral rites, the flag of the State shall not be launched together with the coffin to the grave or to the heat pit;
(j) there shall be no text, depiction, image, sign or badge, bouquet, funeral veil and shall not be bound into a rose;
(k) the flag shall not be used in damaged or contaminated condition.
Flag of the President of the Republic
(1) The flag of the President of the Republic may be used to designate:
(a) the seat of the President of the Republic at the time of his presence in the Czech Republic;
(b) means of transport used by the President of the Republic.
(2) The flag of the President of the Republic may also be used in the context of the exercise of his duties.
State Seal
The State Seal can be used
(a) to seal international treaties and full powers, instruments of ratification or other instruments issued in connection with the negotiation or termination of international agreements;
(b) the credentials of diplomatic representatives;
(c) in other cases, where special legislation so provides, an international treaty which the Czech Republic is bound by and which has been declared, or where normal.
National anthem
The national anthem can be played and sung on public holidays and other occasions, if it is usual.
Transfers of natural, legal and business natural persons
(1) A natural, legal or business natural person commits an offence by:
a) misused, grossly defiled, destroyed, damaged or alien national symbol of the Czech Republic or imitation of a large national character as defined in § 4a;
(b) use a small national character contrary to § 5;
(c) use a large national character contrary to § 6 (2);
d) use the seal of the Ministry of Foreign Affairs in breach of § 6a (2),
(e) uses a representation interchangeable with a State emblem in a way which may give the impression that it is an authorised person, although it is not;
(f) not raise a national flag pursuant to Article 7 (1); or
(g) post a State flag contrary to § 8 or 9.
(2) A fine of up to 30 000 CZK may be imposed for the offence referred to in paragraph 1 (a) to (e) and for the offence referred to in paragraph 1 (f) or (g) for the fine up to 10 000 CZK.
Amendment of Act No. 68 / 1993 Coll., amending and supplementing certain laws on the section of general internal administration, as amended
In Act No. 68 / 1993 Coll., amending and supplementing certain laws on the section of general internal administration, as amended by Act No. 132 / 2000 Coll. and Act No. 301 / 2000 Coll., Article V is deleted.
Change of notarial order
In Section 115 of Act No. 358 / 1992 Coll., on notaries and their activities (notarial order), paragraph 2 is deleted and paragraph 1 is renumbered.
Amendment of the Act on the Armed Forces of the Czech Republic
In Article 5 of Act No. 219 / 1999 Coll., on the armed forces of the Czech Republic, paragraph (d) reads:
"(d) Grants combat battalions."
REPEAL PROVISIONS
Act No. 68 / 1990 Coll., on the Use of the State Sign, State Flag and Other State Symbols of the Czech Republic, as amended by Act No. 114 / 1992 Coll. and Act No. 120 / 2001 Coll.
EFFECTIVE
This Act shall take effect on the day of its publication.
