establishing binding emission ceilings for certain air pollutants and the way in which emission inventories and emission projections are prepared and carried out
The Government mandates pursuant to § 55 (1) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act) ("the Act '):
§ 1
Subject matter
(1) This Regulation lays down, in accordance with the law of the European Community1):
(a) the values of emission ceilings pursuant to Article 6 (9) of the Act on Sulphur Oxide, Nitrogen Oxides, Volatile Organic Substances and Ammonia for the territory of the Czech Republic for 2010 ("national emission ceilings") and for the territory of regions ("regional emission ceilings") for 2010;
(b) indicative target values for the limitation of acidification and ground-level ozone load;
(c) the formalities for carrying out emission inventories and emission projections.
(2) This Regulation shall not apply to emissions from international maritime transport and air traffic, except for the launching and landing of aircraft.
§ 2
Basic concepts
For the purposes of this Regulation:
(a) critical load - a quantitative estimate of exposure to one or more pollutants below which significant negative impacts on sensitive environmental compartments can be excluded on the basis of the current level of knowledge;
(b) the territorial unit of the network - square of the territory of 150 km x 150 km, which is used for mapping critical loads on a European scale, as well as for monitoring the emissions and deposits of air pollutants carried out under the International Convention to which the Czech Republic has acceded and the Protocols to this Convention, 2)
(c) critical levels - such a concentration of the pollutant above which, according to the current level of knowledge, a direct effect on receptors such as man, plants, ecosystems, materials,
(d) acronym AOT 40 - sum of differences between hourly concentrations of ground-level ozone greater than 80 µg / m3 (40 ppm) and 80 µg / m3 during daylight hours, accumulated from May to July each year;
(e) acronym AOT 60 - sum of differences between hourly concentrations of ground-level ozone greater than 120 µg / m3 (60 ppm) and 120 µg / m3 accumulated throughout the year,
(f) landing and starting of aircraft - operating cycle given the following times: landing 4 minutes, taxiing 26 minutes, starting 0,7 minutes and take-off 2,2 minutes,
(g) national emission ceiling - the maximum amount of the pollutant or a specified group of pollutants expressed in kilotons which may be emitted in the Czech Republic during a given calendar year,
(h) regional emission ceiling - recommended maximum amount of the pollutant or specified group of pollutants expressed in kilotons which may be emitted in the territory of the region within one calendar year;
(i) nitrogen oxides (NOx) - nitric oxide and nitrogen dioxide, expressed as nitrogen dioxide,
(j) ground-floor ozone - ozone in the lowest layer of troposphere,
(k) the indicative target value - the value indicating the percentage or proportion of the reduction in the area at which the critical burden or critical level was exceeded in 1990 as the resulting effect of the application of emission ceilings under this Regulation;
(l) emission inventory - the procedure for determining the total annual emissions of the pollutant or a specified group of pollutants in the demarcated territory, from a defined group of sources, where appropriate according to another definition. It includes ensuring the necessary data, the way in which they are verified and processed, the determination of the results and making them available to the public,
(m) emission projections - the procedure to determine the expected total annual emissions of pollutants or their specified groups in the future. It is used for the processing of forecasts for the development of air quality in the Czech Republic, regions and areas with impaired air quality,
(n) acidification - acidification process for constituents and other environmental objects caused by emissions of air pollutants.
§ 3
Achieving and binding emission ceilings
(1) The value of the emission ceilings referred to in Annex 1 to this Regulation should be reached in the Czech Republic by 2010 at the latest. In subsequent years these values must be further reduced so that critical loads are not exceeded in 2020.
(2) The values of the emission ceilings are binding on the Czech Republic and the source operators under Section 11 (1) (b) of the Act.
(3) The indicative recommended emission ceilings for each region are set out in Annex 2 to this Regulation.
§ 4
Indicative target values
The emission ceilings set out in Annex 1 to this Regulation shall contribute to the achievement of the indicative targets set out in Annex 3 to this Regulation by 31 December 2010.
§ 5
Emission inventories and emission projections
(1) Emission inventories shall be provided annually for pollutants for which emission ceilings, the Ministry of the Environment or the legal person established by it are set out in Annex 1 to this Regulation. Together with the emission inventories, it will also develop emission projections of these substances for the period up to 2020 (Section 6 (9) of the Act). At the same time, it shall carry out an evaluation of the achievement of the target targets.
(2) The implementation of emission inventories and the processing of their results shall be carried out in accordance with the methodology approved under the Convention on Long-Range Transboundary Air Pollution. (2)
(3) Emission inventories are carried out for stationary and mobile sources of air pollution, all sources or groups of resources defined by the territorial organisation or technical specification. Emissions from aircraft operations shall only be included in the operating cycle defined in Section 2 (f). The inventory documents are carried out using the data of the Air Pollution Register and sources (Section 13 (1) of the Act).
(4) Emission inventories are carried out for particularly large, large and medium-sized resources from aggregated traffic records (Section 13 (4) and (5) of the Act). Quantities of pollutant emissions shall be determined by source operators in the manner specified in Section 9 (10) of the Act and in the implementing legislation.3)
(5) An emission inventory of small sources of air pollution using solvents is carried out using data from the records of these sources.
(6) The results of emission inventories and projections are made available to the public.4)
§ 6
National emission reduction programmes
(1) The national emission reduction programmes for each pollutant by 2010 for which emission ceilings and, where appropriate, the integrated national emission reduction programme are set out in Annex 1 to this Regulation are prepared according to the outline in Annex 2 to the Act.
(2) The national programmes referred to in paragraph 1, drawn up in accordance with Paragraph 6 (2) of the Act, in addition to the objective of achieving the emission ceilings set out in Annex 1 to this Regulation, also serve to achieve the targets set out in Section 4.
(3) Each central administration and its respective contribution or budgetary organisation shall cooperate in the processing of emission inventories and emission projections by providing data and information pursuant to Article 5 (2) to (5).
(4) The Ministry of the Environment, in cooperation with the other central administrations and institutions referred to in paragraph 3, shall submit to the Government, by 1 May 2004, a summary information on the National Programmes referred to in paragraphs 1 and 2, by 31 October 2006, a summary information on the updated National Programmes referred to in paragraph 2, starting on 31 October each year, a report on the emission inventories for the previous year and the emission projections referred to in paragraph 5 and by 31 December 2007, a report on the state of compliance with the emission ceilings referred to in Annex 1 to this Regulation.
§ 7
Efficacy
This Regulation shall enter into force on the day of its publication.

Indicative target values
The indicative target value for acidification shall be determined as a reduction in the area where the critical burden for acidification is exceeded by at least 50% in relation to 1990 (for each territorial unit of the network).
The indicative target for human health shall be set as a reduction in the area where ozone burden exceeds the critical level for human health (AOT60 = 0), in all territorial units of the network by two thirds in relation to 1990. The ground-level ozone load in any territorial unit of the network shall not exceed the absolute limit of 2,9 ppm h.
The indicative target value for crop and vegetation shall be determined as a reduction in the area where the ozone burden exceeds the critical level for crop and vegetation (AOT40 = 3 ppm.h), in all territorial units of the network by one third in relation to 1990. The ground-level ozone load in any territorial unit of the network shall not exceed the absolute limit of 10 ppm.h expressed as a critical level of 3 ppm.h.
