Government regulation fixing the rate of a one-off fee for the storage of radioactive waste and the amount of contributions from the nuclear account to municipalities and their provision

fixing the rates of charges applicable to the storage of radioactive waste and the amount of contributions from the nuclear account to municipalities and their provision
The Government mandates pursuant to § 117 (4) and § 131 (2) of Act No. 263 / 2016 Coll., Atomic Act:
§ 1
One-off fee rate
(1) The rate of the one-off fee is:
(a) CZK 145 000 for radioactive waste in the form of a standard storage unit meeting the limits and conditions for the management of radioactive waste approved by the State Office for Nuclear Safety; or
(b) CZK 174 000 for radioactive waste other than that referred to in (a).
(2) The rate of the one-off fee referred to in paragraph 1 shall be increased by 2% from 1 January 2018 to the year immediately preceding, but not exceeding CZK 250 000, if the rate referred to in paragraph 1 (a) or 300 000, if the rate referred to in paragraph 1 (b) is higher; the rate is rounded up to the whole crown.
§ 1a
Regular fee rate
The rate of the regular fee for the storage of radioactive waste for the period 1 January 2026 to 31 December 2030 shall be:
a) CZK 88 for the quantity of electricity produced in MWh measured at generator terminals by the taxpayer operating an energy nuclear device,
b) CZK 35 for the quantity of heat produced in MWh by a taxpayer operating a research nuclear installation or a nuclear installation whose main purpose is the production of heat energy.
§ 2
Amount of contributions from the nuclear account and the rules governing their provision
(1) The amount of the contribution from the nuclear account to the municipality in whose cadastral territory the exploration area is determined for special intervention into the earth's crust for the storage of radioactive waste in underground areas (hereinafter referred to as the "exploration area") is CZK 850 000 per year and CZK 0.60 per year for each m2 of the cadastral territory of the municipality in which the survey area is established. This contribution shall be transferred to the municipality for the first time within 3 months of the date of the acquisition of legal power by the Administration of Radioactive Waste Reserves and thereafter in the first half of the calendar year.
(2) The amount of the contribution from the nuclear account to the municipality in whose cadastral territory a protected area is established for special intervention into the Earth's crust for the storage of radioactive waste in underground areas (hereinafter referred to as "protected territory") is CZK 850 000 per year and CZK 0,90 per year for each m2 of the cadastral territory of the municipality in which the protected area is established. This contribution shall be transferred by the Administration to the municipality for the first time within 3 months of the date on which the decision on the establishment of the protected area was taken and thereafter in the first half of the calendar year.
(3) The amount of the contribution from the nuclear account for the municipality in whose cadastral territory the operation of the radioactive waste storage site is permitted is CZK 5 750 000 per year. This contribution shall be transferred by the Administration to the municipality in the first half of the calendar year concerned. In addition, this municipality receives a contribution of CZK 14,000 for each m3 of radioactive waste stored in a given calendar year. This contribution shall be transferred by the Administration to the municipality in the first half of the following calendar year.
(4) A single contribution from a nuclear account of CZK 60 000 000 will be transferred by the Administration to the Municipality in whose cadastral territory a protected area is established within 1 year of the date on which the decision on the determination of the protected area is taken.
(5) The area of the exploratory territory or protected territory which is the basis for calculating the amount of the contribution referred to in paragraph 1 or 2 shall be calculated according to the definition of that exploratory territory or protected territory in the decision establishing that territory.
(6) The contribution referred to in paragraph 1 or 2 shall belong to the municipality in whose cadastral territory the exploratory territory or protected territory is established only for the duration of the relevant decision to establish the exploratory territory or protected territory.
§ 3
Transitional provision
The administration shall transfer a one-off contribution from a nuclear account of CZK 50 000 000 within 1 year from the date of entry into force of this Regulation to a municipality whose cadastral territory is designated on the date of entry into force of this Regulation.
§ 4
Efficacy
This Regulation shall enter into force on the day of its publication.
