DECLARATION
of 28 February 2014
amending Decree No 383 / 2001 Coll., on details of waste management, as amended
According to § 39 (11) and § 44 (9) of Act No. 185 / 2001 Coll., on waste and amending certain other laws, as amended:
Decree No. 383 / 2001 Coll., on Details of Waste Management, as amended by Decree No. 41 / 2005 Coll., Decree No. 294 / 2005 Coll., Decree No. 353 / 2005 Coll., Decree No. 351 / 2008 Coll., Decree No. 478 / 2008 Coll., Decree No. 61 / 2010 Coll. and Decree No. 170 / 2010 Coll., is amended as follows:
1. in § 1 (1) (f) and § 2 (e), "§ 15 (6)" shall be replaced by "§ 15 (5)";
2. Article 17 shall be deleted, including the title.
3. In Paragraph 21 (2), the last sentence is replaced by the sentence "Where waste is continuously generated, and in the case of the periodic collection of municipal waste, continuous records are kept at monthly intervals."
4. Paragraph 28, including the title, reads:
Waste management plan of the municipality
The waste management plan of the municipality shall include:
(a) the name of the municipality;
(b) an overview of the types and categories of waste produced, the ways in which they are disposed of and the way in which they are recovered or disposed of, an evaluation of the existing management of waste with the requirements laid down in the law and implementing legislation;
(c) an assessment of the compliance of the municipal waste management with the mandatory part of the waste management plan of the region or regions concerned;
(d) an overview of the objectives and measures to be taken to achieve them, including the dates to be implemented by the municipality to prevent, reduce their quantities and their hazardous properties and to comply with the mandatory part of the waste management plan of the region;
(e) the organisational arrangements for managing the municipal waste management, including a list of internal documents; and
(f) the name and contact details of the waste manager, if the municipality is obliged to establish the waste manager under Article 15 of the Act.

Receipt of waste to the installation and transmission of information on the characteristics of the waste to be taken over
1. The operator of the installation shall ensure the following activities at the time of taking over the waste:
(a) visual inspection of each supply of waste;
(b) spot checks of waste to verify compliance of waste with information provided by the supplier of waste;
(c) recording the code of the type of waste, category, weight of waste, delivery dates, identity of the supplier of waste and, in the case of municipal waste, the identity of the company which collects or collects it, when supplying hazardous waste, as well as data on hazardous properties;
(d) recording the data on the characteristics of the waste necessary to determine whether it is possible to dispose of the waste in the relevant facility, including the test reports and the relevant sampling protocols, where this results from the agreement to operate the installation or its operating rules;
(e) the issue of a written certificate of each shipment of waste to an establishment.
2. The waste supplier shall provide the person authorised to operate the relevant waste facility with the following written information in the case of a single or first of a series of deliveries:
(a) the name, address of the registered office and, if assigned, the ID of the supplier of waste;
(b) the waste code, the category and when the hazardous waste is supplied, also the information on its hazardous properties;
(c) further information on the characteristics of the waste necessary to determine whether it is possible to dispose of the waste in the relevant waste facility, including test reports and the relevant sampling protocols, where this results from an agreement to operate the installation or its operating rules. ";
Efficacy
This Decree shall take effect on 1 April 2014.
