DECLARATION
of 23 January 2012
amending Decree No 54 / 2004 Coll., on foodstuffs intended for particular nutritional uses and their method of use, as amended
According to Article 19 (1) (a) and (i) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, as amended by Act No. 306 / 2000 Coll., Act No. 146 / 2002 Coll., Act No. 316 / 2004 Coll. and Act No. 120 / 2008 Coll.:

Decree No. 54 / 2004 Coll., on foodstuffs intended for particular nutritional uses and their method of use, as amended by Decree No. 402 / 2006 Coll., Decree No. 473 / 2006 Coll. and Decree No. 157 / 2008 Coll., are amended as follows:
1. Paragraph 1 (1), including footnotes 1 and 1a, reads as follows:
"(1) This decree implements the relevant provisions of the European Union1) and regulates the types of food for particular nutritional uses, the health requirements of foods intended for particular nutritional uses, their composition, labelling and conditions and their use.
1) Council Directive 92 / 52 / EEC of 18 June 1992 on infant formulae and follow-on formulae intended for export to third countries. Commission Directive 96 / 8 / EC of 26 February 1996 on foodstuffs for low energy nutrition for weight reduction. Commission Directive 1999 / 21 / EC of 25 March 1999 on dietary foods for special medical purposes. Directive 2000 / 13 / EC of the European Parliament and of the Council of 20 March 2000 on the approximation of the laws of the Member States relating to the labelling, presentation and advertising of foodstuffs. Commission Directive 2006 / 125 / EC of 5 December 2006 on cereal-based foods and baby foods for infants and young children. Commission Directive 2006 / 141 / EC of 22 December 2006 on infant formulae and follow-on formulae and amending Directive 1999 / 21 / EC. Commission Directive 2007 / 29 / EC of 30 May 2007 amending Directive 96 / 8 / EC as regards the labelling, advertising and presentation of foodstuffs for low energy nutrition for weight reduction. Directive 2009 / 39 / EC of the European Parliament and of the Council of 6 May 2009 on foodstuffs intended for particular nutritional uses.
(1a) Regulation (EC) No 1924 / 2006 of the European Parliament and of the Council of 20 December 2006 on nutrition and health claims made on foods. Regulation (EC) No 1925 / 2006 of the European Parliament and of the Council of 20 December 2006 on the addition of vitamins and minerals and of certain other substances to food. Commission Regulation (EC) No 1609 / 2006 of 27 October 2006 authorising the placing on the market of infant formulae based on whey protein hydrolysates derived from cows' milk proteins for a period of two years. Commission Regulation (EC) No 2073 / 2005 of 15 November 2005 on microbiological criteria for foodstuffs. Commission Regulation (EC) No 1441 / 2007 of 5 December 2007 amending Regulation (EC) No 2073 / 2005 on microbiological criteria for foodstuffs. Commission Regulation (EC) No 41 / 2009 of 20 January 2009 on the composition and labelling of foodstuffs suitable for people intolerant to gluten. Commission Regulation (EC) No 953 / 2009 of 13 October 2009 on substances which may be added to foods for particular nutritional purposes. '
2. in § 1 (4), first sentence, § 5 (6) (b), § 6 (5), § 8 (3) (b) and § 9 (2) (c), "the European Communities" shall be replaced by "the European Union";
3. In Paragraph 1 (4), the words "Annex No 13 'are replaced by the words" a directly applicable European Union Regulation on substances that may be added to foods for particular nutritional uses (7)'.

„§ 2
For the purposes of this decree, the following categories of food for particular nutritional uses shall be distinguished:
(a) foods for infant formulae and follow-on formulae and young children;
(b) foodstuffs for cereal and other nutritional uses other than those intended for infant and young children;
(c) food for low energy nutrition intended to reduce body weight;
(d) food for special medical purposes,
(e) foods without phenylalanine,
(f) low-lactose or lactose-free foodstuffs;
(g) food intended for athletes and persons with increased physical performance. "
5. footnote 3a is deleted.
6. in Articles 11 (3), 14 (3) and 29, the words "Annex No 13" shall be replaced by the words "directly applicable European Union legislation on substances that may be added to foods for particular nutritional uses (7)."
7. Parts 7, 8 and 10 shall be deleted, including the headings.
8. Annex No 13 is deleted.
Čl. II
Efficacy
This Decree shall take effect on 1 February 2012.
