DECLARATION
of 26 January 2006
amending Decree No. 186 / 1996 of the Ministry of Industry and Trade Coll., laying down details on the dyeing and labelling of certain petroleum fuels and lubricants, as amended
The Ministry of Industry and Trade provides pursuant to Sections 2 (2) and 14 of Act No. 136 / 1994 Coll., on the coloring and marking of certain hydrocarbon fuels and lubricants and on the related measures, and on the amendment of other laws, as amended by Act No. 95 / 1996 Coll., Act No. 304 / 2000 Coll., Act No. 442 / 2003 Coll. and Act No. 291 / 2005 Coll.:
Decree No. 186 / 1996 Coll., laying down the details of the colouring and labelling of certain petroleum fuels and lubricants, as amended by Decree No. 348 / 2000 Coll., Decree No. 443 / 2003 Coll. and Decree No. 230 / 2004 Coll., is amended as follows:
1. In Article 3 (1), the first sentence is replaced by "The sample of fuel or lubricants (hereinafter referred to as" the sample ") is entitled to be taken by the competent State authority."
2. in Article 3 (2) (b):
"(b) in Czech technical standard ČSN EN ISO 3170 Liquid petroleum products - manual sampling, in other cases."
3. In Article 3 (3), "Annex 2 to this Decree 'is replaced by" Czech Technical Standard CSN EN ISO 3170 Liquid petroleum products - Manual sampling'.
4. Paragraph 5 is deleted.
5. Annex 2 shall be deleted;
6. In Annex No 4, the words "tariff heading 'are replaced by the words" nomenclature code 4)';
footnote 4:
"(4) Council Regulation (EEC) No 2658 / 87 / EC of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff, as amended."
7. In Annex 4, "ex1) 'is replaced by" ex *';
footnote 1 is deleted and the following explanatory note is added at the end of Annex 4:
"* If the designation" ex "is indicated before the nomenclature code, this means that only those fuels and lubricants which are so labelled in this Annex must be dyed and labelled. '
This decree shall take effect on the day of its publication.
