of 16 April 1970
on the election of judges from the people
The Czech National Council decided on this law:
(1) The Judges of the People of the District Courts are elected by the Regional National Committees.
(2) The judges of the people of the Regional Courts are elected by the Regional National Committees.
(3) The election of judges from the people shall be held by national committees, in whose district there is, in whole or in part, the district of the competent court.
(4) People's judges are elected on a proposal from the competent authority of the National Front.
(1) The number of judges from the people to be elected for the District Court shall be determined by the President of the District Court. If the district court district is situated in the district of several regional national committees, the President of the county court shall determine how many judges from the people are to be elected by each national committee.
(2) The number of judges from the people to be elected to the Regional Court shall be determined by the President of the Regional Court. If the district court district belongs to several regional national committees, the President of the county court shall determine how many judges from the people are to be elected by each national committee.
(3) When determining the number of judges from the people, account should be taken of the need for individual judges not to meet as a rule more than 12 days a year. If the number of judges from the people to be elected by each national committee is to be determined, account should be taken of the population of the respective district.
For candidates for the election of judges from the people, the competent authority shall propose: National fronts of citizens who meet all the requirements for election *) and live or work in the district of the court for which they are to be elected.
(1) Upon election, the judges of the people shall take the oath * *) in the hands of the chairman of the national committee which elected them.
(2) The President of this National Committee shall issue a certificate of election to the judges of the people newly elected after the composition of the promise, to the other judges of the people after the election. * * *)
On a proposal from the competent authority The national fronts may be removed from office by the judge of the people of the district or county court of the national committee which elected them if:
(a) seriously infringes its judicial duties; or
(b) his state of health does not allow him to perform his judicial duties properly.
At the request of the People of the District Court or of the County Court, a judge may be relieved of his duties by the National Committee which elected him if he is unable to perform his duties permanently for illness or for other serious reasons.
(1) The provisions of this Law on the Regional and Regional National Committees also apply to the national committees which exercise the powers of those national committees.
(2) The provisions of this Law on District and Regional Courts shall also apply to courts otherwise designated which exercise the jurisdiction of those courts.
This Act shall take effect on the day of its publication.
