Slovak National Council
of 27 February 1964
concerning the elections to the Slovak National Council
The Slovak National Council decided on this law:
Basic provisions
The working people elect their best representatives, political and professional citizens, to be members of the Slovak National Council, and able to organise and unify the creative forces of workers in their efforts to fully develop socialist society.
Elections to the Slovak National Council shall be held on the basis of the general, equal and direct voting rights by secret ballot.
(1) All citizens of the Czechoslovak Socialist Republic in Slovakia have the right to vote for the Slovak National Council, who reached 18 years on the day of the election, regardless of nationality, sex, religion, employment, residence, social origin, property conditions and past activity.
(2) However, citizens who have been legally deprived of legal capacity for mental illness or whose legal capacity has been restricted for such a failure are not entitled to vote. *)
(3) Citizens who are in jail or in custody do not vote.
Any citizen of the Czechoslovak Socialist Republic who has the right to vote may be elected to the Slovak National Council and reached 21 years on the day of the election.
Members of the armed forces and armed corps shall have the same right to vote and to be elected as other citizens.
Voting lists
Entry into the electoral list
(1) All citizens of the Czechoslovak Socialist Republic who have the right to vote are included in the electoral list according to their place of residence.
(2) Citizens who, after drawing up a list of voters, acquire or lose their voting rights shall be added to or withdraw from the list of voters.
(3) Each voter can only be written in one vote.
Establishment of the electoral list
(1) The electoral lists are drawn up by the local national committee according to the constituencies.
(2) The electoral lists of members of the armed forces and the armed corps who are housed in the group shall be drawn up by their master.
(3) If elections to the Slovak National Council are held on the same day as elections to other representative corps, the electoral lists are common.
Unloading of electoral lists
(1) No later than 30 days before the election date, the local national committee shall land electoral lists so that citizens can see them in official rooms. The local national committee shall inform citizens of the launch of the electoral lists in the usual manner.
(2) In municipalities where there are more than 5000 people on the electoral lists, the local national committee will arrange for a list of voters living in the house to be included in each house. The local national committee may also take such action in municipalities with fewer than 5000 persons on electoral lists.
Opposition procedure
(1) Any citizen may, orally or in writing, draw the local national committee's attention to errors and errors in the electoral list and propose corrections. The local national committee shall decide on the alert within three days by either making an appropriate correction in the electoral list or by informing the complainant in writing of the reasons for the correction.
(2) If the application is rejected, the citizen may submit it to the district court responsible under the constituency. The provisions of the Civil Code on review of decisions of other institutions shall apply to proceedings. According to the court's decision, the local national committee will make a correction on the electoral list. Proceedings before a court shall not be subject to a judicial fee.
Election card
Voters who, from the time the electoral lists are unloaded to the election date, as well as voters who, for serious reasons, will not be able to vote in the constituency in whose electoral list they are registered, will issue a local national committee, at their request, and will delete them from the electoral list.
The Voting Card authorises the entry on the list of voters in another constituency. The registration is carried out by the local national committee of new residence (place of residence), on the election day of the District Election Commission. On entry, the voter card is withdrawn and added to the voter list.
Election circuits for elections to the Slovak National Council
General provisions
(1) Elections to the Slovak National Council are held according to the constituencies.
(2) One Member of the Slovak National Council is elected in each constituency.
(3) Replacements are not elected.
Creating electoral districts for elections to the Slovak National Council
(1) The number and definition of electoral districts for elections to the Slovak National Council coincides with the number and definition of electoral districts created in Slovakia for elections to the National Assembly.
(2) The list of electoral districts for elections to the Slovak National Council will be published by the Bureau of the Slovak National Council no later than 60 days before the election date.
Election districts for elections to the Slovak National Council
(1) Election districts for elections to the Slovak National Council are created in the municipalities when voting and counting. If elections to the Slovak National Council are held on the same day as elections to other representative corps, the electoral districts for these elections are common.
(2) Electoral districts and polling rooms for each district shall be determined by the local national committee at the latest 30 days before the election date.
(3) The electoral district is usually created so that it includes about 1000 voters. For remote parts of the village, separate electoral districts can be created if there are at least 50 voters.
(4) Special electoral districts can be created in hospitals, births, sanitariums, welfare institutions, similar institutions and facilities, or parts thereof, but only if there are at least 50 voters.
(5) The forces of the armed forces and armed corps form special electoral districts, if they have at least 50 voters.
Election Commission for Election to the Slovak National Council
General provisions
(1) Election to the Slovak National Council is managed by the Slovak Election Commission of the National Front for Election to the Slovak National Council.
(2) Elections to the Slovak National Council in individual constituencies are managed by the district election commission for the Slovak National Council.
(3) Voting in the various constituencies is managed by the district election commission for the Slovak National Council.
(4) The election committee for the Slovak National Council will be formed from representatives of the Communist Party of Czechoslovakia, other political parties and other social organisations of the Slovak National Front. Proposals from representatives shall be submitted by the competent authority of the Slovak National Front.
(1) Election Commission for the Slovak National Council may be held in a valid resolution if an absolute majority of the members are present.
(2) The Election Commission shall act by an absolute majority; the vote of the President shall be taken by equal vote.
Slovak Election Commission National Front for Election to the Slovak National Council
(1) The Slovak Election Commission of the National Front for elections to the Slovak National Council is hereby established by the Bureau of the Slovak National Council no later than 55 days before the date of election.
(2) The Slovak Election Commission of the National Front for Election to the Slovak National Council consists of the President, Vice-Presidents, Secretary and the necessary number of other members.
(1) The Slovak Election Commission of the National Front for Election to the Slovak National Council manages the elections to the Slovak National Council and oversees the precise observance of the rules on elections.
(2) The Slovak Election Commission of the National Front for Election to the Slovak National Council sets out the model voting lists, the model registration of the Circular Election Commission on the registration of candidates for members of the Slovak National Council, the District Election Commission on the vote and the Circular Election Commission on the census of votes and the model of the certificate of election of a Member of the Slovak National Council.
(3) Slovak Election Commission National Front for Election to the Slovak National Council
(a) concentrate proposals on candidates for Members of the Slovak National Council;
(b) subscribes candidates to the Slovak National Council for registration at the District Election Commission;
(c) make final decisions on complaints concerning the malpractice of district and district electoral commissions;
(d) register elected members of the Slovak National Council;
e) Submit files on the elections of Slovak National Council members to the mandate committee of the Slovak National Council.
(4) The Slovak Election Commission of the National Front for Election to the Slovak National Council may direct the District Election Commission for Election to the Slovak National Council through the Regional Election Commission of the National Front established for Election to the National Committees.
If elections to the Slovak National Council are held on the same day as elections to other representative corps and the election of judges of the District Courts, the Slovak Electoral Commission of the National Front for elections to the Slovak National Council also performs the tasks of the Slovak Electoral Commission of the National Front for elections to the National Assembly and to the National Committees and the election of judges of the District Courts.
Circuit Election Commission for Election to the Slovak National Council
(1) The Council of the Regional National Committee shall set up, no later than 50 days before the date of the election to the Slovak National Council, a Circular Election Commission for each constituency.
(2) The Regional Election Commission for the Slovak National Council consists of the President, Vice-President, Secretary and the necessary number of other members.
Circuit Election Commission for Election to the Slovak National Council
(a) oversees the precise observance of election regulations;
(b) register candidates for the Slovak National Council,
(c) provide the district election committees with election ballots;
d) keeps an eye on the election process and ascertains their results in the constituency;
(e) decide on complaints concerning the malpractice of district electoral commissions;
f) submit a report to the Slovak Election Commission of the National Front for elections to the Slovak National Council on the outcome of the election in the constituency,
(g) issue to the elected candidate a certificate of election to the Slovak National Council,
h) forward the files on the elections to the Slovak National Council to the custody of the Regional National Committee.
Regional Electoral Commission
(1) For each electoral district, the council of the local national committee shall form a district election committee no later than 30 days before the election date.
(2) The Regional Electoral Commission is composed of the President, Vice-President, Secretary and between 4 and 8 other members. In constituencies with less than 300 voters, the District Electoral Commission has two or three other members alongside the President and Secretary.
Regional Electoral Commission
(a) oversees the proper surrender of ballots and ensures the maintenance of order in the voting room;
(b) shall add the votes cast for each candidate;
(c) write a minutes on the course of the election and count the votes, which shall be submitted without delay to the Circular Election Commission for Election to the Slovak National Council,
d) turn over the files on the elections to the Slovak National Council to the county national committee.
Candidates
Design of candidates
(1) Candidates for elections to the Slovak National Council are candidates for the Slovak National Front.
(2) The candidates are proposed by the Communist Party of Czechoslovakia, other political parties and other social organisations of the Slovak National Front, the assembly of workers, peasants and other workers at races, offices and villages and the assembly of soldiers and members of other armed corps. If elections to the Slovak National Council are held on the same day as elections to other representative corps, the local (city) election committee of the National Front shall submit proposals to the Regional Election Commission of the National Front. The Regional and Regional Election Commission of the National Front is doing the same.
(3) Candidates are designed for individual constituencies. One or more candidates may be proposed for each constituency.
Registration of candidates
(1) The candidates for Members of the Slovak National Council are registered by the Slovak Election Commission of the National Front for Election to the Slovak National Council. Applications shall be submitted to the relevant Regional Election Commission for elections to the Slovak National Council no later than 30 days before the election date.
(2) Candidates are registered by constituency. No one can stand for election to the Slovak National Council in more than one constituency.
(3) The application shall contain a statement by the candidate that he agrees to his or her candidacy. The application shall be accompanied by a report on the meeting of the organisation or assembly of workers where the candidate has been proposed.
The Regional Election Commission for the Slovak National Council is obliged to register all duly designed candidates for the Slovak National Council.
Announcement
The District Election Commission for the Slovak National Council shall publish the name, surname, age and employment of each registered candidate for the Slovak National Council, no later than 25 days before the date of the election.
Voting lists
(1) All registered candidates must be listed on ballots.
(2) Voting lists must take the form laid down and be reproduced in the quantities required.
Membership of candidates in election committees
Candidates for members of the Slovak National Council may not be members of the district or district electoral committees in which they are elected.
Election agitation
Every workers' organisation and every citizen of the Czechoslovak Socialist Republic have the right to freely agitate candidates in the press, in meetings and in other ways.
Options
Announcement of elections
Election Day
(1) The date of the elections to the Slovak National Council shall be determined by the Bureau of the National Assembly no later than 60 days in advance.
(2) The elections to the Slovak National Council take place on the same day on the territory of the whole of Slovakia. The elections take place on a day of work. Supplementary elections to the Slovak National Council may also take place on a working day.
(3) The elections are held on a specified day from 7 a.m. to 16 p.m. Cities which are the headquarters of regional and regional national committees, as well as all municipalities with at least 10 000 inhabitants, shall hold elections on a specified day from 7 a.m. to 20 p.m. If local needs so require, the start of the elections may be set for an earlier hour.
Informing voters
(1) The Regional Electoral Commission shall inform voters in the last 15 days before the election date of the time and place of the election.
(2) In municipalities with more than 5000 registered voters, the District Electoral Commission will ensure that a legitimate ballot is drawn up for each voter showing the necessary voting data. At the same time, he will arrange for the legitimate ticket to be delivered to the electorate. The local (city) election commission of the National fronts may provide that the same procedure is applied in municipalities with fewer than 5000 registered voters.
Voting procedure
Preparations in polling rooms
The President of the District Electoral Commission shall check the ballot box and seal it before the election starts in the presence of the members of the Commission. It will also check whether a list of voters and ballots is ready. Then the vote will be taken.
Voting ballot boxes
Special spaces shall be designated in the ballot rooms in order to ensure the secrecy of the vote. No one must be present in these spaces at the same time as the voter or the electoral commission.
Voting time
(1) Each voter shall vote in person. Representation is not admissible.
(2) The voter will hand over a legitimate ballot after arriving in the ballot room and will receive a ballot after the entry in the voter list. If the voter does not have a legitimate ticket and the members of the District Electoral Commission do not know him, the commission may ask him to prove his identity.
(3) The voter who came into the voting room with an electoral pass will be included by the district electoral commission in the electoral list. The minutes shall be signed by the President and the Secretary of the District Electoral Commission; Voting cards shall be connected.
Modification of ballots
(1) The voter shall leave on the ballot the name and surname of the candidate for whom he votes in the area designated for adjusting the ballots; the names and surnames of candidates for whom it does not vote shall be crossed out. Then he goes to the ballot box and puts a ballot in it.
(2) A voter who is unable to adjust his own ballot for a physical defect, or because he cannot read and write, has the right to take with him a ballot space to modify another voter's ballot box to modify the ballot box for him.
Order in the Election Room
The President of the District Electoral Commission shall be responsible for the order of the election room. His instructions to maintain order in the polling room are binding on all present.
End of election
As soon as the hour set for the end of the vote has passed, the election room will be closed, but before that, everyone who is in or before the election room will be inferred. Then the President of the District Electoral Commission shall declare the vote closed and proceed to the opening of the ballot box.
Determination of election results
Who can be present at the count of votes in the District Election Commission
In a room where the District Electoral Commission sums up the votes, members of the Election Commission of higher degrees and representatives of workers' organisations and representatives of the press have the right to be present, empowered to do so by the National Front Election Commission.
Allocation of votes in the District Election Commission
(1) Once the ballot box has been opened, the District Electoral Commission shall add the ballots, compare the number of ballots submitted with the number of persons who have received ballots on the electoral list, establish the number of votes cast for each candidate and record the result in the vote record.
(2) The President of the District Electoral Commission shall check the accuracy of the census.
Assessment of ballots
(1) Votes which are not on the prescribed form are invalid.
(2) If the voter left more than one candidate on the ballot, the ballot shall be deemed to have been submitted for the first uncrossed candidate.
(3) If doubts arise as to the validity of the ballot, the District Electoral Commission shall decide on the validity, which shall be noted in the minutes.
Minutes of votes
(1) The Regional Electoral Commission shall draw up a separate minutes of the vote and count the votes; the minutes shall be signed by the President, the Secretary and the other members of the Commission.
(2) The minutes of the District Electoral Commission on the vote shall state:
(a) the time at which the vote begins and ends;
(b) the total number of voters in the constituency included in the electoral list;
