State Fire Control and Fire Protection Act

on State fire surveillance and fire protection.
The National Assembly of the Czechoslovak Republic decided on the following Act:

Část I.

Basic provisions.
§ 1.
(1) Socialistic state building must be protected against damage caused by fires and other natural disasters or accidents. It is therefore necessary to build fire protection on the extensive mass cooperation of citizens and to deepen its activities by setting up national fire surveillance authorities so that fire protection can successfully perform its tasks.
(2) The development of the mass participation of fire protection workers is primarily taken care of by national committees, which work in conjunction with voluntary organisations, in particular the Czechoslovak Fire Protection Union.
(3) Each shall, in principle, be obliged to contribute to the proper performance of fire protection tasks, in particular to provide the necessary personal and material assistance in preventing and combating fires and other natural disasters or accidents.
§ 2.
Responsibility.
(1) The National Committees, State Fire Supervision Authorities and the Minister of Interior shall be responsible for implementing measures to enhance fire safety, to organise the preparation and use of firefighting forces and means of fire protection in municipalities, districts and regions.
(2) They shall be responsible for implementing measures to enhance fire safety, to organise the preparation and to use the forces and means of fire protection in enterprises, establishments, institutes, offices and other facilities (hereinafter referred to as "the plants').

Část II.

Fire control. Organisation and competence of state fire control.
§ 3.
General fire protection control.
(1) General fire protection management and supervision are the responsibility of the Minister for the Interior.
(2) The Minister of the Interior shall be entitled to take, within the limits of the provisions in force, the measures necessary to ensure fire protection, in particular to issue general legislation and generally binding directives and guidelines in this field.
(3) The guidelines of the Minister for the Interior in the field of fire protection are also governed by all central authorities and other state bodies.
(4) The central authorities shall assist the Home Secretary in carrying out his fire protection tasks.
§ 4.
State fire control authorities.
(1) The Minister of the Interior shall direct and supervise fire protection through the central administration of the State Fire Supervision and its local authorities.
(2) A central (regional) administration of state fire surveillance is established in the Ministry of Interior.
(3) The following shall be established in the counties and counties and in the cities designated by the Minister for the Interior:
(a) regional administration of state fire control;
(b) district inspection of state fire control;
(c) urban, including district inspection of state fire control.
(4) Regional administrations and district (urban, district) inspections of state fire surveillance are an organisational component of the apparatus of the relevant national committee. Their relationship with the national committees will be regulated by the government by regulation.
(5) The organisation of administrations and inspections of state fire control and the performance of their services are adapted to the principles applicable to military departments to the extent laid down by the Minister of Interior in an agreement with the Minister of National Defence.
§ 5.
Tasks of the State Fire Supervision Authorities.
In particular, the national fire surveillance authorities shall carry out the following tasks:
(a) prepare and issue legislation, directives, guidelines and technical standards in the field of fire protection;
(b) check how the fire-fighting measures are implemented;
(c) provide for the organisation, training, use and enhancement of the capability of fire protection units as well as for the continuous education of fire protection citizens;
(d) ensure that fire protection is prepared and carried out in substance;
(e) ensure that fire protection requirements are taken into account in the design and construction of plants, settlements, individual buildings and equipment, and control projects and the construction of such buildings in this respect;
(f) organise and develop improvement activities in the field of fire protection.
§ 6.
Rights of the authorities of the State Fire Supervision.
(1) In the performance of their tasks, the authorities of the State Fire Supervision have the right:
(a) enter establishments and buildings for inspection under the Home Secretary's directives;
(b) require reports and evidence of the state of the fire-fighting measures;
(c) give binding instructions to eliminate detected fire protection defects and take all necessary measures to ensure fire safety;
(d) investigate the causes of the fires;
(e) impose fines on persons responsible for infringements in the field of fire protection up to the amount laid down by the Government by the Regulation;
(f) notify for prosecution persons who have infringed fire protection regulations;
(g) if other measures in the field of fire protection are not sufficient to eliminate the causes of the immediate occurrence of a fire, they may, under the guidelines of the Minister of the Interior, stop the operations causing this imminent danger in the plants; the decision of the State Fire Authority shall cease to be effective if the Minister of Interior or the Chief of State Fire Control Administration does not confirm it during the next working day. Only the Minister of the Interior may order the plant to shut down if there is an imminent risk of fire, after prior notice of the relevant member of the government.
(2) In order to impose fines, the authorities of the State fire surveillance authority may authorise the fire protection unit commander. An appeal may be made to the decision imposing a fine.

Část III.

Tasks of other fire protection authorities.
§ 7.
Tasks of central authorities.
(1) The central authorities shall, within the limits of the guidelines of the Minister for the Interior, issue instructions to their subordinate authorities on the provision and implementation of fire protection in establishments within their field of competence.
(2) In order to carry out these tasks successfully, the central authorities, including in subordinate bodies as appropriate, will establish specific fire protection components.
(3) The Ministry of National Defence and National Security, in their field of competence, controls the implementation of fire protection measures by their departments; In doing so, it shall follow the guidelines and instructions of the Minister for the Interior.
(4) The tasks of the public mining authorities under the specific rules remain unaffected.
§ 8.
Tasks of national committees.
(1) The National Committees mobilise citizens to participate actively in the fire protection tasks with the help of voluntary organisations, in particular the Czechoslovak Fire Protection Association.
(2) National committees are entitled to take all measures necessary to ensure fire protection within the limits of the rules in force in their respective districts.
(3) Local national committees shall plan and ensure, in accordance with closer regulations, the means of public fire protection issued, shall cover the costs of their actions and the maintenance of public fire departments and fire patrols.
§ 9.
Race assignments.
(1) Plant management organises fire protection for plants; This shall be governed by the instructions of the State Fire Supervision Authorities.
(2) The plant managers plan and ensure the means of fire protection in the plant and pay the personal and material costs associated with fire protection, according to the closer regulations on this issue.

Část IV.

Czechoslovak Fire Protection Association.
§ 10.
(1) In order to prepare for the performance of fire protection tasks, workers in the voluntary organisation of the "Czechoslovak Union of Fire Protection" (hereinafter referred to as the "Association") are joined.
(2) The task of the Union is to assist national committees and other state bodies in the fight against fires and to popularise fire protection issues so that they become a matter for all people. The Union shall in particular:
(a) carrying out agitation and promotion activities in the mass preparation of citizens in the fight against fires;
(b) cooperate with the national committees and with the management of the plants in the establishment of voluntary fire departments and their training;
(c) organise fire patrols.
(3) The Minister for the Interior, the National Committees and the State Fire Supervision Authorities may entrust the Union and, where appropriate, other voluntary organisations to carry out other fire protection tasks.
(4) The National Committees and the Ministry of the Interior assist the Union in its activities and check how it performs its fire protection tasks.

Část V.

Fire protection units.
§ 11.
Tasks and types of fire protection units.
(1) The fire protection authorities shall have public and racing fire protection units; They're fire departments, professional fire corps, voluntary fire corps and fire patrols. Their task is to prevent and combat fires and other natural disasters or accidents. The organisation of fire services and the performance of services therein shall be adapted to the principles applicable to military services to the extent laid down by the Minister of Interior in agreement with the Minister of National Defence.
(2) In order to strengthen the fire protection and to ensure its uniform organisation, the Minister of the Interior may provide for certain cities to have all fire protection units directly managed by the authorities of the State fire control.
(3) The performance of the service of fire protection units, their training, external marking and disciplinary conditions shall be regulated by the Minister for the Interior, if necessary, for the service and working conditions.
§ 12.
Uniforms and rank.
(1) Uniformity shall be established for the members of the State Fire Supervision Authorities and for the members of the Fire Services and shall be granted rank, appropriate to military rank, with a designation of competence to the Fire Protection Component.
(2) To strengthen discipline and facilitate the performance of the service, the Minister of the Interior may, in agreement with the Minister of National Defence, also establish uniforms for members of other fire protection components and award them rank.
(3) The Minister for the Interior provides details in agreement with the Minister for National Defence.
§ 13.
Material security.
The material security of the State Fire Supervision Authorities and the members of the occupational fire protection units shall be regulated by the Government.

Část VI.

Provisions common and final.
§ 14.
Implementing regulations.
(1) The provisions for the implementation of this Act shall be laid down by the Government by regulation. In this way, the following issues will in particular be addressed in more detail:
(a) the tasks of the State Fire Supervision Authorities and other Fire Protection Authorities;
(b) the organisation of fire protection units and the legal status of their members;
(c) the procurement, distribution and testing of means of fire protection in kind;
(d) reimbursement of personal and material costs;
(e) compensation for damage caused in the performance of fire protection tasks.
(2) The Government may, by regulation, lay down provisions on measures to prevent fires and other natural disasters or to prevent accidents, as well as provisions on measures to replace housing, buildings and installations.
(3) The detailed arrangements may be entrusted to general legislation.
Final provisions.
§ 15.
What applies under this Act on fire and fire protection applies mutatis mutandis to other natural disasters, as well as to accidents and protection against them.
§ 16.
(1) Regulations contrary to this law shall be repealed; in particular, Act No. 62 / 1950 Coll., on the Protection against Fire and Other Natural Diversity, and Decree No. 135 / 1950 Coll., on the Organisation of Protection against Fire and Other Natural Diversity, is repealed.
(2) The provisions of this Act shall be applied mutatis mutandis to the provisions of the present Act, unless they contradict it.
(3) Measures taken before the entry into force of this Act which comply with its provisions are deemed to have been taken under it.
§ 17.
This law shall take effect on the date laid down by the Government by the Regulation; It shall be implemented by the Minister for the Interior in agreement with participating members of the Government.
