of 15 July 1952
on the definition of tasks for the purchase of agricultural products in 1952.
The Government of the Czechoslovak Republic, with the agreement of the President of the Republic pursuant to § 42 (1) of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
§ 1.
For the timely and complete fulfilment of the supply of the State and the plan for the purchase of agricultural products, the experts of the Ministry of Purchase and National Committees shall be responsible in their respective districts; ensure high delivery morale in close cooperation.
§ 2.
(1) The district managers of the Ministry of Buying are responsible to the regional attendants of the Ministry of Buying and together with them to the Ministry of Buying; in Slovakia, district and county officers of the Ministry of Buying are also responsible to the Minister of Buying for Slovakia.
(2) The Regional Observers of the Ministry of Buying and the Regional Supervisors of the Ministry of Buying appoint and withdraw the Minister of Buying.
§ 3.
(1) The Regional Observers of the Ministry of Buying and the Regional Supervisors of the Ministry of Buying perform in particular the following tasks:
(a) draw up a plan for the purchase of agricultural products; cooperate closely with the national committees in the implementation of the schedule;
(b) organise and manage the purchase of agricultural products and, together with the national committees, ensure that farmers and the rest of the population have a wide participation in the supply of the State;
(c) continuously monitor the supply of agricultural products to which the agricultural establishment has committed itself by a supply contract or which has been officially provided for it, and implement measures to consolidate the State discipline in the purchase and to meet the supply within the prescribed time limits in each county, district, municipality and agricultural establishment;
(d) keep records of supplies of all agricultural products;
(e) manage and control the implementation of the supranational buyout of agricultural products by ransom organisations within the approved plan and within the set prices; if there is a breach of the rules on supranational buyout, they may waive the right to conduct supranational buyout;
(f) issue guidelines and orders for the implementation of the rules on the supply and purchase of agricultural products, binding on all purchasing organisations;
(g) control the activities of the ransom organisations as regards the timeliness, accuracy and consistency of the taking-over, storage, disposal and transport of agricultural products and their technical preparation for carrying out these tasks, as well as the quality of the agricultural products stored;
(h) draw the attention of the national committees to shortcomings in the implementation of the agricultural production plan which they identify in their activities.
(2) The full powers of the Ministry of Purchase have the right to use records of agricultural production held by national committees and agricultural factories.
§ 4.
(1) In the event of non-compliance with the supply of agricultural products to the State for which the agricultural establishment has committed itself to the supply contract or which has been officially established to it, the district supervisor of the Ministry of Exchequer shall issue a notice of non-compliance with the supply with an invitation to the farm to comply within eight days of the date of receipt of the notice.
(2) An action for non-compliance with the supply of agricultural products shall be admissible on a complaint which shall be decided definitively by the Regional Minister of Buying; the complaint shall be lodged with the Ministry of Buying Regional Officer within eight days of the date of receipt of the notice of non-compliance.
(3) The timely submission of a complaint has suspensory effect. The district manager of the Ministry of Purchase may exclude suspensive effect from the overriding general interest.
§ 5.
The scope of failure to comply with the supply of agricultural products which has acquired legal authority shall be enforceable mutatis mutandis under the rules on administrative management; the performance is performed by the district manager of the Ministry of Purchase.
§ 6.
In the event of non-compliance with the supply of agricultural products to the State for which the centrally planned agricultural establishment has undertaken an economic contract, the provisions on economic contracts and State arbitrage shall apply.
§ 7.
The county buyout ministries and district buyout officers shall be entitled to inspect the stocks at the farm premises, including the state goods, and to carry out the provisional security of the agricultural product stocks, in cooperation with a member of the local national committee, to the extent necessary to meet the supply.
§ 8.
(1) National Committees:
(a) continuously monitor the fulfilment of supplies and the purchase plan of agricultural products;
(b) discuss regularly the performance of supplies of agricultural products for the co-operation of inspection officers of the Ministry of Purchase who submit reports to the Chairpersons of the National Committees on the progress of the purchase;
(c) assist the experts of the Ministry of Buying in carrying out their tasks, in particular in organising the buyout, and eliminate defects which undermine the timely and complete fulfilment of the buyout plan;
(d) take care, together with representatives of the Ministry of Purchase, of the wide participation of peasants and the rest of the population in the supply of the State.
(2) The criminal jurisdiction of the national committees remains unaffected.
(3) The chairman of the national committee shall be responsible for carrying out the tasks of the national committees in the purchase of agricultural products to the chairman of the superior national committee and the prime minister.
§ 9.
In agreement with the competent central authorities, the Ministry of Buying shall lay down more detailed rules for the activities of the Ministry of Buying.
§ 10.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Prime Minister and the Minister for Buying in agreement with the participating members of the Government.
