GOVERNMENT REGULATION
of 9 November 2022
on the State Energy Concept and on the Territorial Energy Concept
The Government orders pursuant to Sections 3 (7) and 4 (11) of Act No. 406 / 2000 Coll., on Energy Management, as amended by Act No. 3 / 2020 Coll.:
§ 1
Subject matter
This Regulation lays down:
(a) the content and manner of processing of the national energy concept and the content and structure of the material for its processing and evaluation; and
(b) the content and manner of processing the territorial energy concept and the content and structure of the material for its processing and for the processing of the report on its application.
§ 2
State Energy Concept
(1) The State Energy Concept contains:
(a) an analysis of the state's existing energy system and a determination of the main trends in energy development, energy demand, the applicability of individual primary energy sources, the relative representation of individual primary and secondary energy sources in the energy system, including an analysis of possible future changes in this representation and of energy infrastructure issues;
b) Analysis of the strengths and weaknesses of the energy of the Czech Republic and the opportunities and threats to the energy sector of the Czech Republic,
(c) comprehensive analysis of the external and internal conditions affecting the energy of the Czech Republic in the long term;
(d) the setting of strategic objectives and targets for the whole energy sector, including a percentage representation of individual energy sources within primary and secondary sources with a set maximum and minimum that the energy source can achieve in the target year or sub-years, where appropriate;
(e) the results of the expected energy development of the Czech Republic using energy modelling in the light of the target values set and with emphasis on reducing emissions of pollutants and greenhouse gases, increasing energy efficiency, economic efficiency and maximum ecological acceptability,
(f) quantification of energy security indicators, competitiveness and social acceptability and sustainability of energy management and the setting of targets;
g) optimisation of the energy development scenario of the Czech Republic and indicators of energy security, competitiveness and social acceptability and sustainability of energy management on the basis of an assessment carried out on the basis of a number of different parameters, the parameters and settings being determined by taking into account quantified input assumptions and balanced implementation of strategic objectives;
(h) the sub-development strategies of each energy sector and downstream sector, comprising individual priorities and measures, in relation to optimisation calculations and overall strategic input following the output from energy modelling; and
(i) the procedure and instruments for implementing the objectives and priorities, including a timetable containing the implementation date and the institutions responsible for the implementation and, where relevant, the funding entitlements.
(2) Energy security indicators are:
(a) emergency stocks of primary energy sources;
(b) breakdown of primary energy sources;
(c) breakdown of gross electricity production;
(d) breakdown of imports;
(e) import dependence,
(f) security of operation of electricity and gas infrastructure,
(g) self-sufficiency in electricity supply; and
(h) the source adequacy of the electricity system.
(3) The indicators of competitiveness and social acceptability are:
(a) the energy performance of gross value added,
(b) the electric energy performance of gross value added,
(c) the degree of integration into international energy networks;
(d) final prices of electricity, natural gas and heat for industry and households;
(e) share of energy expenditure in total household expenditure;
(f) the share of the energy sector in gross added value; and
(g) share of energy in public expenditure on science and research.
(4) Energy sustainability indicators are:
(a) emissions of pollutants and greenhouse gases;
(b) the emission intensity of gross value added,
(c) greenhouse gas emissions per capita;
(d) share of fossil fuels in primary energy consumption;
(e) share of renewable energy sources in gross final energy consumption;
(f) energy consumption and per capita electricity consumption;
(g) the proportion of heat from renewable energy sources sold in the heat sold; and
(h) the share of heat from cogeneration in the heat sold.
§ 3
Territorial Energy Concept
(1) The territorial energy concept includes:
(a) analysis of trends in energy demand, including:
1. an analysis of the areas collecting population and housing data, including the outlook, as well as geographical and climatic data, on the basis of which technical calculations can be carried out and analysis of the production possibilities and scope of energy consumption; and
2. analysis of fuel and energy consumption systems and their claims in subsequent years to determine the structural distribution of fuel and energy consumption systems into the housing, public sector and business sector and to quantify their energy performance;
(b) an analysis of possible sources and modes of energy management, including an analysis of the availability of fuels and energy, which aims to determine the structural distribution of fossil fuels used, renewable and secondary energy sources, and to determine their share and availability in the supply of the area concerned;
(c) an assessment of the usefulness of renewable energy sources, including:
1. the determination of the technical potential of renewable energy sources, taking into account the requirements laid down by the legislation, and the analysis of their location and use, aimed at regional and local conditions and objectives and reducing the environmental burden; and
2. an analysis of the possibilities for the use of secondary energy sources in the territory concerned;
(d) an assessment of the economically viable savings involved
1. the determination of the technical potential of energy savings and the possibilities for their implementation for consumption systems in the housing sector, public and business sectors; and
2. the determination of the technical potential of energy savings and the possibilities for their implementation for energy production and distribution systems;
(e) basic objectives within the framework of:
1. the operation and development of thermal energy supply systems;
2. the implementation of energy savings;
3. the use of renewable and secondary energy sources, including energy recovery of waste;
4. electricity generation from cogeneration;
5. reducing emissions of pollutants and greenhouse gases;
6. the development of energy infrastructure;
7. the operation of parts of the electricity system which are disconnected from the rest of the interconnected system but remain under voltage (hereinafter referred to as "the electricity system island"),
8. the development of electricity networks capable of effectively linking the behaviour and actions of the manufacturer, the consumer or the consumer with its own production to ensure an economically efficient and sustainable energy system operated with low losses and high reliability of supply and safety, hereinafter referred to as the "smart network"; and
9. Use of alternative fuels in transport,
(f) instruments for achieving the objectives set;
(g) a solution to the energy management system, which includes:
1. a proposal to ensure economically efficient coverage of the energy needs of the geographical area concerned, while respecting the national energy concept, regional programmes, other strategic documents and regional restrictive conditions, taking into account the reliability of the supply of individual forms of energy; and
2. the definition of a comprehensive technical solution for the development of the energy supply system of the territory concerned, leading to compliance with the requirements set out in the anticipated development of energy demand within the area addressed and the quantification of their effects and entitlements.
(2) The outcomes of the energy management system solutions are:
(a) the anticipated evolution of electricity consumption in the territory, including changes in electricity consumption due to the development of the housing sector, the development of the public sector and the development of the business sector;
(b) anticipated developments in the operation of thermal energy supply systems on the territory, including:
1. the operation of individual resources in systems and the change of fuel used in those resources, including the use of renewable and secondary energy sources;
2. changes in the range of use of combined electricity and heat production and changes in the heat transfer medium in systems;
3. the development of systems as a result of the new construction and connection of existing buildings and related changes in the use of fuels within the territory; and
4. assessing the risks of disconnection of individual systems as a result of customer disconnection and methods and proposals to ensure a controlled disintegration of systems in the event of technical or economic impossibility of maintaining them and related changes in the use of fuels in the territory;
(c) the anticipated development of natural gas consumption in the territory, including changes in natural gas consumption due to the development of the housing sector, the development of the public sector and the development of the business sector, including changes in the efficiency of energy use in those sectors;
(d) anticipated developments in the use of renewable and secondary energy sources in the territory, including the use of the potential of individual technologies for the production of electricity and for the production of heat in each year of the processing period;
(e) anticipated developments in the area of the implementation of energy savings in a given territory, including the use of energy savings potential in the housing sector, in the public sector, in the production and distribution of heat in the thermal energy supply systems, and in other sectors of the national economy in the various years of processing;
(f) expected developments in the area of emissions of pollutants and CO2 and the associated impact on air quality within the territory, including changes in the amount of emissions of essential pollutants and CO2 and compliance with the limit values in problematic locations;
(g) identification of the risks in the areas of energy security and the reliability of the energy supply of the territory concerned and the results of the analysis of the security of alternative supply of fuels and energy in emergency situations, including the determination of the quantity of petroleum products for electricity production to ensure the operation of health and social facilities, safety forces, armed forces or components of the integrated rescue system, and, to the extent necessary, critical infrastructure elements, in short-term outages of up to six hours, medium-term outages of up to 18 hours and long-term outages of over 18 hours;
(h) anticipated developments in the development and implementation of smart network technologies within the territory;
(i) the results of the analysis of the security of operation of the electricity system islands in an emergency situation in the electricity system and the re-connection of those islands to the electricity system in the absence of such status, in order to maintain the priority electricity supply for health and social facilities, security forces, armed forces or components of the integrated rescue system and, to the extent necessary, also for critical infrastructure elements, at least at the level of statutory cities;
(j) identification of the energy infrastructure development and construction requirements within the territory, including graphic representation;
(k) anticipated developments in the use of electricity and natural gas, or alternative fuel, on a basis other than liquid petroleum products, in local, urban and suburban public transport within the territory.
(3) In the framework of a comprehensive technical solution, the following definitions shall apply:
(a) the energy balance of the new state;
(b) the investment costs incurred by the proposed technical solution;
(c) operating costs of the energy supply system;
(d) impacts on energy efficiency and energy savings;
(e) requirements for the protection of the agricultural land fund in relation to the construction of energy infrastructure and energy installations; and
(f) impacts on emissions of pollutants and CO2 and on air quality.
§ 4
Content and structure of the processing material
(1) The content and structure of the material for the processing and evaluation of the State energy concept are set out in Annex 1 to this Regulation.
(2) The content and structure of the documentation for the processing of the territorial energy concept and its implementation reports are set out in Annex 2 to this Regulation.
§ 5
Repeal
Government Decree No. 232 / 2015 Coll., on State Energy Concept and Territorial Energy Concept, is repealed.
§ 6
Efficacy
This Regulation shall take effect on 1 January 2023.

Content and structure of the materials for processing and evaluation of the state energy concept

1 Operation of electrical and thermal energy sources
The basis for modelling the development of the relative representation of individual primary and secondary sources of energy within the Czech Republic is the view of the operation of individual sources of electricity and heat, compiled on the basis of data obtained from the licence holders for electricity and heat generation, according to the following table:

2 Planned investment expenditure
The outlook for the planned investment expenditure of energy system operators in five-year sections, based on data obtained from electricity transmission and distribution licence holders, gas transport, storage and distribution and heat distribution, and from oil and product system operators, is the basis for determining the future cost of energy supply.

The basis for determining the current cost of energy security is an overview of the investment costs incurred by the energy system operators over the past five years, based on data obtained from the licence holders for the transmission and distribution of electricity, the transport, storage and distribution of gas and the distribution of heat and from the oil and production system operators, according to the following table:

1 Energy balance
Part of the outputs of the energy management system is the compilation of a simplified energy balance of the territorial unit for the initial and final years of the processing period broken down by fuel and energy types and by national economy sectors containing the following tables:

Entities with a NACE-code CZ- NACE 35 shall be classified in the Energy sector.
Subjects with NACE code 05, 06, 07, 09, 10 to 32 shall be classified in the industry sector.
Entities with a NACE code 41 to 43 shall be classified in the construction sector.
Entities with a NACE code 49 to 51 shall be classified in the Transport sector.
Entities with a NACE code 01, 02 and 03 shall be classified in the agriculture and forestry sector.
Trade, services, health care, education are to be classified under the NACE code 33, 36 to 39, 45 to 47, 52, 53, 55, 56, 58 to 66, 68 to 75, 77 to 82, 84, 85 to 88, 90 to 96, 99.

Table 1 shall be processed for all fuels together and separately for each fuel and energy group according to the following breakdown:
• Nuclear fuel - Black coal including coke - Brown coal including lignite - Natural gas - Biogas - Biogas - Waste - Liquid fuels - Other solid fuels - Other renewable and alternative energy sources including non-fuel sources
The basis for drawing up this simplified energy balance for the initial year of the concept is data processed by the Ministry of Industry and Trade. The basis for drawing up this simplified energy balance for the end-year of the concept is the own analysis of the processor of the territorial energy concept based on anticipated developments in electricity consumption, thermal energy supply systems, natural gas consumption, the use of renewable and secondary energy sources and the improvement of energy efficiency within the territory.
2 Electrical energy
2.1. Electricity production
The analysis of potential sources and ways of energy management shall include a detailed overview of the production and supply of electricity on the territory, broken down by production technology and type of fuel used, containing the following tables:

The analysis of trends in energy demand trends shall include an analysis of the evolution of electricity consumption in the territory over the previous five-year period, broken down by collection category and a detailed overview of electricity consumption at the distribution clearing rate and by the national economy sector of the following tables:

2.3 Status and development of the electricity system
The solution of the energy management system shall include a description of the state and analysis of the planned development and planned reconstruction of the electricity system, including a forecast of investments in the restoration and development of the transmission system and regional distribution systems in the territory, containing the scheme of the electricity system of the territory with the proposed investment actions and the following table:

3 Heat energy
3.1 Production and supply of heat
The analysis of potential sources and ways of energy management shall include a detailed overview of the production and supply of heat on the territory from heat energy sources broken down by fuel type used or energy and electricity sources broken down by production technology and the type of fuel used containing the following tables:

3.2. Thermal energy supply systems
The analysis of potential sources and ways of energy management and of trends in energy demand shall include a detailed analysis of the thermal energy supply systems in the territory, including the following points:
• A description of the different thermal energy supply systems, including data on the defined territory, premises, price location, type and length of the heat network, fuel used and the share of the State, region or municipality in ownership of the establishment or thermal network containing a heat network scheme in respect of the significant heat supply system in the territory, including tables:
