DECLARATION
of 21 October 2016
amending Decree No 5 / 2011 Coll., on the definition of hydrogeological zones and bodies of groundwater, the method of assessment of groundwater status and the details of groundwater survey and assessment programmes, as amended by Decree No 264 / 2015 Coll.
The Ministry of the Environment and the Ministry of Agriculture provides pursuant to § 21 paragraph 3 of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll. and Act No. 150 / 2010 Coll.:
Decree No. 5 / 2011 Coll., on the definition of hydrogeological havens and bodies of groundwater, the method of assessment of groundwater status and the details of groundwater survey and assessment programmes, as amended by Decree No. 264 / 2015 Coll., is amended as follows:
1. in Article 2, the following point (g) is inserted after point (f):
"(g) the background level of the substance concentration or the indicator value corresponding to a zero or very low anthropogenic change compared to undisturbed conditions,";
Points (g) to (m) shall be renumbered as points (h) to (n).
2. In Annex No 1, Part B, paragraph 3, including footnote 11, read:
"(3) Where background levels for substances or ions or their indicators are increased on the basis of natural hydrogeological causes, the increased background levels for the groundwater body concerned shall be taken into account when establishing the thresholds. When determining background levels, the procedure shall be followed by:
(a) the determination of background levels shall be based on the characterisation of bodies of groundwater and on the results of the monitoring of groundwater under this Decree and other legislation governing the detection and evaluation of water status (11). The monitoring and interpretation of data shall take into account the fact that the conditions of groundwater flow and groundwater chemical composition are changing laterally and horizontally,
(b) if sufficient data from previous groundwater monitoring is not available in determining the background level, further data shall be obtained by the end of the following six-year cycle at the latest. Until such data are obtained, background levels shall be determined on the basis of limited monitoring data by means of a simplified approach. Where appropriate, a subset of samples shall be used for which the indicators show no impact on human activity. Where information on geochemical transfers and processes is available, it shall be taken into account,
(c) if sufficient data from previous groundwater monitoring and sufficient information on geochemical transfers and processes are not available in determining the background level, further data and information shall be obtained at the latest by the end of the following six-year cycle and, where appropriate, background levels shall be estimated on the basis of statistical reference results for the same type of waterproof layers in areas for which sufficient monitoring data are available. "

Efficacy
This Decision shall enter into force on 1 November 2016.
