DECLARATION
of 30 November 2023
amending Decree No. 82 / 2019 Coll., on tobacco labels
According to § 129 (a) to (f) of Act No 353 / 2003 Coll., on Consumer Taxes, as amended by Act No 80 / 2019 Coll.:
Decree No. 82 / 2019 Coll., on tobacco labels, is amended as follows:
1. In Article 2 (1) (d) (2), the word "tobacco 'is replaced by the words" contents' and the words "one decimal place '; This quantity shall be given with an accuracy of one decimal place," shall be replaced by "1 decimal place."
2. In Article 2, at the end of paragraph 1, the dot is replaced by a comma and the following points (e) to (h) are added:
"(e) in the case of other tobacco products:
1. a capital letter of the alphabet characterising the rate of excise duty;
2. the quantity of product in the unit pack intended for direct consumption, expressed in grams, rounded to 1 decimal place; and
3. the letter "O" identifying the type of product,
(f) in the case of an electronic cigarette refill
1. a capital letter of the alphabet characterising the rate of excise duty; and
2. the quantity of filling per unit pack intended for direct consumption, expressed in millilitres, rounded to 1 decimal place,
(g) in the case of nicotine bag:
1. a capital letter of the alphabet characterising the rate of excise duty;
2. the quantity of product in the unit pack intended for direct consumption, expressed in grams, rounded to 1 decimal place; and
3. the letter "S 'identifying the type of product,
(h) in the case of other nicotine products:
1. a capital letter of the alphabet characterising the rate of excise duty;
2. the quantity of product in the unit pack intended for direct consumption, expressed in grams, rounded to 1 decimal place; and
3. the letter "N" indicating the type of product. ';
3. in Article 2 (1), the following point (d) is inserted after point (c):
"(d) in the case of tobacco for a pipe
1. a capital letter of the alphabet characterising the rate of excise duty;
2. the quantity of tobacco in a unit pack intended for direct consumption in grams; and
3. the letter "V" indicating the type of product, ';
Points (d) to (h) shall be renumbered as points (e) to (i).
4. In Article 6 (1) of the Introductory Part of the provision, the word "tobacco 'is deleted.
5. in Article 6 (1) (b) of the introductory part of the provision, the words "or" shall be replaced by a comma and after the words "smoking" shall be inserted the words "other tobacco product, refills for electronic cigarettes, nicotine bag or other nicotine product."
6. in Article 6 (1) (b) of the introductory part of the provision, the words "tobacco in a water pipe" shall be inserted after the words "smoking."
7. In Section 7 (2) of the introductory part of the provision, the words "or 'are replaced by a comma and the words" smoking' are inserted after the words "other tobacco product, electronic cigarette filling, nicotine bag or other nicotine product '.
8. In Section 7 (2) of the introductory part of the provision, the words "tobacco in a water pipe 'shall be inserted after the word" smoking'.
9. In Paragraph 8 (1), the word "tobacco 'is deleted.
10. In Annex No 1, the following Figures 5 to 8 are added:

11. In Annex 1, the following figure 4 is inserted after figure 3:
"

Figure 4 to 8 to date is renumbered as Figure 5 to 9.
12. In Annex 2, in the part "Explanatory notes', in paragraph 1, the words" tobacco 'and' or 'deleted' and after the word "products' are inserted the words" other tobacco product, refill in electronic cigarettes, nicotine bag or other nicotine product '.
13. In Annex 2, in the part "Explanatory notes', in paragraph 1, the words" tobacco in a water pipe 'are inserted after the words "smoking'.
14. In Annex No 2, in the part "Explanatory notes', in paragraph 2 (a), the word" tobacco 'is deleted and after the word "products' the words" O for other tobacco products, E for the filling in electronic cigarettes, S for nicotine bags, N for other nicotine products' are inserted.
15. In Annex No 2, in the part "Explanatory notes', in paragraph 2 (a), the words", V for tobacco in water pipe 'are inserted after the words "smoking'.
16. In Annex 2, in the part "Explanatory notes', in paragraph 2 (c) (4), the word" tobacco 'is replaced by the words "contents' and the words" rounded to one decimal place 'are replaced by "rounded to one decimal place'.
17. In Annex 2, in the part "Explanatory notes', at the end of point (c), the following points 5 to 8 are added:
'5. The other tobacco product shall be the quantity of the product in a unit pack intended for direct consumption in grams rounded to 1 decimal place,
6. an electronic cigarette filling by the quantity of the filling in a unit pack intended for direct consumption in millilitres, rounded to 1 decimal place,
7. nicotine sachet by the quantity of product in the unit pack intended for direct consumption in grams rounded to 1 decimal place,
8. The other nicotine product shall be the quantity of the product in the unit pack intended for direct consumption in grams rounded to 1 decimal place, '.
18. In Annex No 2, in the part "Explanatory notes', in paragraph 2 (c), the following point 4 is inserted after point 3:
'4. Water pipe tobacco by the quantity of tobacco in a unit pack intended for direct consumption in grams, '.
Points 4 to 8 shall become points 5 to 9.
19. In Annex 2, the words "Examples of tobacco sticker code: 'are replaced by the words" Examples of tobacco sticker code:'.
20. In Annex No 2, in the part "Examples of tobacco sticker code ', the text" mm' is inserted in point 3 after the number "20 '.
21. In Annex 2, in the section "Examples of tobacco sticker code ', point 4, the words" tobacco and twenty' are replaced by the words "fillings and 20 '.
22. In Annex 2, in the part "Examples of tobacco sticker code ', at the end of point 4, the dot is replaced by a comma and the following points 5 to 8 are added:
'5. Om10M (tobacco sticker for other tobacco products - e.g. chewing tobacco - of a size of 16 mm x 32 mm for unit packaging containing 10 g of the product at a tax rate characterised by the letter M),
6. Ev2M (tobacco sticker for an electronic cigarette filling of 20 mm x 44 mm size for a unit pack containing 2 ml of a product with a tax rate characterised by the letter M),
7. Sm14M (tobacco sticker for a nicotine bag of 16 mm x 32 mm size for unit packaging containing 14 g of the product at a tax rate characterised by the letter M),
8. Nv8M (tobacco sticker for other nicotine products of 20 mm x 44 mm size for unit packaging containing 8 g of product at the tax rate characterised by the letter M). '
23. In Annex 2, in the part "Examples of tobacco sticker code ', the following point 4 is inserted after point 3:
'4. Vv200M (tobacco sticker for water pipe tobacco of 20 mm x 44 mm size for unit packaging containing 200 g tobacco at a tax rate characterised by letter M) ';
Points 4 to 8 shall be renumbered 5 to 9.
24. In Annex 3, in the part "Explanatory notes', in paragraph 1 (a), the word" tobacco 'is deleted and after the word "products', the words" O for other tobacco products, E for filling in electronic cigarettes, S for nicotine bags, N for other nicotine products' are inserted.
25. In Annex 3, in the part "Explanatory notes', in paragraph 1 (a), the words", V for tobacco in a water pipe 'are inserted after the word "smoking'.
26. In paragraph 1 (c) (4) of Annex 3 to the Explanatory Notes, the word "tobacco 'is replaced by" contents' and the words "rounded to one decimal place 'are replaced by the words" one decimal place'.
27. In Annex 3, in the part "Explanatory notes', at the end of point (c), the following points 5 to 8 are added:
'5. The other tobacco product shall be the quantity of the product in a unit pack intended for direct consumption in grams rounded to 1 decimal place,
6. an electronic cigarette filling by the quantity of the filling in a unit pack intended for direct consumption in millilitres, rounded to 1 decimal place,
7. nicotine sachet by the quantity of product in the unit pack intended for direct consumption in grams rounded to 1 decimal place,
8. The other nicotine product shall be the quantity of the product in the unit pack intended for direct consumption in grams rounded to 1 decimal place, '.
28. In Annex 3, in the part "Explanatory notes', point (c) of paragraph 1, the following point 4 is inserted after point 3:
'4. Water pipe tobacco by the quantity of tobacco in a unit pack intended for direct consumption in grams, '.
Points 4 to 8 shall be renumbered 5 to 9.
29. In Annex 3, in the part "Examples of tobacco sticker code ', the text" mm' is inserted after the heading "20 '.
30. In Annex 3, in the part "Examples of tobacco sticker code ', point 4, the words" tobacco and twenty' are replaced by the words "fillings and 20 '.
31. In Annex 3, in the part "Examples of tobacco sticker code ', at the end of point 4, the dot is replaced by a comma and the following points 5 to 8 are added:
'5. Om10M (tobacco sticker for other tobacco products - e.g. chewing tobacco - of a size of 16 mm x 32 mm for unit packaging containing 10 g of the product at a tax rate characterised by the letter M),
6. Ev2M (tobacco sticker for an electronic cigarette filling of 20 mm x 44 mm size for a unit pack containing 2 ml of a product with a tax rate characterised by the letter M),

32. In Annex 3, in the part "Examples of tobacco sticker code ', the following point 4 is inserted after point 3:
'4. Vv200M (tobacco sticker for water pipe tobacco of 20 mm x 44 mm size for unit packaging containing 200 g tobacco at a tax rate characterised by letter M) ';
Points 4 to 8 shall be renumbered 5 to 9.
33. In Annex 4, in the part "Explanatory notes', in paragraph 2, the text" mm 'is inserted after the number "20'.
34. In Annex 4, in the part "Explanatory notes', in paragraph 3 (a), the word" tobacco 'is deleted and after the word "products', the words" O for other tobacco products, E for filling in electronic cigarettes, S for nicotine bags, N for other nicotine products' are inserted.
35. In Annex 4, in the part "Explanatory notes', in paragraph 3 (a), the words", V for tobacco in a water pipe 'are inserted after the word "smoking'.
36. In paragraph 3 (c) (4) of Annex 4, the word "tobacco 'shall be replaced by" content' and the words "rounded to one decimal place 'shall be replaced by" rounded to one decimal place'.
37. In Annex 4, in the part "Explanatory notes', the following points 5 to 8 are added at the end of point (c) of paragraph 3:
'5. The other tobacco product shall be the quantity of the product in a unit pack intended for direct consumption in grams rounded to 1 decimal place,
6. an electronic cigarette filling by the quantity of the filling in a unit pack intended for direct consumption in millilitres, rounded to 1 decimal place,

8. The other nicotine product shall be the quantity of the product in the unit pack intended for direct consumption in grams rounded to 1 decimal place, '.
38. In Annex 4, in the part "Explanatory notes', in paragraph 3 (c), the following point 4 is inserted after point 3:
'4. Water pipe tobacco by the quantity of tobacco in a unit pack intended for direct consumption in grams, '.
Points 4 to 8 shall be renumbered 5 to 9.
39. In Annex 4, in the part "Examples of tobacco sticker code ', the text" mm' is inserted after the number "20 'in point 3.
40. In Annex 4, in the part "Examples of tobacco sticker code ', point 4, the words" tobacco and twenty' are replaced by the words "fillings and 20 '.
41. In Annex 4, in the part "Examples of tobacco sticker code ', at the end of point 4, the dot is replaced by a comma and the following points 5 to 8 are added:

Points 4 to 8 shall be renumbered 5 to 9.
Notification of technical regulation
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This Decree shall take effect on 1 January 2024, with the exception of Article I (3), (6), (8), (11), (13), (15), (18), (23), (25), (28), (32), (35), (38) and (42), which shall take effect on 1 March 2024.
