DECLARATION
of 12 October 2012
establishing the technical and economic parameters of renewable sources for electricity production and the lifetime of electricity generation from supported sources
The Energy Regulatory Authority shall determine, pursuant to § 53 (2) (a) and (b) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the amendment of certain laws (Act on Supported Energy Sources), for the implementation of § 7 (3) and § 12 (1) (a) of the Law on Supported Energy Sources:
Subject matter
This decree sets out technical and economic parameters for determining the purchase prices of each type of renewable energy source for electricity production and the lifetime of renewable energy generation.
Basic concepts
For the purposes of this decree:
(a) the electricity generation source of the electricity generation installation, determined by the value of the installed power, the date of entry into service and the identification number allocated by the Energy Regulatory Authority when the decision to grant a power generation licence is taken;
(b) electricity generation from renewable energy sources, energy installations for the conversion of renewable energy sources into electricity, including all necessary installations, including plants for the conversion or modification of renewable energy sources into fuel;
(c) by technological own electricity consumption, electricity consumption for electricity generation in the production of electricity or electricity and heat in the main production facility as well as ancillary plants directly related to production, including production, conversion or modification of fuel, distribution losses of own consumption as well as losses on power supply or transmission system power generation transformers;
(d) by the technological own consumption of heat from renewable sources, the consumption of heat in the production plant and in auxiliary plants directly related to the production of electricity, including the production, conversion or modification of fuel and the losses in the heat distribution of the electricity plant;
(e) the useful heat from renewable sources of heat produced in the cogeneration process for the supply to the heat supply system or for further use for technological purposes other than the own technological heat consumption of the renewable electricity plant or used for further conversion into electricity or mechanical energy.
The electricity generation from renewable energy sources consists of one or more power generation sources.
In order to ensure a 15-year investment-free return period for the promotion of electricity produced from renewable sources by means of ransom prices, compliance with the technical and economic parameters for each type of renewable resource is provided in the annex to this decree.
The useful life of renewable electricity generation is set out in the Annex to this Decree.
Transitional provisions
(1) The indicative values of the technical and economic parameters referred to in Annex 3 to Decree No. 475 / 2005 Coll., implementing certain provisions of the Renewable Resources Support Act, as amended, apply to the plants put into service until 31 December 2012 inclusive.
(2) For plants put into service from 1 January 2013 inclusive, the Energy Regulatory Authority shall follow the technical and economic parameters laid down in this Decree when setting the ransom prices.
Repeal
The following shall be deleted:
1. Decree No. 475 / 2005 Coll., implementing certain provisions of the Act on the Promotion of the Use of Renewable Resources.
2. Decree No. 364 / 2007 Coll., amending Decree No. 475 / 2005 Coll., implementing certain provisions of the Act on the Promotion of the Use of Renewable Resources.
3. Decree No. 409 / 2009 Coll., amending Decree No. 475 / 2005 Coll., implementing certain provisions of the Act on the Promotion of the Use of Renewable Resources, as amended by Decree No. 364 / 2007 Coll.
4. Decree No. 300 / 2010 Coll., amending Decree No. 475 / 2005 Coll., implementing certain provisions of the Act on the Promotion of the Use of Renewable Resources, as amended by Decree No. 364 / 2007 Coll. and Decree No. 409 / 2009 Coll.
5. Decree No. 338 / 2011 Coll., amending Decree No. 475 / 2005 Coll., implementing certain provisions of the Act on the Promotion of the Use of Renewable Resources, as amended by Decree No. 364 / 2007 Coll., Decree No. 409 / 2009 Coll. and Decree No. 300 / 2010 Coll.
Efficacy
This Decree shall take effect on 5 November 2012, with the exception of Article 7, which shall take effect on 1 January 2013.

Electricity from renewable energy sources
I. Water energy - Water power plants
1. Duration of production: 30 years.
2. Required efficiency of primary energy use: The efficiency of the newly installed turbine is assumed to be ≥ 85% in the operating optimum, for renovated types ≥ 80% (measured on turbine coupling).
3. Costs of installed unit power and annual use of installed power:

II. Energy of biomass

2. The use of useful heat from renewable sources is envisaged for the production of renewable electricity.

Note: Classification into the different biomass categories is determined by Decree No. 477 / 2012 Coll., on the determination of the species and parameters of supported renewable sources for electricity, heat or biomethane production and on the determination and storage of documents. The cost of the installed power unit shall reflect the total investment costs related to the installed electrical power.

III. Wind Energy - Wind Power
1. Duration of production: 20 years.
2. Requirement for efficiency of primary energy use: Annual average wind speed at the wind power plant site at the height of the rotor of the proposed power plant is assumed to be ≥ 6 m / s

IV. Geothermal energy - use of low potential heat
1. Duration of production: 20 years.
2. Required efficiency of primary energy use: The energy potential of the geothermal energy source is assumed to be at least such that it can be permanently obtained by means of a heat transfer medium at a minimum thermal gain of 50 to 70 litres of water per second at a temperature of > 95 ° C per megawatt of the installed electrical power of the source.
