DECLARATION
of 12 October 2012
on the dates and procedures for selecting the form of support, the procedures for registering aid with the market operator, the dates and procedures for selecting and amending the green bonus schemes for electricity and the dates for offering electricity to the purchaser (registration decree)
According to Article 53 (2) (c) to (g) and (m) of Act No 165 / 2012 Coll., on supported energy sources and amending certain laws, (hereinafter referred to as "the Act '), the Energy Regulatory Authority provides for the implementation of § 8 (2), (3) and (5), § 9 (4) and (5), § 11 (3), § 23 (7), § 32 (2), § 39 (2) and § 54 (2) of the Act:
Subject matter
This decree sets out the dates and procedures for the selection of the form of aid and the procedures for the registration of electricity support, operating heat support, biomethane support and the promotion of the decentralised production of electricity by the market operator, the dates and procedures for the selection and modification of green bonus schemes for electricity and the date of the supply of electricity by the renewable electricity producer to the purchaser.
Data records
(1) The conditions for registration of electricity support, decentralised electricity production, biomethane support and heat promotion by the market operator are:
(a) the registration of the identification data of the manufacturer, the electricity producer from the decentralised electricity plant, the biomethane producer and the heat producer in the market operator system; and
(b) the recording of the data identifying the electricity generation energy installation identified by the identification number allocated by the Authority when the decision to grant a licence for the production of electricity (hereinafter referred to as the "production source identification number of the licence), the value of the installed power and the date of entry into service (hereinafter referred to as the" generation source of electricity ") or the bio-methane or heat production plant in the market operator's system.
(2) Where the manufacturer records the chosen form of electricity support or changes it through the buyer or the obligor, the buyer or obligor shall record the data referred to in paragraph 1 with the market operator through its own secure access.
Identification of the manufacturer, the electricity producer from the decentralised electricity plant, the biomethane producer or the heat producer
(1) The manufacturer, the electricity producer from the central power plant, the producer of biomethane or the producer of heat shall register in the market operator's system, with a guaranteed electronic signature, his identification data and other data necessary to cover the aid to the extent specified in Annex 1 to this Regulation.
(2) Manufacturers who have registered the data referred to in paragraph 1 in a market operator's system shall, in accordance with the procedure laid down in the Electricity Market Rules Regulation (1), assign a registration number if not already allocated and allow secure access to the market operator's system for the selection of the form of aid, its registration and changes and the change of the green bonus scheme to electricity.
(3) Biomethane producers which have registered the data referred to in paragraph 1 in the market operator's system will allow the market operator to have secure access to the market operator's system for the registration of aid.
(4) Heat producers that have registered the data referred to in paragraph 1 in the market operator's system shall assign a registration code to the market operator's system and allow secure access to the market operator's system for the registration of aid.
(5) Electricity producers from a central power plant that has registered the data referred to in paragraph 1 in a market operator's system shall, in accordance with the procedure laid down in the Electricity Market Rules Regulation (1), assign a registration number if not already allocated and allow secure access to the market operator's system for the registration of aid.
Identification of the electricity generation source
(1) The producer or producer of electricity from a central electricity production plant, which has registered the data referred to in Article 3 (1) in the market operator's system and obtained secure access to the market operator's system pursuant to Article 3 (2), shall also register the data on the electricity generation source in the market operator's system to the extent specified in Annex 2 to this Regulation.
(2) Where a power plant from supported sources or a decentralised power plant consists of more than one power plant, the producer or the electricity producer from the decentralised power plant shall register data in the market operator's system to the extent set out in Annex 2 to this Decree individually for each power plant.
(3) If the electricity producer or the electricity producer from a decentralised power plant intends to register more than one form of aid in the market operator's system, it shall only record the data on the power generation plant once.
(4) In the case where the electricity producer or the electricity producer from the central power plant records in the market operator's system the information referred to in point 2 of Annex 2 to this Regulation, the market operator shall check the conformity of the recorded data referred to in points 1, 3 and 4 of Annex 2 to this Regulation with the data of each electricity production source already registered which is assigned the same installation identification number from the licence to which the electricity generation source is part.
(5) After verifying the data referred to in paragraph 4, the market operator shall immediately inform the electricity producer or the electricity producer from the central power plant via the market operator's system whether the data referred to in points 1, 3 and 4 of Annex No 2 to this Decree registered by the manufacturer or the electricity producer from the central power plant to each of the individual power generation sources. If any of the data does not match, the market operator shall inform the manufacturer or the electricity producer of the dedicated electricity plant in question.
(6) The market operator shall assign a unique identifier of the power source to the power-generating facility manufacturer or power-generating facility manufacturer or power-generating facility manufacturer without delay after registration of the electricity generation data in the market operator's system. Where a producer or producer of electricity from a decentral electricity production plant has registered more than one of the electricity sources referred to in paragraph 2 in a market operator's system, the market operator shall assign a unique identifier of the power generation plant for each registered power source to the power generation plant manufacturer or power generator.
(7) If the electricity producer or electricity producer has concluded an energy connection agreement with the transmission system operator or distribution system operator (2), the transmission or distribution system operator shall, at its request, communicate within 15 working days the identification code of the demand or transfer point for the purpose of recording the electricity generation source. Within this period, the transmission or distribution system operator shall register the identification code of the sampling or transfer point in the market operator's system without tribal data.
Identification of the biomethane factory
(1) The producer of biomethane, which has registered data in the market operator's system pursuant to Article 3 (1) and obtained secure access to the market operator's system pursuant to Article 3 (3), shall also register data in the market operator's system within the scope of Annex 3 to this Regulation.
(2) The market operator will assign a unique identifier to the biomethane producer immediately after registration of data on the biomethane production plant in the market operator system.
(3) If the biomethane manufacturer has concluded a connection agreement with the transmission system operator or distribution system operator under the Energy Act (3), the transmission or distribution system operator shall, at its request, communicate within 15 working days the code number of the transfer point for the registration of the biomethane factory, unless indicated in the connection agreement. Within 15 working days of the receipt of the request or the conclusion of the connection agreement, the transmission or distribution system operator shall register the code number of the transfer point in the market operator's system without tribal data.
Identification of the heat plant
(1) The heat producer, which registered the data referred to in Article 3 (1) in the market operator's system and obtained secure access to the market operator's system pursuant to Article 3 (4), shall also register the data on the heat production plant in the market operator's system within the scope of Annex 4 to this Decree.
(2) Where a producer of heat operates multiple heat production plants for which the right to aid may be exercised under the law, it shall separately register individual heat production plants in the market operator system within the scope of Annex 4 to this Decree.
(3) The market operator shall assign a unique identifier to the heat generator immediately after registration of the heat production data in the market operator system.
Registration and registration of forms of electricity support and decentral production support
(1) The electricity producer and the electricity producer from the central electricity production plant shall register in the market operator's system for each electricity production source, which has been assigned the unique identifier of the electricity generation source referred to in Article 4 (6), the chosen form of support for electricity from supported sources, the selected settlement period, the change in the form of support for electricity from renewable sources, the change in the green bonus scheme to electricity and the promotion of the decentralised electricity production. Furthermore, the manufacturer shall register the selected category of electricity support in the market operator's system in accordance with the Authority's pricing decision.
(2) The electricity producer and the electricity producer from the central electricity production plant shall register in the market operator's system the chosen form of support for electricity from supported sources referred to in paragraph 1 for a power source newly put into service no later than 30 calendar days before the date of effective registration of the form of electricity support. The electricity producer and the electricity producer from the central power plant shall record in the market operator system a change in the chosen form of support for electricity from renewable sources or a change in the green bonus scheme to electricity by 30 November of the calendar year concerned at the latest for the following calendar year.
(3) A producer intending to offer electricity produced from renewable sources for the purchase of electricity to a buyer under Article 11 (12) of the Act shall notify the buyer of this fact by means of the market operator system for a power source newly put into service no later than 30 calendar days before the date of effective registration of the form of aid, otherwise no later than 30 November of the calendar year concerned for the following calendar year.
(4) The electricity producer or the electricity producer from the Decentralised Electricity Plant has requested to be reimbursed by the market operator pursuant to § 9 (3) and § 40 (2) of the Act or has complied with the obligation under § 11 (3) of the Act if it has registered in the market operator's system the promotion of electricity from renewable sources, the promotion of electricity from secondary sources or high-efficiency cogeneration by means of a green bonus or the promotion of decentralised electricity production by means of a decentralised electricity production, and has sent for the first time a statement of electricity produced under another legislation4).
(5) The electricity producer or the electricity producer from the central power plant shall register in the market operator's system for each power source newly put into service, which has been assigned a unique power source identifier pursuant to Article 4 (6),
(a) the number of the electricity production licence, the installation identification number of the licence and the production source identification number of the licence and any changes to the data on the electricity production source that have already been registered in order to match the data on the electricity production source of the decision granting the electricity production licence; and
(b) the date of connection and the installed power of the power-generating facility and, if any, any changes to other already registered data on the power-generating facility in such a way as to correspond to the data from the protocol on the first parallel connection to the power-generating system or any other document proving the connection, if the transmission or distribution system operator has issued it, and the power-generating facility connection contract, after the connection of the power-generating facility to the power-generating facility or after the connection of the power-generating facility within the existing production facility;
(c) the date of installation of the measuring device at the transfer point.
(6) The electricity producer or electricity producer from the desenturant electricity production plant shall register the data referred to in paragraph 5 in the market operator system no later than 7 working days before the required date of registration of the form of support, registration of a change in the form of support or registration of a change in the green bonus scheme to electricity.
(7) The purchaser or obligor shall proceed with the registration of the chosen form of support for electricity from renewable sources and its amendments mutatis mutandis in accordance with paragraphs 1, 2, 5 and 6.
(8) The market operator shall inform the purchaser of the registration of the production source data referred to in paragraph 5 where the manufacturer is proceeding in accordance with paragraph 3 or has registered the aid in the form of ransom prices and shall make available to him the information necessary for the conclusion of the purchase contract.
Registration and registration of biomethane support
(1) The biomethane manufacturer shall record in the market operator's system the date from which the registration of the biomethane aid is to be effective and the length of the settlement period for each biomethane production which has been assigned the unique identifier of the biomethane production referred to in Article 5 (2) and the green bonus for biomethane.
(2) The biomethane manufacturer shall register the aid with the green biomethane bonus referred to in paragraph 1 for the biomethane production facility no later than 30 calendar days before the date of effective registration of the aid by the green biomethane bonus.
(3) The producer of biomethane requested the payment of the aid by the market operator pursuant to Article 33 (3) of the Act if it registered the aid in the market operator's system with a green bonus for biomethane.
(4) The manufacturer shall register in the market operator system for each biomethane production plant newly put into service, which has been assigned a unique identifier of the biomethane production plant pursuant to § 5 (2),
(a) the number of the gas production licence and the identification number of the biomethane production plant from the licence and any changes to the data on the biomethane production plant already registered in order to match the data from the decision to grant the gas production licence without undue delay after the decision to grant the gas production licence has become final;
(b) the date of connection of the biomethane production plant, the date of installation of the security against unauthorised manipulation of the measuring device for measuring the quantity of the biomethane produced by the transmission system operator or distribution system, and any changes to any other biomethane manufacturer of the already registered biomethane production facility data, in such a way as to correspond to the contract for the connection of the biomethane production plant to the transmission or distribution system, directly or through another biomethane production plant.
(5) The biomethane manufacturer shall register the data referred to in paragraph 4 in the market operator system no later than 7 working days before the requested date of registration of the biomethane aid.
(6) The market operator shall immediately inform the transmission or distribution system operator, through the market operator system, of the registration of data on the biomethane production referred to in paragraph 4.
Registration of heat promotion
The heat producer applied for the aid to be paid by the market operator pursuant to § 26 (6) of the Act if it registered the data on the heat production plant in the market operator's system pursuant to § 6. The market operator shall register heat support in the form of a green heat bonus within 30 calendar days at the latest.
Verification of registration of electricity aid and verification of entitlement
(1) No later than the following working day following the registration of data on the electricity generation source pursuant to Article 7 (5) (a), the market operator shall verify the conformity of the data registered by the manufacturer or the electricity producer in the system of the market operator with the data provided by the Authority under the law, namely the licence number, the identity number of the person, the identification number of the electricity generation source from the licence, the identification number of the establishment of the licence and the type of supported resource. In addition, the market operator shall record the date of acquisition of legal power from the decision to grant a licence for the production of electricity or the decision to amend the decision to grant a licence for the production of electricity and the value of the installed power of the electricity generation source.
(2) After verifying the data referred to in paragraph 1, the market operator shall immediately inform the producers or producers of electricity from the central power plant via the market operator's system whether the data are consistent. If any of the data does not match, the market operator shall inform the manufacturer or the electricity producer of the dedicated electricity plant in question and the data recorded by the Authority.
(3) At the latest on the following working day following the registration of the data on the electricity generation source pursuant to Article 7 (5) (b), the market operator shall inform the transmission or distribution system operator via the market operator system of the records of the electricity generation source data. Where data on the identification number code of the sampling or transfer point, the method of connection of the production source, the value of the installed output and the date of connection of the production source to the transmission or distribution system from the first parallel connection protocol or similar document and the date of installation of the transfer point measuring device do not match the data registered by the transmission or distribution system operator under the connection contract, the transmission or distribution system operator shall inform the market operator of this non-compliance through the market operator system within 2 working days.
(4) After verifying the data referred to in paragraph 3, the market operator shall without delay inform the power producer or electricity producer from the central power plant via the market operator's system whether the data registered by the producer or electricity producer from the central power plant is consistent with the data registered by the transmission or distribution system operator. Where any of the data does not conform, the market operator shall inform the manufacturer of the data concerned and of the data recorded by the transmission or distribution system operator.
(5) Once the market operator has received the data referred to in paragraphs 2 and 4, it shall immediately verify the conformity of the installed power output of the power source from the first parallel connection protocol with the installed power output of the power source from the licence. They shall also verify compliance with the conditions for obtaining the aid. If the data do not match or the conditions for receiving the aid are met, the market operator shall immediately inform the producers or producers of electricity from the central power plant via the market operator system.
(6) The market operator shall without delay inform the producers or producers of electricity from the central electricity generation plant and, where the manufacturer has chosen the aid in the form of ransom prices or has acted in accordance with Article 7 (3), the purchaser shall also be obliged to comply with the recorded data.
(7) The form of aid shall be registered with effect from the date on which the conformity of registered data has been confirmed by the market operator and the transmission or distribution system operator and the conditions for obtaining the aid have been met and responsibility for the derogation provided for in the Decree on Rules of the Electricity Market, but not earlier than the deadline laid down in Article 7 (2) has been assigned to the transmission point of the electricity generation and electricity system.
Verification of registration of biomethane aid and verification of entitlement
(1) No later than the following working day following the registration of data on the biomethane production plant pursuant to Article 8 (4) (a), the market operator shall verify the conformity of the data registered by the biomethane manufacturer in the market operator's system with the data provided by the Authority under the law, namely the licence number, the person identification number and the gas registration number. Furthermore, the market operator shall register the date of acquisition of legal power from the decision granting the gas licence or the decision amending the decision granting the gas licence.
(2) After verifying the data referred to in paragraph 1, the market operator shall immediately inform the biomethane manufacturer through the market operator's system whether the data registered by the manufacturer conforms. If any of the data does not match, the market operator shall inform the biomethane manufacturer of the data in question and the data recorded by the Authority.
(3) No later than the following working day following the registration of data on the biomethane production plant pursuant to Article 8 (4) (b), the market operator shall inform the transmission or distribution system operator via the market operator system of the registration of data on the biomethane production plant. The transmission or distribution system operator shall verify and confirm, within 3 working days of sending the information, whether the transmission or distribution system code number, the date of connection to the transmission or distribution system, the date of installation of the security against unauthorised manipulation of the measurement device for measuring the quantity of biomethane produced by the transmission or distribution system operator matches the data registered by the transmission or distribution system operator. In addition, according to the data it has registered, it shall verify and confirm whether it is a biomethane plant connected to the transmission or distribution system directly or through another gas plant.
(4) After verifying the data referred to in paragraph 3, the market operator shall immediately inform the biomethane manufacturer through the market operator's system whether the data registered by the biomethane manufacturer matches the data registered by the transmission or distribution system operator. Where any of the data does not match, the market operator shall inform the biomethane manufacturer of the data in question and the data recorded by the transmission or distribution system operator.
(5) The form of the aid is registered with effect from the date following that on which the conformity of the registered data has been confirmed by the market operator and the transmission or distribution system operator.
Verification of registration of heat promotion and verification of entitlement
(1) No later than the following working day following the registration of heat production data pursuant to Section 6 of the market operator shall verify the conformity of the data registered by the heat producer in the system of the market operator with the data provided by the Authority under the law, namely the licence number for the production of heat energy, the identity number of the person, the registration number of the establishment and the type of renewable source. Furthermore, the market operator shall register the date of acquisition of legal power from the decision to grant a thermal energy licence or the decision to amend the decision to grant a thermal energy licence.
(2) After verifying the data referred to in paragraph 1, the market operator shall immediately inform the manufacturer through the market operator system whether the data registered by the manufacturer are consistent. If any of the data does not match, the operator of the heat producer market shall inform the data concerned and the data recorded by the Authority.
(3) Heat support in the form of a green heat bonus shall be registered on the first day of the following calendar month after the date on which the conformity of the recorded data was confirmed by the market operator.
Transitional provisions
(1) The manufacturer who applies for the period up to and including 31 December 2012 shall register only the manufacturer's identification data with the market operator in accordance with the procedure laid down in Article 3, not later than 31 January 2013.
(2) A manufacturer who applies for electricity aid for the period up to and including 31 December 2012 shall notify the transmission or distribution system operator of the change of the selected form of aid for 2013 for the electricity generation source by 31 December 2012. The model of the notification of the choice of the form of aid for the production of electricity from renewable sources and its amendment is set out in Annex 1 to Decree No 475 / 2005 Coll., implementing certain provisions of the Act on the Promotion of the Use of Renewable Resources.
(3) The transmission or distribution system operator for which the manufacturer has chosen the ransom price support for 2013 shall, without delay, transmit to the Purchaser the data necessary for the conclusion of the electricity supply contract (5) to that producer, within the scope of points 1, 3 to 5, 9, 10, 14, 15 and 18 of Annex 1 to this Regulation and Annex 5 to this Regulation, if the transmission or distribution system operators are known.
(4) The electricity producer or electricity producer from the desenter shall register the identification data of the producer or electricity producer from the desenter and the electricity source and register the form of aid for the generation source of electricity with the first claimed entitlement to support the electricity after 1 January 2013, including in accordance with the procedure laid down in this Decree.
(5) The transmission or regional distribution system operator shall transmit to the market operator data on products that claim aid for the period up to 31 December 2012 and apply it also for 2013, their generation sources of electricity and the selected forms of support to the extent set out in Annex 5 to this Decree. This will record the electricity generation sources of such producers and register the selected forms of support in the market operator system with effect from 1 January 2013, with the exception of the power generation sources connected to the local distribution system, for which the manufacturer will subsequently register the identification code of the transmission point of the electricity generation source in the market operator system.
(6) In the event that the producer has acquired the right to aid in the form of a green bonus under the existing legislation and requires aid under the 2013 hourly green bonus scheme, the aid scheme shall be registered in the market operator system from 1 to 8 February 2013. The change in aid thus registered under the hourly green bonus scheme has been effective since 1 January 2013.
(7) A manufacturer who decides to exercise the right under Paragraph 11 (12) of the Act from 1 January 2013 shall do so with the Purchaser by 30 November 2012 at the latest. The transmission or distribution system operator shall subsequently, upon request by the Purchaser, make available without delay to the Purchaser the data necessary for the conclusion of the electricity supply contract (5) with that producer.
Efficacy
This Decree takes effect on 5 November 2012.

Data on the electricity generation source for recording in the market operator system
1. Location of the electricity generation source - region, municipality, or parts thereof, street name, descriptive and indicative number, if assigned, postal code, followed by name and code of the cadastral territory (6), where the electricity generation source is located, Partition number of the land according to the cadastral where the electricity generation source is located
2. Identification number of the establishment of the licence to which the electricity generation source is part where the production plant already exists
3. Identification of the transmission or distribution system operator to which the production plant of which the power generation source is connected is or is intended to be connected, including indication of whether the production plant is connected to the system
(a) directly or through its own demand facility
(b) through another market participant's electricity plant

Notes:
(a) In the event that the transfer point of the power source will be registered at the request of the manufacturer as 2 production points pursuant to § 8 (1) of Decree No 541 / 2005 Coll., as amended, the EAN for which the actual measurement values for the supply of electricity to the electricity system will be transmitted shall be reported. The EAN may be changed by the manufacturer so that the production source is always registered under the EAN for which the transmission or distribution system operator will send the measured electricity data supplied to the transmission or distribution system.

1. 6. System identification number to which the power source is connected directly or indirectly through the manufacturer's or the customer's sampling or transfer point

All EAN power-generating modules connected directly to the transmission or regional distribution system or all EAN demand or transmission points through which the power-generating module is connected, in the case of connection of the power-generating module to the local distribution system, all EAN local distribution system connection points to the regional distribution system
8. Voltage level through which the power source is transmitted to the transmission or regional distribution system
9. Installed power output of the power source which was responsible for granting the aid
