THE LAW
of 5 December 2007
amending Act No 169 / 1999 Coll., on the execution of a prison sentence and amending certain related laws, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 169 / 1999 Coll., on the enforcement of prison sentences and on the amendment of certain related laws, as amended by Act No. 359 / 1999 Coll., Act No. 3 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 218 / 2003 Coll., Act No. 52 / 2004 Coll., Act No. 539 / 2004 Coll., Act No. 109 / 2006 Coll. and Act No. 267 / 2006 Coll., is amended as follows:
1. Paragraph 30 (4) reads as follows:
"(4) The employment of a convicted person with a body other than a prison shall require the prior written consent of the sentenced person; This does not apply if the sentenced is employed by the Czech Republic, the Region, the Municipality, a voluntary association of municipalities or an entity which has been established or constituted by them and in which the majority of the property is held, a majority of the voting rights or exercises a decisive influence on its management or operation."
2. In Article 30, the following paragraph 5 is added:
"(5) The sentenced person may withdraw the consent referred to in paragraph 4 by a declaration made against the Prison Service. If the declaration is not in writing, the Prisoner's Service staff shall immediately take the minutes which they submit to the sentenced for signature. The effects of the withdrawal of consent shall take place on the expiry of the last day of the calendar month immediately following the month in which the sentenced consent was withdrawn. Withdrawal of consent of the sentenced shall not be considered a refusal of work. ';
This Act shall take effect on the 15th day following its publication.
