DECLARATION
of 22 June 2006
laying down animal welfare conditions
The Ministry of Agriculture provides pursuant to § 29 (1) and for the implementation of § 14a (2) of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 162 / 1993 Coll. and Act No. 77 / 2004 Coll.:
Conditions for keeping dressed animals
(1) In order to maintain the physiological functions of wild animals which are raised, trained and used for dressage (hereinafter referred to as the "dressed animal") and to ensure their biological needs, the breeder shall establish conditions to ensure the well-being of the dressed animals at the place of winter, when they are moved and transported (1) and where their dressage is carried out or where they are used for public appearance, by:
(a) allow dressed animals to care for the surface of the body and the game, prevent stress and stereotypical behaviour from occurring by enrichment of the environment of these animals (for example, equipment of space for dressed animals to hide, strains, branches or moving aids),
(b) by equipping and dividing the space by the natural function of the movement apparatus of the dressed animal and, for species requiring it, the possibility of cutting claws;
(c) ensure sufficient residence for dressed animals in designated areas in the outdoor environment;
(d) ensure adequate ventilation of internal spaces;
(e) ensure that the length and intensity of lighting corresponds to the needs of each species of dressed animals and, in the case of forest species of dressed animals, ensure that part of the space is shrouded especially during the summer period;
(f) adapt the mode of heating to the needs of each species of dressed animals and exclude the possibility of burning them and overheating them;
(g) has a group of individuals to whom individual breeding would cause suffering.
(2) Paragraph 1 (a) and (c) shall not apply to aquatic vertebrates.
(1) The dressing room must:
(a) be easily accessible and washable for dressed animals and breeders or caregivers;
(b) allow continuous disinfecting, disinsecting and exeratization to be carried out in such a way as to avoid excessive effects on the health of dressed animals; in the presence of dressed animals, disinfectant and disinsectisation may not be used to irritate them.
(2) Mobile devices with dressed animal compartments must be designed and used in such a way as to be safe for them, enabling them to take a natural position in standing and lying down, enabling them to rest, to prevent the loss of feed and litter and the discharge of water, animal by-products, feces and other waste, while meeting the conditions for the well-being of dressed animals.
(3) In addition to mobile premises, additional technical equipment, in particular outdoor verandas and indoor and outdoor enclosures, shall be available for dressed animals, which must be able to be used by the dressed animals as soon as the equipment for the dressing of animals is at the post. When calculating the minimum area of the cage, it is possible to count the porch only if it is able to achieve a full expansion of the inner cage, for example by means of external walls and roof.
(4) Managers must:
(a) size corresponding to the species of dressed animals, allowing their safe movement, their structure and equipment to minimise the possibility of injury or other damage;
(b) be covered with soil or sand up to an amount of 8 - 10 cm if the ground of the operation does not form an aluminium or sandy surface or a lawn. The same high layer of wood sawdust must be applied to this ground. Other materials can only be used as the floor of the gurney if they are malleable, non-elastic, safe to move and non-slip,
(c) be secured against dust formation by appropriate measures, such as sprinkling.
(5) The dressing facilities of the dressed animals include storage and auxiliary facilities, which are considered as separate premises intended for storage of feed, bedding and other materials.
(1) The specific conditions for the breeding of felines, bears, elephants, wild equidae, llama and camels, turnip and dolphin are set out in Annexes 1 to 7.
(2) The space conditions set out in Annexes 1 to 7 are sufficient only if the dressed animals are employed daily by dressage or are allowed to move freely outside the mobile premises. Where dressed animals are not employed on a daily basis, the minimum size of outdoor cages and enclosures shall be at least one third greater than that specified in Annexes 1 to 7.
Conditions of dressage of dressed animals
(1) The following means of communication of the breeder are used to the dresser, including activities aimed at reducing the fear of contact between the dressed animal and humans, and to establish a relationship and respect where the dressed animal must become accustomed to handling:
(a) voice initiatives;
(b) non-contact stimuli of body parts (body language),
(c) touches;
(d) management,
(e) the load;
(f) remuneration.
(2) The means of communication must be understandable to the individual, must be used rigorously, with minimal effort and must not cause suffering to the dressed animal. The dressed animal must be used slowly and gradually for new equipment.
(3) Only the natural characteristics of the dressed animal can be used in the dressage. Consideration should be given to the ability of a dressed animal to play, to induce positive stimuli and to act on a dressed animal to consolidate the desired habits, exercises and tricks using the reward for correct performance. Unauthorised method of dressage shall be considered to be the use of:
(a) whips or punches by other devices and objects;
(b) fires or stimuli causing pain by thermal or other effects of a physical nature, chemically or using electrical current;
(c) initiatives for the purpose of inducing defensive reflexes to promote aggressive behaviour;
(d) methods of starvation and restriction of feeding, drinking or methods affecting the natural biorrhythmia of the dressed animal at rest demands, or the extension of the period of light or darkness, drugs and other substances affecting the perception or behaviour of the dressed animals;
(e) muzzle and devices limiting movement of limbs,
(f) circumcisions or similar devices in parts of the body other than those on the chest;
(g) drugs or other substances affecting the perception of dressed animals;
(h) barriers or aids for dressage with sharp edges and protrusions or otherwise endangering the health of dressed animals;
(i) aids imitating human clothing.
(4) Equipment, equipment and equipment used must be adequate to the construction of the body, age and performance of the dressed animals and must not cause them suffering. The equipment and equipment used shall be in such a condition as to avoid injury, suffering or harm to the health of the dressed animal. In the event of failure of equipment which could cause physical or psychological suffering to the dressed animal, the operation with the dressed animal shall be terminated without delay.
(5) The method of dressage and its length must correspond to the age, physical development and behaviour of the dressed animal, account must be taken of the origin of the dressed animal, gender, social status, health status, surrounding situation and the current state of the dressed animal.
(6) Dressed animals shown in public performance must be clean and, where appropriate, have treated hooves or hooves. Dressed animals may only be shown after adequate training has been completed and adapted to the conditions of public appearance.
Transitional and final provisions
Equipment for dressing dressed animals operated on the date of entry into force of this Decree shall comply with the conditions laid down in the Decree no later than 15 July 2008.
This Decree shall take effect on 15 July 2006.

SPECIAL CONDITIONS FOR THE TERRITORY OF CHECKS
1. For species and subspecies from warm climate belts, the indoor temperature for animals shall be at least 15 ° C. For cold-resistant cats (for example, irbis, a Ussurian tiger, some subspecies of cougar), only dry sleeping boxes are sufficient to protect them from the draught.
2. The inner areas for feline animals shall comply with the following conditions:
(a) shall have a minimum height of 2,2 m. The minimum base area of the cage shall be 12 m2 for 1 to 2 animals, for each additional animal 4 m2 additional,
(b) the animals must be provided with an optical possibility of retreat, such as a half-open sliding door;
(c) sawdust or straw litter must be used,
(d) be heat-insulated;
(e) they must be equipped with tree strains to scratch and sharpen claws and to mark and play objects;
(f) it must contain elevated lying positions so high that the animals can pass under them without injury;
(g) for childbirth and in the first weeks after delivery, it is necessary to ensure a special separation of at least 12 m2 for female with pups and to ensure that the litter is protected against extreme weather fluctuations and interference with the external environment. As soon as the pups start to move separately, they shall be provided with an additional cage area of at least 4 m2 on each cub until weaned.
3. Outdoor runs and cages for cat animals shall meet the following conditions:
(a) a minimum area of 50 m2 for a maximum of 5 animals, for each additional animal an additional 5 m2,
(b) it is necessary to place in the range tribes for scratching, objects for playing, hay, branches, grass, raised lying areas and for tigers and jaguars to ensure the possibility of bathing or showering;
(c) at temperatures below 10 ° C, the animals must be able to hide in an inner cage, except for cold species.

SPECIAL CONDITIONS FOR THE USE OF THE MEDSCIENCE
1. Bears must be kept in enclosures provided with a safety device (e.g. doors, sliding doors, exaggeration devices), which corresponds to significant body strength and particular endurance of bears.
2. For brown bear and polar bear at the time of reproduction, the temperature shall be at least 12 ° C. The indoor temperature for Malaysian, Himalayan, Proud and Spectacular bears shall be at least 16 ° C.
3. The inner spaces for bears, in particular cages or transport wagons, shall comply with the following conditions:
(a) a minimum area of 24 m2 for 1 to 2 large bears with body length greater than 2 m, for each additional animal 6 m2 extra;
(b) a minimum area of 12 m2 for 1 to 2 bears with a body length of less than 2 m, for each additional animal an additional 6 m2,
(c) a minimum height of 2,2 m;
(d) to enlarge the area of the inner space, it is possible to land the veranda to which access from all boxes must be provided; the area of the porch shall not be counted against the area referred to in point. a) and b).
4. Each bear must be able to bathe in the pool or shower at least twice a month; at temperatures exceeding 25 ° C at least twice a week.

SPECIAL CONDITIONS FOR COMPETITION
1. The following conditions shall be met for elephant breeding:
(a) the indoor temperature for elephants, including the tent stable, shall be at least 15 ° C;
(b) elephants shall not be kept individually except for adult males. Babies must grow up with adult females. Where only 1 elephant (female) is kept in the establishment, it must be kept in the company of other animals, in particular ruminants or horses,
(c) Elephant males shall only be allowed to behave and drive in a mobile device if a non-mobile object is available suitable for their permanent housing, where these animals are located in the non-periodic period of Elephant Madness (so-called must) and which has an area of at least 50 m2 per animal.
2. By the time the mobile device is on the exit, the elephants must have a tent that serves as a stable and an indoor enclosure. The truck used to transport elephants does not replace the tent stable. The vehicle can be used as an elephant overnight place during transport if the width of the vehicle is 50 cm higher than the back height of the elephants.
3. The chain holding shall be limited to the most necessary period of time, in particular for housing at night, in the case of pre-appearance or test preparation, in the case of treatment of the animal or in the interests of protecting the animal or human. In addition to these cases, the animals must be kept without chains, either in the range or in the stable, which is adapted to this, under the supervision of the breeder.
4. In addition to the outdoor run-off, an indoor run in a tent with a minimum area of 100 m2 for 1 to 3 animals must be available in particular under poor climatic conditions and for each additional animal with an area of 20 m2 larger.
5. A solid housing building must be available at the winter grounds. In dry weather, even in winter, for a short time, elephants can be dependent on the temperature and strength of the wind, located in the outdoor range. In case of a temperature below 0 ° C, measures must be taken to prevent frostbite of the ears.
6. At the time of binding of elephants on chains, the following conditions shall be met:
(a) the standing must be dry, the urine and water must flow away without obstacles so that the animals do not stand therein;
(b) an area of at least 2,5 × 4 m shall be available for each animal;
(c) each animal must be bound on two chains, one on the rear leg and the other on the opposite front leg or neck. In order to avoid bruising, chains must be attached alternately to the right or left front or rear leg each day. The length of the chains shall be measured so that the tied elephant can lie down and take one step forward and backward. The chains must be padded.
7. The following conditions shall be met for outdoor access:
(a) the range must be so large that the animals can move indefinitely. For 1 to 3 elephants it must be at least 250 m2, for each additional animal an additional 20 m2,
(b) the animals placed in the range must be kept under constant surveillance.
8. Elephants must be showered with water at least once a week. At temperatures below 10 ° C, this may be replaced by washing contaminated parts of the body and brushing the skin.
9. Notwithstanding the time spent on the show, all animals are employed for at least 1 hour a day by education or dressage or walking accompanied by a nurse or other activity.

SPECIAL CONDITIONS FOR THE WELFARE OF FRENCH FAMILY
1. The internal temperature of stables at zebras and African donkeys shall be at least 10 ° C.
2. Boxes for holding horses, zebras and donkeys shall have a minimum area of 4 m2 for each animal with a faucet height of 100 cm, a minimum area of 6 m2 for 120 cm, a minimum area of 8 m2 for 140 cm, a minimum area of 10 m2 for 160 cm, a minimum area of 12 m2 for 180 cm and a minimum area of 16 m2 above 200 cm.
3. The side walls of the horse holding boxes are designed so that the horse can see the other horse housed.
4. Equidae shall not be bound during housing, and individuals under 2 years of age shall not be kept in mobile devices.
5. Zebras and donkeys are housed in groups.
6. Equidae must have an outdoor range for everyday use. The range area for horses and donkeys is at least 100 m2 for 1 to 5 animals, for each additional animal it is necessary to increase this area by 10 m2. The zebra range area is at least 250 m2 for 1 to 10 animals, it is necessary to increase this area by 10 m2 for each additional animal.

SPECIAL CONDITIONS FOR LAMP AND AMOUNT
1. Lamas and camels may be kept year-round in the open air, with unheated stables (shelters) available, which provide space for all animals of the herd, with dimensions of at least 4 m2 for camels for 1 animal, for lames 2 m2 for 1 animal. These shelters shall be secured against draught.
2. For llama and camel breeding, the following conditions shall be met:
(a) llama and camels must be kept in individual or group boxes with a minimum area of 12 m2 for individually housed camel and 8 m2 for individually housed llama; in addition, 4 m2 or 2 m2 for each additional llama must be added for each additional camel;
(b) camel females behave in groups; camel males can be housed individually;
(c) camels and lamas must not be permanently tied;
(d) the bedding must be dry and clean,
(e) the roofed part of the enclosure with the bedding must be provided, so that all animals are protected from rain and snow;
(f) the outdoor range for 1 to 3 camels shall have an area of at least 150 m2, and 25 m2 more for each additional animal. The outdoor area for 1 to 3 llama shall be at least 75 m2 and 15 m2 more for each additional animal. The outdoor enclosure shall have natural soil or sand and be equipped with items to wipe and scratch.

SPECIAL CONDITIONS FOR TERRITORIAL ANIMALS
1. Turoves from cold climatic zones shall have a draught-protected or non-heated stable in the enclosure. Turoves from tropical and subtropical zones must be kept in the animal compartments, including stables, heated to at least 15 ° C, and have an outdoor area where they can stay for part of the day and in winter.
2. Turoves from cold climatic zones may be kept in unheated stables, they must have dry bedding, turoves from tropical and subtropical zones must have a minimum temperature of 8 ° C in the indoor area for animals during the winter.
3. Turtles must not be tied during housing.
4. The minimum indoor area for turoids shall be 6 m2 per 500 kg body weight. A discharge with non-slip surface shall be established, in particular due to the slippiness and abrasion of the hooves. The outdoor area for 1 to 5 animals shall be at least 100 m2 and 10 m2 more for each additional animal. When housed in individual animal boxes, the area of the box shall be at least 12 m2.

SPECIAL CONDITIONS FOR THE TERRITORY OF DELPHILITIES
1. Dolphins must not be reared and used for dressage in mobile animal dressage devices.
2. Dolphin breeding must be carried out in a two-pool system, additional pools must be available for the treatment and separation of animals according to the number of animals.
3. For a group of up to 5 adult jumping dolphins, the following minimum dimensions shall be met:
(a) the smallest water area of the whole pool complex must have a minimum of 400 m2, an additional 75 m2 is required for each additional animal;
(b) the total volume of water must be at least 1500 m3, 250 m3 for each additional animal;
(c) the group must at any time have access to the entire swimming pool complex with a minimum surface area of 400 m2, unless this is prevented by zoological or veterinary reasons;
(d) for pools which are exclusively intended for breeding and do not hold any public appearances, the water area shall be at least 75 m2 for the adult animal. The young are considered immature until the age of autonomy and social inclusion. The total volume of water shall be at least 250 m3 for the adult animal,
(e) the horizontal dimensions of both units of the two-pool system (defined as the diameter of the largest circuit) shall be at least 7 m. The smallest depth of the two-pool system is 3.5 m, at the pool for the performance (at 20% of its area) at least 4 m. Separating pools or pools which serve to separate animals or for veterinary treatment may have a depth of less than 3,5 m Areas of shallow water between 1,5 m and 2 m shall be available,
(f) free space above the performance facility shall be at least 7 m high, space above other tanks of the breeding system at least 2,5 m high
4. The conditions referred to in point 3 shall apply to the holding of a jumping dolphin with an average body length of 250 to 270 cm and a weight of 150 to 280 kg. For other species the size ratios shall be adjusted accordingly according to the size and weight of the adults of the species concerned.
5. The water shall meet the following quality requirements and physical and chemical parameters:
(a) it must be clean, clear and hygienic. Temperature tolerance range is 10 to 28 ° C, optimal between 18 and 21 ° C. The pH value shall be between 7,5 and 8,5, the optimum pH being 7,8. The salt content must vary between 2,0 and 3,5%, i.e. 20 to 35 g NaCl per litre of water. The potassium permanganate content must be below 50 mg per litre of water, nitrate concentrations below 100 mg per litre of water and total chlorine content below 2 mg per litre of water, pool systems must be well flowing,
(b) the water of the whole breeding system must be filtered, cleaning, performance check and filter replacement must be regularly carried out, and water exchange, as appropriate;
(c) the addition of chlorine may be made in the form of gas (gaseous chlorine) or in the form of a solution (potassium perchlorate). The chlorine solution can only be directly added if there are no animals in the tank,
(d) the temperature, pH, chlorine and salt content must be checked daily. Potassium permanganate and nitrate concentrations must be checked four times a year. The tanks shall be capable of being completely emptied.
6. Other farming conditions are as follows:
(a) air above the water level shall not contain dust and its relative humidity shall be at least 60% and the temperature shall be between 10 and 24 ° C;
(b) natural light shall be provided, additional artificial lighting shall correspond to the spectrum of natural light;
(c) the animals must be protected from excessive noise, the ambient noise must not exceed 40 dB above the audibility threshold;
(d) keeping outside is only permitted if the air and water temperature fluctuations do not disturb the well-being of the animals, the air quality is safe and the water tanks can be maintained without freezing.
7. Dolphin breeding must be carried out in socially tolerable groups of at least 2 animals. Only one male should live in a breeding group. Separate possession of animals of 1 species must be exceptional if required by the health status of the animal, the disease measures, or if pregnant female or aggressive individual.
