DECLARATION
of 14 November 2024
amending Decree No. 207 / 2001 Coll., implementing Act No. 301 / 2000 Coll., on Matrices, Names and Surnames, and amending certain related acts, as amended
The Ministry of the Interior provides, pursuant to § 96 (1) (a), (b), (c), (d), (i), (j), (k), (l) and (n) of Act No. 301 / 2000 Coll., on Matrices, Name and Surname, and on the amendment of certain related laws, as amended by Act No. 165 / 2004 Coll., Act No. 279 / 2019 Coll., Act No. 414 / 2023 Coll. and Act No. 123 / 2024 Coll.:

1. In Article 2, the words "for marriage 'shall be added at the end of point 10.
2. In Paragraph 2 (12), the comma after the word "sheet 'and" if death for the duration of partnership' is deleted.
3. Paragraph 2 (14) reads as follows:
"14. Certificate of legal capacity to conclude partnerships'.
4. In Article 2, the words "for marriage 'shall be added at the end of point 15.
5. In Article 2 (18) and (19), the word "registered 'shall be inserted after the word" book'.
6. In Article 2 (20), the word "registered 'shall be inserted after the word" o'.
7. Paragraph 2 (21) and (22) read as follows:
"21. Questionnaire for the conclusion of a partnership
22. Partnership Protocol '.
8. In Article 2, at the end of point 29, the dot is deleted and the following points 30 and 31 are added:
"30. Marriage certificate for partnership
31. Certificate of marriage for partnership. '
9. in Article 2a (1), "20 and 23" is replaced by "20, 23 and 30."
10. in Articles 3 (1) and (3) and 5 (1), the words "or partnership" shall be inserted after the word "marriage" and the words "registered" shall be inserted after the word "creation."
11. in Paragraph 9 (2), the word "origin" shall be replaced by "partnership or registered establishment."
12. In Article 16, at the end of paragraph 2, the sentence "Closed partnerships shall be entered in the register according to the surname of both partners."
13. At the end of Section 21, the words "and partnership 'shall be added.
14. in Article 21 (1) and (2), the words "or partnership" shall be inserted after the words "marriage."
15. In Article 21, the words "or partnership 'shall be added at the end of the text of paragraph 2.
16. In Article 21, paragraphs 3 and 4 are added:
"(3) If the marriage data are entered in the relevant matrix sheet in the marriage book, the words" / partnership ', "/ PARTNER / KA' and" / partnership 'shall be crossed by a horizontal line.
(4) Where the data on the partnership are entered in the relevant matrix in the book of marriage, the words "marriage / '," MANZEL /', "MANZELKA / 'and" marriage /' shall be crossed by a horizontal line. '
17. In Section 21a, the word "registered 'is inserted after the word" Minutes'.

25. In Article 29, the words "or a certificate of compliance with the requirements of the Civil Code for the conclusion of a partnership 'shall be inserted after the word" marriage' and the words "or partnership 'shall be added at the end of the text of Article 29.
26. In Article 30 (1), the words "or a certificate of legal capacity to conclude a partnership 'shall be inserted after the word" marriage' and the words "or partnership 'shall be added at the end of the text of the paragraph.
27. in Paragraph 30, paragraph 2 is deleted;
Paragraph 3 shall become paragraph 2.
28. in § 31 (2) of the introductory part of the provision, § 31 (2) (b), § 31 (3) of the introductory part of the provision, and in § 31 (3) (c), the words "or partnership" shall be inserted after the word "marriage."
29. In Paragraph 32 (2), the words "or partnership 'are inserted after the word" marriage' and the words "or partner 'are inserted after the word" spouse'.
30. In Article 32 (3) of the introductory part of the provision, the words "or partnership 'shall be inserted after the word" marriage'.
31. in Paragraph 33 (1), the word "creation" shall be replaced by "partnership or registration."
32. in Paragraph 33 (2) (d), "15" is replaced by "12."
33. In Article 35, paragraph 6 is added:
"(6) A candidate who did not show up for the test without due apology or withdrawal from the test failed the test. A candidate who could not attend the test for a serious reason and whose failure to participate has been duly excused shall be appointed by the Regional Authority for a replacement period. '
34. In Annex No 1, in the part of the Karlovy Vary Region, in the column "Community of extended application ', in point 7," Sokolov', in the column "Matrix Office ', point 8," Lomnice' and in the column "List of municipalities, urban areas, urban districts and military estates of the administrative district of the matrix office ', points 1 and 2 are deleted.
In the column "Matrix Office ', points 9 and 10 are renumbered as points 8 and 9.
35. In Annex 1, in the part of the Karlovy Vary Region, in the column "Community with extended application ', in point 7," Sokolov', in the column "Matrix Office ', in point 9," Sokolov', in the column "List of municipalities, urban areas, urban districts and military estates of the administrative district of the Matrix Office ', point 2 is inserted after point 1." Points 2 to 6 shall be renumbered as points 3 to 7.
36. In Annex No 1, in the part of the Karlovy Vary Region, in the column "Enlargement Community 'in point 7." Sokolov', in the column "Matrix Office 'in point 9." 42. In Annex 1, in the part of Vysočina, in the column "Community of extended application ', in point 14." Great Meziríčí', point 4. In the column "Matrix Office ', points 5 and 6 are renumbered as points 4 and 5.
43. In Annex 1, Part Vysočina, in the column "Enlarged municipality ', in point 14." Great Meziríčí', in the column "Matriční úřičí ', in point 5." 44. In Annex No 2 to Model 6, the word "/ partnership 'is inserted after the word" marriage' and the word "/ partnership 'is inserted after the word" marriage'.
45. In Annex No 2 to Model 6, "MAN 'is replaced by" MANZEL / PARTNER / KA' and "WOMAN 'is replaced by" MANZELKA / PARTNER / KA'.
46. In Annex No 2 to Model 6, the words "MEN '," WOMEN' and "MANJELS 'are deleted.
47. Model 14 of Annex 2 reads as follows:

In Annex No 2 to Model 16, the words "marriage or death certificate of the deceased spouse, or, where applicable, final decision of the court of annulment of the partnership, or death certificate of the deceased partner 'are replaced by the words" marriage / partnership *) or final decision of the court of termination of the previous registered partnership, or death certificate of the deceased spouse, or death certificate of the deceased partner'.
49. In Annex No 2 to Model 16, the words "marriage or death certificate of the deceased spouse, or final decision of the court to abolish the partnership, or death certificate of the deceased partner 'are replaced by the words" marriage / partnership *) or final decision of the court to abolish the previous registered partnership, or death certificate of the deceased spouse, or death certificate of the deceased partner'.
50. In Annex 2, models 21 and 22 read:

Transitional provisions
1. The Matrix Form of the Matrix Book of Marriage, in accordance with model 6 of Annex 2 to Decree No 207 / 2001 Coll., as effective before the date of entry into force of this Order, may be used until 31 December 2035, provided that the amendments referred to in points 44 to 46 of Article I are indicated.
2. A registered partnership or similar ratio of persons of the same sex, concluded abroad before the date of entry into force of this Decree, which was not entered into a special register before the date of entry into force of this Order, shall be entered in a special register as a partnership.
3. A registered partnership or a similar ratio of persons of the same sex, concluded abroad before the date of entry into force of this decree, entered in a separate register before the date of entry into force of this decree as a registered partnership, shall be entered in a separate register as a partnership at the request of both partners.
Efficacy
This Decree shall take effect on 1 January 2025.
