DECLARATION
of 21 October 2013
on the establishment of protection zones for the natural health source of the pelloid bearing Vrka and the definition of specific protective measures
According to § 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Areas and on the amendment of certain related laws (Spa Act):
§ 1
Establishment of protection zones
(K § 21, 22 and 23 of the spa law)
(1) For the protection of the natural health source of peloid (hereinafter referred to as "the source") of the bearing Vrbka, district Litomerice, protection zones I and II shall be established.
(2) Level I protection zone consists of the territory on which the source is located. The area consists of land parcel number 906 / 3 in the cadastral territory of Mšené-bath and land parcels number 796 / 1 and 796 / 2 in the cadastral territory of Vrbka u Roudníček.
(3) The definition of the protection zone I is graphically marked in a copy of the cadastral map of the scale 1: 1 000, which is shown in Annex 1 to this decree, on the base map of the Czech Republic, on the scale 1: 10 000, which is shown in Annex 2 to this decree, and on the base map of the Czech Republic, on the scale 1: 50 000, which is shown in Annex 3 to this decree.
(4) The Class II protection zone consists of land parcels located in the cadastral territories of the Mšenespa, Roudník and Vrbka near Roudníček, which are listed in Annex 4 to this Decree.
(5) The definition of protection zone II is graphically marked on the base map of the Czech Republic in the scale 1: 10 000, which is shown in Annex 2 to this order, and on the base map of the Czech Republic in the scale 1: 50 000, which is shown in Annex 3 to this order.
§ 2
Definition of specific safeguard measures
(K § 22, 23 and 24 of the spa law)
(1) In the area of the protection zone I of the source, entry is prohibited under the spa law.
(2) The following shall be prohibited in Level II protection zone:
(a) to carry out drainage work and treatment of watercourses likely to endanger the natural groundwater regime, except for the routine management of the water flow of the Podbradecký stream and the land under water flow management;
(b) carry out melioration work;
(c) to build or operate objects for agricultural production, industrial production objects and other objects in which it is a significant component of the technology of handling defective substances which may endanger the quality of surface or groundwater;
(d) to build or operate landfills of hazardous waste and to store hazardous waste;
(e) to operate in the forests of a special destination in such a way that the natural groundwater regime could be adversely affected;
(f) discharge waste water and defective substances into surface or groundwater waters, including their application to the surface of the terrain;
(g) to build or operate fuel service stations;
(h) use persistent preparations of a specific type of chlorinated hydrocarbons;
(i) to export the contents of the immediate pit, urine pit and manure of livestock to land in the protection zone;
(j) establish or operate permanent storage facilities for petroleum products, fertilisers and chemical products;
(k) apply chemical plant protection products for which the effect on the quality or quantity of groundwater or source cannot be clearly excluded.
(3) In the protection zone II, the entry of vehicles carrying cargo liable to cause water pollution is prohibited on the road to land parcel number 783 in the cadastral territory of Vrka u Roudnice.
§ 3
Repeal
Decree No. 6 / 2001 Coll., on the protection zones of the natural medical source of the peloid bearing Vrbka spa site Mšené-Spa, is deleted.
§ 4
Efficacy
This Decree shall take effect on 1 December 2013.
